Rhodes Pond Dam Repair
Dear Mr. Kleinmaier:
On April 15, 2020, the Division of Water Resources (Division) received your application dated
April 15, 2020, and fee received on April 16, 2020 requesting a 401 Water Quality Certificatior
from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following
information is received:
1. The US Army Corps of Engineers has determined that the use of Nationwide Permit 3
is not appropriate for this project and that an Individual Permit would be required
and therefore an Individual 401 Water Quality Certification.
Pursuant to Title 15A NCAC 02H .0502(c) the above requested information is necessary for the
proper consideration of the application. The Division will be notified by the USACE when a
Public Notice is issued for your project. No action is necessary by you at this time. This letter
serves as notification to you that your application cannot be processed until a Public Notice has
been issued.
