The Barber Mill Road Site 404/401 application was submitted as a non- reporting Nationwide Permit #18 on April 14, 2020. Kimley-Horn received an Incomplete Notification from the US Army Corps of Engineers (USACE) on April 27, 2020 via email requesting additional information. The following provides detail on the questions raised by the USACE: 1) A review of our records indicates that approximately 0.3 acre of potentially jurisdictional wetland had previously been documented on this site associated with an old pond bed. In 1998, impacts to approximately 0.3 acre of herbaceous wetland were permitted to facilitate construction of commercial/residential development on this site. A review of aerial photography and other available mapping indicates: a. The site was never developed under the permit (expiration 13 December 1998), b. National Wetland Inventory resources occur on the site, and c. Tire rutting, possibly associated with saturated soil, is visible as recently as the February 2019 aerial photo (Google Earth). • While the development that was previously permitted on the Site was not completed, imagery from Google Earth shows the site was cleared and graded between February 1999 and April 2004. Our client purchased the proposed site in 2016 and has no knowledge of whether the prior development graded/filled any potential wetlands on the site. Kimley-Horn staff delineated the project area in February 2019 and no wetlands were identified. Tire rutting was observed on the ground during the field investigation, however soils were br ight, non-hydric, and lacked wetland hydrology indicators. Approximately 0.36” of rain was recorded in the 36 hours prior to Kimley-Horn’s site visit, and despite the recent rainfall, only small puddles were Page 2 kimley-horn.com 421 Fayetteville Street, Raleigh, NC 27601 919 677 2000 present in the tire ruts. Below are two photos taken in the vicinity of the former pond bed, and a data form documenting site conditions within this area is included with this package. Note tire ruts were present but soils are bright. Wetland hydrology indictors were not identified during the site investigation (3/2019). Page 3 kimley-horn.com 421 Fayetteville Street, Raleigh, NC 27601 919 677 2000 2) Impacts to stream resources are requested, but no JD request has been included to document Section 404 Jurisdiction over these impacts. • See response to question (3) below. 3) USGS, NRCS, and NWI mapping all indicate this stream is a modified natural stream. Impacts under non-reporting use of Nationwide Permit (NWP) 18 require demonstrating no special aquatic site would be impacted. To address items 1-3, above, please expand on the discussion of this site’s history and impacts that have occurred to date, and submit a JD request for features on this project. Include data forms from within the old pond bed, the ditch above the stream origin shown on impact mapping, and the ditch occurring along the southern property line where impacts would occur. Please also include photographs of the stream and tributary ditch features to document no special aquatic site occurs along this reach. • Kimley-Horn staff delineated the site in February 2019 and no jurisdictional features were identified. At that time, the project was anticipated to have no impacts to jurisdictional features or potentially jurisdictional features (roadside ditches). Since there is an NRCS- and USGS-mapped stream within the site that would be subject to Neuse River Basin buffers if present, Kimley-Horn submitted a Buffer Determination request to NCDWR and had a field review with Erin Deck and Zack Thomas in March 2019. NCDWR determined that the mapped stream had been relocated to the roadside ditch running along Barber Mill Road and that this ditch would be subject to 401 jurisdiction and Neuse River Basin buffers. Kimley- Horn determined the most efficient course of action would be to assume 404-jurisdiction over this feature (Stream S1) and entirely avoid disturbance or impacts accordingly. Since that time, the site plan has been modified based on feedback obtained during site plan review to include sidewalks and modified stormwater outlets that now are proposed to drain to S1. Photos of stream S1 are displayed below and a PJD request including a NCDWR Stream Identification Form has been included with this package. As S1 has functioned historically as a roadside drainage ditch and subject to repetitive manipulation and maintenance, S1 was found to lack any identifiable natural bed form or stream characteristics. The lack of in -stream structures, degraded aquatic habitat, heavy erosion, and multiple bank failures have resulted in a primarily stormwater-driven stream channel with no special aquatic sites identified in the proposed impact areas. Note the lack of natural stream features and the degraded banks (2/2019). 4) Non-reporting use of a Nationwide Permit requires compliance with all general and regional conditions, including coordination with the US Fish and Wildlife Service (USFWS). The USFWS IPaC website identifies three listed, and three proposed listed, species as potentially affected by Page 5 kimley-horn.com 421 Fayetteville Street, Raleigh, NC 27601 919 677 2000 activities in this location. There is no requirement to address proposed listed species at this time, though it is recommended to protect applicants from unnecessary delay in the event listing occurs during this review. Please either document coordination with USFWS and secure their concurrence with this project as proposed or provide assurances for each species so we can complete this requirement under NLEB SLOPES Situation 2 coordination. • The USFWS IPaC website lists red-cockaded woodpecker (E), Neuse River waterdog (PT), Carolina madtom (PE), Atlantic pigtoe (PT), dwarf wedgemussel (E), and yellow lance (T) as the six federally-protected or proposed species that may be affected by activiti es in this location. A review of the NCNHP database records, updated April 2020, indicates there are no known occurrences of any federally protected species within 1.0 mile of the project area. The red-cockaded woodpecker (RCW) typically occupies open, mature stands of southern pines, particularly longleaf pine (Pinus palustris), for foraging and nesting habitat. The RCW excavates cavities for nesting in living pine trees, aged 60 years or older, which are contiguous with pine stands at least 30 years of age for foraging habitat. The foraging range for RCW is normally less than 0.5 miles. Suitable habitat for RCW is not present within the study area due to the lack of mature pine stands. A few open-grown loblolly pines (Pinus taeda) are present along the eastern boundary of the site, however, these trees are isolated from large pine stands and appear to be ~30 years in age. Due to the lack of known occurrences, the lack of suitable nesting habitat in and around the project area (tree stands >60 years in age), and the amount of development surrounding the site, it has been determined that the proposed project will have no effect on RCW. In North Carolina, the dwarf wedgemussel is known from the Neuse River and Tar River drainages. The mussel inhabits creek and river areas with a slow to moderate current and sand, gravel, or firm silt bottoms. Water in these areas must be well oxygenated. Stream banks in these areas are generally stable with extensive root systems holding soils in place. Suitable habitat for the dwarf wedgemussel is not present within the project corridor due to the lack of well-oxygenated, perennial streams with stable banks. Stream S1 has been relocated to a roadside ditch with poor substrate, vertical banks, frequent failures and bank sloughing throughout, and is choked with algae. Due to the lack of known occurrences and the lack of suitable habitat in the project area, it has been determined that the proposed project will have no effect on the dwarf wedgemussel. The yellow lance is endemic to the Chowan, Tar, and Neuse river drainage basins in North Carolina. The freshwater mussel prefers coarse sandy substrate and sometimes prefers lightly graveled sandy substrate. Yellow lance is often found in mixed sand and gravel substrate at the base of a stream riffle. The mussel also requires clean streams that are well-oxygenated, with moderate flow and little sediment discharge. Suitable habitat for the yellow lance is not present within the project corridor due to the lack of well -oxygenated, moderate-flow streams with stable banks. Stream S1 has been relocated to a roadside ditch with poor substrate, vertical banks, frequent failures and bank sloughing throughout, and is choked with algae. Due to the lack of known occurrences and the lack of suitable habitat in the project area, it has been determined that the proposed project will have no effect on the yellow lance. Page 6 kimley-horn.com 421 Fayetteville Street, Raleigh, NC 27601 919 677 2000 In addition to the above federally-protected species, the USFWS IPaC website also identifies the Neuse River waterdog, Carolina madtom, and Atlantic pigtoe as species that are proposed for listing and may occur within the project area. These three species require specific aquatic habitats that have not been degraded by sloughing banks, sedimentation, and stream relocation. Habitat for these species is not present within the study area due to the degraded nature of Stream S1, the only stream in the project area. At this time, these species are currently listed as “Proposed Threatened” or “Proposed Endangered” and, for that reason, are not currently protected under the Endangered Species Act. However, due to the lack of suitable habitat in the project area and the lack of known occurrences, it is assumed that the proposed project will have no effect on any of these proposed species. In addition, the northern long-eared bat is listed as “Threatened” and occurring in North Carolina. The USFWS has developed a 4(d) rule that provides special coverage for those working within northern-long eared bat habitat. Per the USFWS NLEB website, Johnston County is not listed as a “NLEB County” and no Red HUC occurs within 0.25-mile of the project area. The bald eagle is protected under the Bald and Golden Eagle Protection Act (BGPA) and is listed as occurring in Johnston County. Habitat for the bald eagle consists of mature forests in proximity to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. A desktop GIS-assessment of the project area and the area within 1.13-mile of the project boundary was conducted in May 2020. No water bodies large enough or sufficiently open to be considered as feeding sources were identified. In addition, the NCNHP database records, updated April 2020, indicates no known bald eagle occurrences within 1.0 mile of the project area. Due to the lack of foraging habitat and the lack of known occurrences, it has been determined that the proposed project will have no effect on bald eagle. 5) The PCN application states that no trees will be cleared as part of construction on this site. However, development plans included in the application indicate this is not the case. Until a JD review is completed we are unable to determine whether this clearing would occur within areas subject to our jurisdiction. • The only trees present within the site are along the eastern edge of the property boundary, across the site from the jurisdictional stream impacts. These trees are proposed to be cleared to the property line. No trees are present along Stream S1, within the riparian area of S1, or in the vicinity of any jurisdictional resource on the site. 6) Riprap used under NWP 18 must comply with general condition 9. Please provide a detail to indicate that placement will preserve the pre-project channel morphology. • The plan sheets have been updated to include details on the keyed in rip rap and are attached. Flow within S1 will not be restricted or impeded by the stream bed and bank armoring. Due to the presently degraded nature of S1, the proposed armoring will prevent future bank failures and better prevent sedimentation impacts to downstream waters. Page 7 kimley-horn.com 421 Fayetteville Street, Raleigh, NC 27601 919 677 2000 7) Reference is made to the Town of Clayton’s requirement that this project include sidewalk. Per NWP 18 general condition 15, this would be included as part of a single-and-complete project. Plan sheets provided state “Limits of disturbance to extend beyond property line for construction of offsite sidewalk and regrading of roadside swale” along Barber Mill Road. Please clarify the roadside swale referenced is not the stream shown on project mapping. No details are provided to indicate what, if any, impact to the stream would result from either the sidewalk or regrading, or how the stream would be protected during construction. Additional detail of all impacts assoc iated with development of this project are required to complete our review. • The only stream on-site, as delineated by Kimley-Horn and NCDWR, is the stream along Barber Mill Road. There is a vegetated roadside drainage ditch (swale) located along Dairy Road that the call out on the plan sheets is referencing. Due to safety concerns, water cannot be allowed to flow across the required sidewalk, so the vegetated roadside drainage ditch (swale) will be piped beneath the sidewalk and discharge to S1. No impacts to the stream would result from the sidewalk or grading. The only permanent stream impacts proposed would result from keyed-in rip rap stabilization in Stream S1 at the two proposed stormwater outfalls flowing below the proposed sidewalk. These two stormwater pipes are located on the northern and southern boundaries of the project – the northern outfall would convey stormwater from the existing vegetated roadside drainage ditch (swale) along Dairy Road and the southern outfall would convey stormwater from a proposed underground stormwater treatment facility below the proposed parking lot. Temporary stream impacts at both sites would be required to install a temporary pump around to facilitate for working in the dry. Rip rap will be keyed into the banks and channel to match the existing stream contours at both sites. In total, less than 10 cubic yards of rip rap will be installed in Stream S1 between the two sites. Additional details regarding the construction sequence and rip rap installation have been added to the included plan set.
