Subject: 1999 Annual Monitoring Report for Pembroke Creek Mitigation Site,
Chowan County
Please find enclosed one copy of the 1999 Annual Monitoring Report for the Pembroke
Creek Mitigation Site. This report details the hydrologic and vegetation monitoring
activities from the past year at the site, constructed in 1997 and 1998.
A meeting to discuss this and other sites evaluated by the Washington and Wilmington
Regulatory Field Offices has been scheduled for Friday, February 18, 2000 at 9:00am in
Room 470 of the Transportation Building. Representatives from NCDOT and various
other agencies will be in attendance.

Dear Mr. Harris:
This correspondence is in reference to your letter dated July 7, 2004, regarding the Pembroke Creek Mitigation site
located in Chowan County, North Carolina. This site is being utilized bythe North Carolina Department of
Transportation as compensatory mitigation for the replacement of Bridge No. 27 on US 17 (TIP R-2404C).
By copy of this letter, we are notifying you that no further monitoring of the site will be required since the
construction and success criteria for the mitigation site has been met.

As you are aware, the Department has continually monitored vegetation for the Pembroke Creek
Mitigation Site since its Phase 2 construction and planting in January 1998. Hydrologic
monitoring gauges were installed in February 1999. Located adjacent to US 17 in Chowan
County, the site was constructed to mitigate for impacts associated with roadway improvements
to US 17 in Bertie and Chowan Counties. The site provides approximately 9.74 acres of
mitigation (4.725 acres for Phase I and 4.949 acres for Phase II). NCDOT proposed to monitor
the Pembroke Creek site for five years or until success criteria were met; both hydrologic and
vegetation monitoring were conducted each year. After each growing season, annual monitoring
reports were submitted to the appropriate regulatory agencies.
Hydrologic success criteria stipulated that the site must be inundated or saturated within 12-
inches of the surface for a consecutive 12.5% of the growing season. The growing season is 262
days in New Hanover County; therefore, the criterion is a consecutive 32 days. The 2003 Annual
Monitoring Report provides a summary of the hydrologic data (the percentage of the growing
season that saturation was indicated) at each groundwater gauge location for the past five years
of monitoring.
As the summary table in the 2003 Annual Monitoring Report indicates, the site has been
consistently inundated or saturated for a majority of each growing season since the site was
constructed. Hydrologic success for this site is based on a comparison of mean depth of
groundwater on the site to that reported from gauges in the monitored reference area (site data
should fall within 20 percent of the reported reference data in a successful hydrologic year). The
hydrologic results for 2003 indicated that the site met both jurisdictional success, as stated above,
as well as the modified criteria outlined in the plan. The region has experienced three years of

average rainfall and two years of average to below average rainfall. A more detailed analysis of
site hydrologic conditions is provided within each individual annual monitoring report.
After five years of vegetation monitoring, vegetation data for 2003 indicates that the site has met
vegetative success criteria by yielding an average tree density of 487 trees per acre. None of the
three individual vegetation plots had a survival density that was below the 5-year requirement.
Individual yearly monitoring data is provided within the annual monitoring reports submitted
between 1999 and 2003.
During the annual monitoring report meeting on April 29, 2004, NCDOT and resource agencies
agreed that the Pembroke Creek Mitigation Site could be closed and that monitoring could be
discontinued. NCDOT requests that the appropriate resource agencies provide documentation
stating that no further monitoring is required and that the site is closed. If you have any questions
