Dear Ms. Williams:
On May 3, 2019 the Winston-Salem Regional Office received a written request for a variance to the well construction
rules. Rule 15A NCAC 02T .1606 states that the minimum horizontal separation between an injection well and an
above -ground structure is 10 feet and 15 feet from subsurface utilities.
Two injection wells at the site (IW-1 and IW-2) and one extraction well (EW-2) were installed closer than 10 feet
from the site building. Additionally, the three injection wells (IW-1, IW-2, and IW-3) and the two extraction wells
(EW-1 and EW-2) were installed closer than 15 feet to underground utilities (an electrical line and a sewer line). This
variance request is for locating the wells closer to the building than the 10-foot limit and closer to the subsurface
utilities than the 15-foot limit. Since the contamination plume that is to be remediated is located adjacent to the
building and the subsurface utilities, it was necessary to install the wells closer than the limits outlined in 15A NCAC
02T .1606 The factors specified are sufficient to satisfy the conditions for approval of a variance as defined in 15A
NCAC 02T .1606. The granting of this variance is for the well location only, and in no way relieves the owner or
agent from other requirements of the North Carolina Well Construction Standards, or any other applicable law, rule
or regulation that may be regulated by other agencies.
