I hope this email finds you well. Last week I did pull the file for the subject project and found that the August
9, 2004 letter was the last correspondence. As suspected, the compliance issues were not resolved and no
application was submitted.
With that said, a State Stormwater permit application must be submitted in order to resolve the issues
identified in the October 27, 2003 Notice of Violation and Assessment of Civil Penalty.

Good Afternoon Jackson,
As you know, I am mostly working remotely and only able to go into the office a couple of days a week. While I
was in the office earlier today, I am currently working remotely and am unable to pull the file.
From what I have been able find while working remotely, this site was issued a Notice of Violation and
Assessment of Civil Penalty on October 27, 2003 for failure to submit for a Stormwater Permit and
constructing without a permit, which was returned (as indicated in the August 9, 2004 letter you attached).
The August 9, 2004 letter indicates that again an application for a State Stormwater permit had still not been
submitted and referenced the October 27, 2003 letter. It appears that, to date, no application was ever
submitted and, therefore, was never resolved.

With that said, when I am able to go into the office later this week, I will pull the file and see if it has any
additional pertinent information.
In the meantime, please let me know if you have any additional questions or concerns.

Thank you for agreeing to act as a "go-between" for this project. The church has been very
unresponsive to the Division's requests to submit the required storniwater application, and
their phone has been disconnected. My last correspondence is dated November 4, 2003, and
was sent via certified mail #7002 1000 0005 2390 1925, copy enclosed. Also enclosed is a
copy of the October 27, 2003, Assessment of Civil Penalty correspondence that was returned.
Attached please find a copy of Form SWU-101, the application form. Since I do not know what
BMP will be used, I am not enclosing any of the supplement forms. Once the BMP is selected
you can either download the appropriate supplement form from the Division's website at
http://h2o.enr'.state.nc.us/su/Forms Documents.htm, or you can call me at the number at the
bottom of this page, or you can email me at [e-mail] to request a copy of the
appropriate supplement. Your consultant should be able to advise you as to the selection of
the most suitable BMP for this site.
Please submit the completed application by September 9, 2004. If you need additional time,
please fax or email me a request for additional time, and provide the date by which you expect

On October 27, 2003, the Division of Water Quality sent- a certified letter, #7002 1000
0005 2390 1963, to Bill Hutchinson, the pastor of Shoreline Baptist Church, regarding
the Notice of Violation and Assessment of Civil Penalty for failing to obtain a Stormwater
Management Permit for the development of Shoreline Baptist Church. The letter was
returned to the Division on November 3, 2003, as "not deliverable as addressed". The
address we used was that shown on the Land Quality application, and for a previous
certified letter regarding a Notice of Recommendation for Enforcement: PO Box 376,
Oak Island, NC.
Enclosed please find the original October 27, 2003, letter. You still have•30 days from
receipt of the letter, based on the date the green card is signed, to respond. If you have

Dear Rev. Hutchinson: Brunswick County
This letter is to notify you that the Wilmington Regional Office of the Division of Water
Quality is considering sending a recommendation for enforcement action to the Director of the
Division of Water Quality. The recommendation concerns the violation of North Carolina
General Statute NCGS 143-215.6A(2) by failing to apply for or secure a permit required by
NCGS 143-215.1. You have failed to obtain a State Stormwater Management Permit for the
subject project.
On April 2, 2002, you were notified via certified mail, that a State Stormwater
Management Permit was required for the proposed development activities at this site. On
October 25, 2002, an inspection of the facilities confirmed that this project is complete. If you
have an explanation for this violation that you wish to present, please respond in writing to me
within ten (10) days following receipt of this Notice. Your explanation will be reviewed and
forwarded to the Director with the enforcement package for his consideration.
By copy of this letter to the Building Inspector, this Office is requesting that the Building
Inspector consider withholding building permits and Certificates of Occupancy for this project
until this matter is satisfactorily resolved. Oak Island does not have a delegated State Stormwater
Management permit program, therefore, any permits they issue must not be considered
compliance with the State Stormwater rules. If you have any questions concerning this matter,
please contact Linda Lewis at [phone].

On March 21, 2002, the Wilmington Regional Office received a copy of a Notice of Violation of the
Sedimentation Pollution Control Act for Shoreline Baptist Church. The North Carolina Administrative Code
requires any project that must receive either Sedimentation and Erosion Control Plan approval and/or a CAMA
Major permit to apply for and receive a Stormwater Management Permit by the Division of Water Quality. Any
construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC
2H.1000 and may result in appropriate enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application form,
fee, and supporting documentation, or a written response regarding the status of this project and the expected
submittal date must be received in this Office no later than April 25, 2002. Failure to respond to this request may
result in the initiation of enforcement action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter
must NOT be considered the Coastal Stormwater Management Permit, which will be signed by the Water Quality
Supervisor. Please reference the Project Number above on all correspondence. Ifyou have any questions, please

On March 19, 2001, personnel of this office inspected a project located on the comer of Fish Factory
Road and Vanessa Drive in Brunswick County, North Carolina. This inspection was performed to determine
compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed
a land -disturbing activity of approximately 1.5 acres being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible
for the following violations, please notify this office immediately.
The violations that were found are:
1. Failure to file an erosion and sedimentation control plan with this office at least 30 days prior to
beginning a land -disturbing activity on a tract comprising more than one acre, when more than one
acre is to be uncovered, failure to secure this office's prior approval of the plan for any land -
disturbing activity prior to beginning the land -disturbing activity. NCGS. 113A-54(d)(4), G. S. 113A-
57(4) and 15A NCAC 413.0007(c).
An erosion and sedimentation control plan has not been submitted to this office for the
referenced project.
An acceptable erosion and sedimentation control plan must be filed with and approved by this office
and implemented on the site sufficient to prevent off -site sedimentation. Until the required plan has
been approved, temporary measures must be provided immediately to control erosion and prevent
sedimentation damage. Any additional land -disturbing activities conducted without an approved
erosion and sedimentation control plan will constitute additional violations of the Act. We will notify
you following our review of the plan if additional measures are required.

2. Failure on a tract of more than one acre, when more than one acre is uncovered, to install
sedimentation and erosion control devices sufficient to retain the sediment generated by the land -
disturbing activity within the boundaries of the tract during construction upon and development of
the tract. G.S. 113A-57(3).
Adequate measures to control erosion and retain sediment on site have not been provided.
To correct these violations, you must:
Submit an erosion and sedimentation control plan to this office for the referenced project.
2. Install the measures, structures, and/or devices necessary to control erosion and retain
sediment on site.
Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover'
or of "ground cover sufficient to restrain erosion." These requirements are not satisfied until a standing
cover of grass or other ground cover is established which is, in fact, sufficient to restrain accelerated or
man-made erosion.
Please be advised that if you fail to respond to this notice or if these violations are not corrected
within 30 days of receipt of this notice, the Director, Division of Land Resources, will be requested to take
appropriate legal action against you pursuant to NCGS 113A-64. That action could be the assessment of
a civil penalty and the amount may be up to $5000 per day for each day of the violation. The penalty may
be assessed from the date of the violation, NCGS 113A-61 (a) (1). If these violations are corrected within
the time period specified for compliance, no further legal action will be pursued.
Please be advised that any new land -disturbing activity associated with this project must not begin
until the area presently disturbed is brought into compliance with the Act. When corrective actions are
complete, you should notify this office so the work can be inspected. You should not assume that the
property is in compliance with the Act until we have notified you. After installation, all erosion control
measures must be maintained in proper working order until development is complete and the site is
completely stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same
time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the
relevant statute and administrative rules may be examined at this office or will be sent to you upon request.
