The Division understands that connecting to the closest available private or public sewer treatment facility could cost$483,500,deemed prohibitively expensive by your authorized consultant,CEtech Associates, PA. We further understand from site-evaluation reports that there is insufficient repair area,and that onsite soils are otherwise unsuitable for a septic system(REF: letter from Jackson County Department of Public Health,August 7, 2009).We therefore concur that the proposed treatment system is a viable discharge alternative. Please note that,as holder of this Certificate of Coverage(COC),you must maintain and operate this treatment system so as to meet all State and Federal surface water-quality standards.You must provide and keep records of its operation and maintenance,or enter into a maintenance contract to provide these records and maintenance services[see Authorization to Construct]. General Permit Coverage. Authorization to Construct(A to C). In accordance with your application for sanitary sewer discharge from Wilmot Baptist Church, the Division hereby authorizes new the construction of: • septic tank (3000 gallons) • recirculation tank,(1,850 gallons) • recirculating sand filter(1,000 gpd) • Ultraviolet(UV)disinfection(double-bulb: 6 gpm)with alarm • Control panel and effluent sample port • other appendages, fencing, and appurtenant piping ��, • outfall erosion control(rip-rap ditch liner) This system discharges treated domestic sanitary wastewater only(not to exceed 1,000 gpd)to Nations Creek [segment 2-79-47],a Class C waterbody within subbasin 04-04-02 of the Little Tennessee River Basin. Operation and Maintenance. Please note that the Permittee is responsible to meet all surface water-quality standards by maintaining and operating this treatment system including records. Responsibilities under this CoC include proper inspection and maintenance of the Ultraviolet (UV)Disinfection Unit and its alarm features(Drawing C-3)in accord with manufacture- recommended protocols, including cleaning and/or replacing UV bulbs.DWQ concurs with your consultant's recommendation that you should contract for these services with a manufacture's- Certified Operator. The Permittee shall document all maintenance activities.Maintenance records shall be kept onsite, available for DWQ inspection,for the life of the treatment facility. Sand specifications and sand-filter details specified on the Drawings(C-2) are hereby approved. All elbow piping shall conform to the long-sweeping type. All cleanouts must be housed in meter boxes below grade. This treatment system shall be located at least 10 feet away from the dwelling, at least 50 feet from the property line, and at least 100 feet from-any water-supply well either on-or off-site. The system shall also be located and constructed above any applicable 100- year flood line. - The Permittee or responsible Engineer shall notify DWQ's Raleigh Regional Office(919-791- 4200) a minimum of forty-eight(48) hours in advance of operating the installed facilities. This will serve to provide DWQ an opportunity to inspect facilities as built.Such notification to the regional office supervisor shall be made during normal office hours from 8:00 a.m. until 5:00 p.m. Monday through Friday, excluding State holidays. , ' Upon completing construction and prior to operating this permitted facility, a North Carolina-registered engineer shall sign and submit to DWQ the attached Engineer's Certification form certifying that the permitted facility has been installed in accordance with the NPDES Permit,the Certificate of Coverage, this Authorization to Construct, and the approved plans and specifications. Compliance with the above shall include a leakage test performed on the septic tank [existing], the pump tank [existing] and the dosing tank [new] to insure that any exfiltration occurs at a rate not to exceed twenty(20)gallons per twenty-four(24)hour per 1,000 gallons of tank capacity.. The Engineer's Certification shall serve as proof of compliance with this condition. This AtoC permit is issued in accordance with Part III, Paragraph of NPDES General Permit NCG550000, and is subject to revocation unless wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in this General Permit. In the event that the facilities fail to perform satisfactorily, including creating nuisance conditions,the Permittee shall take immediate corrective action as may be required by this Division,such as the construction of additional or replacement wastewater treatment(s)or disposal facilities. Failure to abide by the requirements of this A to C permit may subject the Pennittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. Dear Mr. Ward, The Jackson County Department of Public Health, Environmental Health Division on August 7,2009 evaluated the above-referenced property at the site designated on the plat/site plan that accompanied your improvement permit application. According to your application the site is to serve a church with a design wastewater flow of 750 gallons per day. The evaluation was done in accordance with the laws and rules governing wastewater systems in North Carolina General Statute 13OA-333 including related statutes and Title 15A, Subchapter 18A, of the North Carolina Administrative Code,Rule. 1900 and related rules. Based on the criteria set out in Title 15A, Subchapter 18A, of the North Carolina Administrative Code, Rules .1940 through.1948,the evaluation indicated that the site is UNSUITABLE for a ground absorption sewage system. Therefore,your request for an improvement permit is DENIED. A copy of the site evaluation is enclosed. PRIMARY INVESTIGATOR'S CREDENTIALS Timothy P.Harlan: N.C.Licensed Soil Scientist(Certification# 1200) SITE HISTORY AND PHYSICAL CHARACTERISTICS The subject property is located off of Thomas Valley Road in Jackson County. Site - vegetation consists of grass cover. Nations Creek encompassed the far boundary of the site(away from the road). METHODOLOGY The site was investigated on July 1,2008 by making observations of the landscape(slope, drainage patterns,past use,etc,)as well as soil properties(depth,texture,structure, seasonal wetness,restrictive horizons,etc.)with hand in borings to a depth?50 inches when possible. Seven soil borings were made with a hand auger throughout the area and the area was extensively probed Each auger boring was labeled in the field with flagging tape. A description of each boring is attached FINDINGS The soils present at the site are limited by a relatively shallow depth to the seasonal high water table(borings 1,2,5 and 7)and the presence of"unsuitable"cut and fill material on the side furthest from the existing church(borings 3,4 and 6). Please note that according to.1957(bxl)(F)fill material needs to consist of Group I soils to be considered usable. The fill material at the site is not able to meet this classifieatioga;, The potentially usable soil borings(1,2,5 and 7)contain a seasonal high water table between 24 to 29 inches. It has been determined that there is insufficient space for both an initial and repair system(s) (even with reducing setbacks to the existing creek by highly treating the effiueat). An available option for this site may be to direct discharge into the surrounding stream (NPDES discharge permit). This option would need to be pursued through the NC Division of Water Quality. Local Government Review Form General Statute Overview: North Carolina General Statute 143-215.1 (c)(6) allows input from local governments in the issuance of NPDES Permits for non-municipal domestic wastewater treatment facilities. Specifically, the Environmental Management Commission (EMC) may not act on an application for a new non-municipal domestic wastewater discharge facility until it has received a written statement from each city and county government having jurisdiction over any part of the lands on which the proposed facility and its appurtenances are to be located. (1) A drainage area of 2.07 sgmi was determined for your point of inte on Nations Creek above Secondary Road 1397 (Thomas Valley Road) a Wilmot. (2) In Table 1 of the above referenced report, there are four partial-re( sites in northwestern Jackson County and southeastern Swain County 1 vicinity of your point of interest for which low-flow discharge estimates provided. Expressing these estimates as low-flow yields (again, flow p square mile of drainage area, or cfsm) provides some indication of the ranges that could potentially be applicable to your point of interest. Tf 7Q10 low-flow yield range is from about 0.23 to 0.58 cfsm (with an av of about 0.42 cfsm). The 30Q2 low-flow yle range is r m about 0.4; about 0.99 cfsm (with an average of about 0.72 cfsm). (3) The regional low-flow relations presented in the above referenced r for this hydrologic area (HA9) results in 7Q10 and 30Q2 low-flow estirr with yield values of about 0.39 cfsm and 0.86 cfsm, respectively. Both 7Q10 and 30Q2 yields are within the above ranges reported for these t statistics. (4) Mean annual runoff for streams in this area is mapped in the above referenced report as being 2.5 cfsm. In some North Carolina basins, the low-flow conditions observed during the recent droughts (1998-2002, 2007-09) resulted in lower low-flow statistics. No formal statewide investigation been completed to document the changes in low-flow statistics since tf droughts. However, where updated analyses have been completed for selected stations, the changes in pre-drought versus updated 7Q10 discharges have shown varying percentage changes of decline. For instance, at the nearby long-term gaging station on Oconaluftee Ri Birdtown in Swain County (station id 03512000, drainage area 184 sqr records since July 1945), the 7Q10 declined about 6 percent between t .cad Mail -allackey@email.dnet.net Page 4 of 9 1998 and 2009 climatic years. Note: The climatic year is the standard annual period used for low-flow analyses at continuous-record gaging stations. Putting together the above pieces of information... Applying the above low-flow yields (in item #1) to a drainage area of sqmi results in 7Q10 flow estimates ranging from 0.48 to 1.2 cfs (aver about 0.87 cfs). Similarly, 30Q2 flow estimates range from about 1.0 cfs (average about 1.5 cfs). Applying the yield for mean annual runoff #4) to the drainage area results in an estimated average discharge of 5 cfs. The properly was evaluated in accordance with North Carolina statutes for waste disposal Systems("Laws and Rules for Sewage Treatment and Disposal Systems",(amended June 2006))as part of the planning process to evaluate areas of soil with potential for subsurface wastewater treatment and disposal. PRIMARY INVESTIGATOR'S CREDENTIALS Timothy P.Harlan: N.C.Licensed Soil Scientist(Certification# 1200) SITE HISTORY AND PHYSICAL CHARACPERWITCS The subject property is located off of Thomas Valley Road in Jackson County. Site vegetation consists of grass cover. Nations Creek encompassed the far boundary of the site(away from the road). METHODOLOGY The site was investigated on July 1,2008 by making observations of the landscape(slope, drainage patterns,past use,eta)as well as soil properties(depth,texture,strncare, seasonal wetness,restrictive horizons,ern.)with hand anger borings to a depth>50 inches when possible. Seven soil borings were made with a hand auger throughout the area and the area was extensively probed. Each anger boring was labeled in the field with flagging tape. A description of each boring is attached FINDINGS The soils present at the site are limited by a relatively shallow depth to the seasonal high water table(borings 1,2,5 and 7)and the presence of"unsuitable"cut and fill material on the side fnrthestifrom the existing church(borings 3,4 and 6). Discontinuance of the Inspection and Maintenance Agreement places the system and equipment out of service,which places the equipment in noncompliance with any and all expressed or implied warranty agreements. If the system is placed out of service,the local Health Department may be notified and an Out of Service Notification recorded by the Equipment Dealer or Authorized Service Provider. The Equipment Dealer and Authorized Service Provider shall have the authority to record an Out of Service Notification on the property deed,remove this document from the property deed when the equipment is removed from the property,place the system out of service for non-payment of fees or denial of reasonable access to the system for the purpose of inspection and maintenance by the Authorized Service Provider,and release any system information to mortgage,title and insurance companies,or regulatory agencies. The system is equipped for 24 hour performance monitoring. The system includes a telemetry control panel requiring permanent connection to home phone service for reporting system performance to the manufacturer via 800 number service. Telephone service must be established prior to issuance of the Operations Permit and discontinuance of telephone service/access places the system and equipment out of service. This document will be filed by the property owner with the deed of the property upon installation of the equipment. (2) In Table 1 of the above referenced report, there are four partial-re( sites in northwestern Jackson County and southeastern Swain County i vicinity of your point of interest for which low flow discharge estimates provided. Expressing these estimates as low-flow yields (again, flow p square mile of drainage area, or cfsm) provides some indication of the ranges that could potentially be applicable to your point of interest. Tf 7Q10 low-flow yield range is from about 0.23 to 0.58 cfsm (with an av of about 0.42 cfsm). The 30Q2 low-flow yield range is from about 0.4'• about 0.99 cfsm (with an average of about 0.72 cfsm). (3) The regional low-flow relations presented in the above referenced r for this hydrologic area (HA9) results in 7Q10 and 30Q2 low-flow estirr with yield values of about 0.39 cfsm and 0.86 cfsm, respectively. In some North Carolina basins, the low-flow conditions observed during the recent droughts (1998-2002, 2007-09) resulted in lower low-flow statistics. No formal statewide investigation been completed to document the changes in low-flow statistics since tf droughts. However, where updated analyses have been completed for selected stations, the changes in pre-drought versus updated 7Q10 discharges have shown varying percentage changes of decline. Note: The climatic year is the standard annual period used for low-flow analyses at continuous-record gaging stations. Putting together the above pieces of information... Applying the above low-flow yields (in item #1) to a drainage area of e _ sgmi results in 7Q10 flow estimates ranging from 0.48 to 1.2 cfs (aver about 0.87 cfs). Similarly, 30Q2 flow estimates range from about 1.0 cfs (average about 1.5 cfs). Applying the yield for mean annual runoff #4) to the drainage area results in an estimated average discharge of 5 cfs.
