Fort Fisher State Historic Site Low Density Stormwater Project New Hanover County Dear Mr. Steele: Dee Freeman Secretary The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for Fort Fisher State Historic Site on August 15, 2011. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 940822 dated September 16, 2011, for. the construction, operation and maintenance of the built -upon areas and veaetated conveyances associated with the subject project. This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein, and does not supercede any other agency permit or approval that may be required. Please pay special attention to the requirements for Operation and Maintenance, limited built -upon area, prohibition of extensive piping, recorded deed restrictions, and permit transfer procedures. Failure to establish an adequate system of maintenance, to stay below the permitted amount of built -upon area, to keep the piping to a minimum, to record the deed restrictions or to follow the prescribed permit transfer process will result in future compliance problems. The modifications covered by this permit include: Identification of the 68 acre project area. The addition of 4,792 square feet of new 6 wide sidewalk to provide for mobility impaired access to the monuments and beach access points of the site. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a petition with the Office of Administrative Hearings (OAH). The petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. A petition is considered filed when it is received in the Office of Administrative Hearings during normal office hours. The OAH accepts filings Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m., except for official state holidays. The petition may be filed by facsimile (fax) or electronic mail by an attached file (with restrictions) - provided the signed original, one (1) copy and a filing fee (if a filing fee is required by NCGS §1506-23.2) is received in the OAH within seven (7) business days following the faxed or electronic transmission. Unless such demands are made this permit shall be final and binding. You should contact the OAH with all questions regarding the filing fee and/or the details of the filing process. STATE OF NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES DIVISION OF WATER QUALITY STATE STORMWATER MANAGEMENT PERMIT LOW DENSITY DEVELOPMENT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules and Regulations PERMISSION IS HEREBY GRANTED TO NC Department of Cultural Resources Fort Fisher State Historic Site 1601 Fort Fisher Boulevard, Kure Beach, New Hanover County FOR THE construction, operation and maintenance of a 30% low density development in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules") and the approved stormwater management plans and specifications, and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. This permit covers a total of 356,757 square feet of built -upon area, of which 351,965 square feet is existing and previously permitted, and 4,792 square feet is proposed new sidewalk construction. 2. Per the 2008 rules, this site is vested to the 1994 low density limit of 30% within the original 68 acre project area. The overall tract built -upon area percentage for the 68 acre project area must be maintained at or below 30%, as required by Section .1005 of the stormwater rules. 3. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. 4. No piping is allowed except that minimum amount necessary to direct runoff beneath an impervious surface such as a road or to provide access. 5. The project shall provide and maintain a 30-foot wide vegetated buffer between built -upon area and surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers and the mean high water line of tidal waters. 6.' Roof drains must terminate at least 30 feet from surface waters. Page 3 of 6 State Stormwater Management Systems Permit Number SW8 940822 Mod. II. SCHEDULE OF COMPLIANCE 1. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 2. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 3. Prior to the subdivision and/or sale of this project, in whole or in part, the permittee shall have submitted a permit modification and received a permit at least 30 days prior to the final sale. 4. Construction of additional impervious areas such that low -density requirements are no longer met will require a permit modification prior to construction. An engineered system may be required to collect and treat the runoff from all built - upon area associated with the project, including that area permitted under the low density option. 5. Filling in, piping or altering any vegetative conveyance (ditches, swales, etc.) associated with the permitted development, except for minimal driveway crossings, is strictly prohibited by any persons. 6. Projects within CAMA's Area of Environmental Concern (AEC) are subject to a reduction of the permitted amount of built -upon area due to CAMA jurisdiction within the AEC. The more restrictive of the two calculated BUA's shall govern. 7. Prior to the development of any future area or additional phase noted on the approved plans for which an allocation of built -upon area has been made, a permit modification must be submitted to and approved by the Division. The modification must demonstrate that the built -upon area does not exceed the maximum amount permitted under this permit and that it meets the intent of low density development per the stormwater rules and available guidance. 8. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. c. Further development, subdivision, acquisition, or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought or for which a CAMA Major permit was issued. d. Filling in, altering or piping any vegetative conveyance shown on the approved plan. e. Development within the designated future development areas. 9. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built -upon surface. 10. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b Sediment removal. C. Mowing, and re -vegetating of the side slopes. d. immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 12. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been constructed in accordance with the approved plans. 13. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. III. GENERAL CONDITIONS Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until modified, revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. This permit is not transferable to any person or entity except after notice to and approval by the Director. The Director may require modification or revocation and re -issuance of the permit to change the name and incorporate such other requirements as may be necessary. At least 30 days prior to a change of ownership, or a name change of the permittee or of the project, or a mailing address change, the permittee shall submit a completed and signed Name/Ownership Change form to the Division of Water Quality accompanied by the required documentation as listed on the form. The approval of this request will be considered on its merits, and may or may not be approved. 6. The permittee is responsible for compliance with all permit conditions until the Director approves a transfer of ownership. Neither the sale of the project in whole or in part, nor the conveyance of common area to a third party, constitutes an approved request to transfer the stormwater permit. 7. The permittee grants permission to DENR Staff to enter the property during normal business hours, for the purpose of inspecting all components of the stormwater management facility. 8. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may .be imposed by other government agencies (local, state and federal), which have jurisdiction. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. DEED RESTRICTIONS AND PROTECTIVE COVENANTS For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective covenants are required to be recorded prior to the sale of any lot. if lot sizes vary significantly or the proposed BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and protective covenants forms can be downloaded from htU2://12ortal.ncdenr.org/web/wq/ws/su/statesw/forms-docs. Download the latest versions for each submittal. In the instances where the applicant is different than the property owner, it is the responsibility of the property owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring that the deed restrictions are recorded. By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and protective covenants for this project, if required, shall include all the items required in the permit and listed on the forms available on the website, that the covenants will be binding on all parties and persons claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted without concurrence from the NC DWQ, and that they will be recorded prior to the sale of any lot.
