Last week I did pull the file for the subject project and found that the August 9, 2004 letter was the last correspondence. As suspected, the compliance issues were not resolved and no application was submitted. With that said, a State Stormwater permit application must be submitted in order to resolve the issues identified in the October 27, 2003 Notice of Violation and Assessment of Civil Penalty. While I was in the office earlier today, I am currently working remotely and am unable to pull the file. From what I have been able find while working remotely, this site was issued a Notice of Violation and Assessment of Civil Penalty on October 27, 2003 for failure to submit for a Stormwater Permit and constructing without a permit, which was returned (as indicated in the August 9, 2004 letter you attached). The August 9, 2004 letter indicates that again an application for a State Stormwater permit had still not been submitted and referenced the October 27, 2003 letter. It appears that, to date, no application was ever submitted and, therefore, was never resolved. With that said, when I am able to go into the office later this week, I will pull the file and see if it has any additional pertinent information. In the meantime, please let me know if you have any additional questions or concerns. Hutchinson: Brunswick County This letter is to notify you that the Wilmington Regional Office of the Division of Water Quality is considering sending a recommendation for enforcement action to the Director of the Division of Water Quality. The recommendation concerns the violation of North Carolina General Statute NCGS 143-215.6A(2) by failing to apply for or secure a permit required by NCGS 143-215.1. You have failed to obtain a State Stormwater Management Permit for the subject project. On April 2, 2002, you were notified via certified mail, that a State Stormwater Management Permit was required for the proposed development activities at this site. On October 25, 2002, an inspection of the facilities confirmed that this project is complete. If you have an explanation for this violation that you wish to present, please respond in writing to me within ten (10) days following receipt of this Notice. Your explanation will be reviewed and forwarded to the Director with the enforcement package for his consideration. By copy of this letter to the Building Inspector, this Office is requesting that the Building Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is satisfactorily resolved. Oak Island does not have a delegated State Stormwater Management permit program, therefore, any permits they issue must not be considered compliance with the State Stormwater rules.
