SUBJECT: CAMA Dredge/Fill Permit Application for City of Washington Havens
Garden, Beaufort County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at the NC
Hwy 32 bridge crossing at Havens Garden; adjacent Runyon Creek and the Pamlico River. Our comments
are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through
113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and
Wildlife Coordination Act (48 Stat_ 401, as amended; 16 U.S.C_ 661 et seq.).
The City of Washington proposes to construct a pedestrian boardwalk, a floating kayak platform, and
replace the bulkhead along the shore of the Pamlico River at Havens Garden_ The 70' by 6' pier/walkway
over wetlands near the existing boat ramp in Runyon Creek would lead to a 24' by 5' gangway that
terminates to a 10' by 26' floating platform. The platform would have two kayak/canoe launches. Water
depths in the launch area approach -2' NWL. A concrete sidewalk and pad are proposed within the
NCDWR buffer. The 70' walkway will serve as a connector to the future river boardwalk connector that
was permitted under Permit No_ 90-09. The river boardwalk was not constructed, and the permit has since
expired. The proposal includes 1,100' of bulkhead replacement 2' waterward the existing bulkhead
alignment along the river. The Pamlico River and Runyon Creek at these locations are classified SC NSW
by the Environmental Management Commission and are subject to the NC Division of Water Resources
Tar -Pamlico Buffer Rules. Runyon Creek is designated an anadromous fish spawning area (AFSA) by the
NCWRC.
The NCWRC has reviewed this project proposal and is familiar with the project area and its resources.
We also reviewed and commented during the 2009 and 2011 permitting processes (Dunn 25 July 2011).

We do not object to permit issuance as long as the following recommendations are included as permit
conditions:
• In -water work should adhere to a February 15 — June 30 moratorium to minimize impacts to
AFSA resources.
• Consideration should be given to the addition of stops to prevent the floating platform from
sitting on bottom sediments. Water levels and tides are wind driven in this area and are subject to
fluctuating water depths.
• Impacts to the NCDWR Tar -Pamlico Buffer should be minimized to the greatest extent
practicable. We support comments made by the NCDWR to minimize impacts to their resource.
