Have IRT review and determine if additional monitoring necessary. Lyle, Herman Dairy and Little Troublesome Creek. Non -instrument projects. Sliver Moon -would like to close in 5 years, credit release project. Contractual issue- DMS believes this is ready for closure. Todd —contractual issue discussion about 5 vs. 7 years. Is this contractual or early closeout? Pre - Instrument. The credit release for Sliver Moon should be 7 years, DMS had the understanding they could close in 5 years. Todd feels the IRT assumed 7 years. Tim suggests we put on docket to be reviewed. Eventually moving towards no closeout meeting, only credit release meetings. Sliver Moon issue was the outfall structure. Reported that after Hurricane Matthew the site was 6 feet under water, the project held. Vegetation reported to be successful. Year 5 report has a lot of photos. IRT will review the site at credit release visit for success. Lyle Creek —the issues have been addressed and ready for site visit. Lyle had no issues with wetlands, only one section of stream. This is year 5. Todd questions upstream area and sediment input now that check dam has been removed. If it was originally proposed to close in 5 years, we'll look at it. If it was proposed to close in 7, it will have to be looked at on a case by case basis. The wetland component needs to be reviewed separately from the stream component. Sites with problems should go the full 7 years as proposed. Mac —would need to extend to 7 years for Lyle Creek, they were told this on site. Tim requests a review of all sites pre -monitoring release to decide how to proceed. Wildlands-7 year for wetlands was established in 2008, streams in 2011. Todd —people assume that if statement of potential closeout at 5 years is made then sites can close out at year 5. It is only for exceptional sites. Lyle site has had issues so we assume it should go to year 7. Wildlands—discussion is really because of wetlands and the wetlands have no issues. Tim- Everything pre -credit release we need an IRT review at year 5 to see how to proceed. Other sites that are due for closeout that have had repairs: • Beaver Creek — repairs (2004, 2008, 2014) early repairs more extensive than in 2014, 4 or 5 bends they installed mattress brush toes on lower 3ra • McIntyre- repair (2015/2016) six discreet small spot repairs, 4 or 5 bends they put mattress brush toes on lower third. • McKee Creek — repair (2017) 375 foot section where small structure failed, that area repaired. Currently in year 7 of monitoring. • Little Alamance Creek — Easement extinguishment potential, city wants out of easement 2. Set Dates for 2017 DMS Closeout and Credit Release 4 days for four sites in Coastal Plain 5 days for six sites in Mountain Region 10 days for 16 sites in Piedmont Credit Release: MY1 =6 MY2=16 MY3=14 MY4=1 MY5=1 Total=38 Schedule 2 weeks to review sites. Mac sees 5 he would like to visit. Todd -let's consider dates carefully so the releases are not held up and do not conflict with close-out dates. Possibly combine some credit release site visits with close-out visits if in proximity. Tim- going to test drone technology. Would like to show us drone results and have IRT compare results in the field. 3. Millstone Creek Mitigation Plan Prospectus posted Dec 5, 2016. A DBB site in Randolph County. Had a traditional stream site design. Regenerative Stormwater Design proposed due to pasture nutrient input from hog lagoon spraying. Potential credit ratio of 1.5:1 with assumption that a more detailed prospectus be submitted. Baseline monitoring station map presented. Data collection by NCSU Barbara Doll and associate. 3 monitoring sites, surface water every two weeks. Groundwater gauges installed. Found elevated levels of nitrogen in groundwater and surface water. North tributary has higher level of nitrogen. Average level of nitrogen is 15 mg/L. NC State working on a conceptual plan (30%). High marsh/Lowmarsh wetlands proposed in conjunction with stream design and storm water design. Jurisdictional area concern regarding storm water design proposal. EPA's take on putting these structures on a JD stream to treat storm water is they have issues in JD waters but they can possibly permit their way out of this. EPA (Todd) meeting with mitigation team to discuss this today. DMS-It wouldn't be a change in use so it wouldn't be a problem. USACE-The concern is placement of a treatment facility in jurisdictional waters. In the past, this has been considered a loss of waters. In addition, this would not qualify for a NWP 27. USACE might require a standard permit. Kathy Matthews - Concerns about placement - headwaters vs. center of stream. Todd — Although this project was initiated prior to our most recent guidance, we would allow credits bumps for the additional monitoring and wider buffers. Follow-up Action: Todd Bowers will report back on feasibility of permitting this project. Plan will need to be reviewed. IRT members would like to schedule a site visit. 4. Update on Previous Closeouts with Active Contingencies List of sites and summary of contingency items. Three Mile -Raymond wrote letter regarding transfer to stewardship. Meredell Farm -Inner boundary marking. Two zones, one can be maintained in herbaceous vegetation and one cannot. DOT should mark these areas. Bugaboo Creek -tidying up repairs on main tributary, banks and some vane structures. Irwin Creek -additional monitoring required. Jumping Run Creek -lateral ditch breach. Repair complete. Site is very wet, water pouring out of lateral ditch. Wells are showing wetland has not been drained by breach in ditch. Mickey -ditch breach was draining water on back side negatively affecting wetland. Also how stable is the cut? Todd -Concern that it will migrate onto site. . Tim — once water recedes they can review and make sure it held. Mickey — has been 4 years since he was out there. Valleyfields Farm- waiting on decision, signage issues. Todd -signs are required to identify easement boundaries. Credit reduction based on maintenance (utility line, boundary). Potential replanting will depend on extent of mowing. We need a map to show. Leilani (DOT)-Sinage not needed on interior of property because it's private, little outside influence. Advised landowner they could hand clear vines and briers. Todd -Crews are hired for maintenance so signs will show areas where maintenance is permitted. Not all vines and briers are invasive species so they all shouldn't be removed. Preservation: Some areas were non jurisdictional, will not meet standards for mitigation. Concerns about awarding credit at initial proposed credit ratios. Action item for DMS: Utility ROW encroachment map and Preservation Reach map. Wake Forest CC -legal opinion of easement enforcement. Easement was poorly written. Cutawhiskie Creek-terracell repairs 2016; additional visual monitoring. Repairs yet to be completed. They will submit design. Stricker Branch -assets in question. Site needs to be revisited. 5. DMS Delayed Closeout Sites Dye Branch -Litigation, repairs. Suther-Repairs, asset adjustment, monitoring firm contracting. Jacksonville Country Club -Stream repair and monitoring 6. 2017 IRT Schedule: Monitoring Credit Release: April 3-4 (office) April 5-11 (field visits) Coastal Closeouts: April 24-28 Piedmont Closeouts: June 19-23 July 10-14 Mountain Closeouts: August 21-25 IRT Meeting Dates: January 10, 2017 (downtown) February 7, 2017 April 11, 2017 June 6, 2017 August 8, 2017 October 10, 2017 December 12, 2017 Open Dates: To be scheduled at future IRT meetings Little Alamance: January 4, 2017 Leilani: Potential encroachment issues on DOT mitigation sites. Need to convene group to come up with guidance. Todd sent draft out. Action: Need to finalize. Meet January 18, 2017 tentatively (Wake Forest Regulatory Office). Tim: HQP sites —Action: need a letter stating sites are closed. Todd will follow up with Tim.
