Impact Justification (Avoidance and Minimization} Specifically describe measures taken to avoid the proposed impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to Page 9 of 12 freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h?o.enr.state.nc.us/ncwetlands/strmaide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Suite 115 Raleigh, NC 27615 Issued: March 2007 07.0501 1.0 INTRODUCTION & GOALS The BDG Smith Pamlico Associates LLC proposes to construct 404-wetland compensatory mitigation site at Stillwater Subdivision located off HWY 99 near SR 1770 in Beaufort County, North Carolina. This site will be used as compensatory wetland mitigation for impacts planned (.08 acres) in the subdivision. A 3:1 wetland mitigation ratio on .08 acres of wetland impacts was a requirement by the US Army Corps of Engineers. The mitigation concept for this site focuses on creation of 404 wetlands on existing uplands adjacent to existing 404 wetlands. Therefore, this project has been designed to include the following components; 1}Excavating uplands to appropriate elevations for the establishment of targeted adjacent 404-wetland elevation. 2.0 PROJECT APPROACH The Stillwater mitigation site is near SR 1770 and the planned subdivision encompasses 30 plus acres of 404 and coastal wetlands. The site is near Jack Creek that is a tributary to Pungo Creek (refer to topo maps). Uplands/wetlands have been delineated and mapped onsite. Upland vegetation at the proposed mitigation site currently have Loblolly pines (Pinus taeda}, White Oak (Quercus alba), Southern Red Oak (Quercus falcata), and Wax Myrtle (Myrica cerifera) growing onsite. BDG Smith Pamlico Assoc. LLC proposes to remove the existing vegetation and soil from the upland area down to the adjacent wetland grade that will allow surface water exchange from the existing wetlands into the excavated upland area. Existing on-site plant species or "biological benchmarks" were used to identify the plant species and target elevations. Plan and cross sectional views of the Stillwater site are included as a detail on the plan map. 3.0 EXISTING CONDITIONS/ELEVATIONS The existing site consists of three community types; an upland area described above, a 404 wetland area that contains: Loblolly pine (Pinus taeda) in the tree canopy, wax myrtle (Myrica cerifera), and red bay Persea borbonia as the saplings and saw greenbrier (Smilax glauca) at the ground level. Existing site elevations range from 14 feet in the upland areas to 7 feet in the lower areas of the wetland areas. 4.0 PROPOSED MITIGATION COMMUNITIES Stillwater March 2007 Final Mitigation Plan Page Z of 4 A transect was used to identify plant species. The transect extended from lowest to highest elevations within the existing wetland and upland area. Sample points were selected along the transect to represent the lower and upper boundary of the wetland. Plant species were inventoried. The plant species identified and elevations selected for the wetland creation effort resulted from the use of the transect method. 5.1 Wetland Creation Hydrology to the site will be provided by the adjacent existing wetland and stream. The BDG Smith Pamlico Assoc. LLC proposes to conduct mitigation by utilizing an upland area. Upon receiving an approved plan, In early spring 2007 target elevations will be set onsite. Silt fence will be placed around the upland to be excavated. The plan is to remove the existing vegetation and grade the sites to a target elevation of 5.0' nearest the existing wetland. All vegetation and any spoil material will be removed and taken offsite to an upland stockpile area. The site will be accessed from within Stillwater subdivision. The plan is to plant the site with black willow (Salix nigra) and red maple (Acer rubrum) at a density of 1 per 100 sq. ft. Early successional plants such as sedges and rushes should revegitate naturally. If Phragmites australis emerges in the mitigation area it will be controlled with "round-up" herbicide. 5.2 MONITORING PROCEDURES An asbuilt report will be submitted to the US Army Corps of Engineers once the site is constructed. The mitigation site is owned by BDG Smith Pamlico Assoc. LLC and lies outside of DOT R/W. Routine road maintenance or mowing will not disturb the sites being restored to wetland elevation. Emergent wetland vegetation will be monitored at randomly located sample plats using GIS software. The location of the sample plots in the field will be determined using real-time GPS. A minimum often 1.0 m2 sample plots will be located in the wetland areas. Vegetation at the site will be visited twice a year and monitored for five years, or longer as necessary, following the completion of the grade work. 5.3 SUCCESS CRITERIA The success of the wetland creation project will be evaluated using the frequency and average percent cover of emergent herbaceous vegetation. The site will be considered a success if the calculated value for frequency is 0.5 and the calculated value for average percent cover is at least 80% by the end of the fifth growing season. Frequency will be determined by f=nX/n,,, where f= frequency, n,~= number of plots where emergent herbaceous vegetation occurs, and ny total number of plots. Average percent cover will be determined by c=E~n, where c= average percent cover, E~ =the sum of estimated foliar cover for all plots, and n= the total number of plots. Table 1 summarizes wetland mitigation credits that will be generated by constructing Stillwater Mitigation Site. Credits at the site are "creation". Table 1.
