The NCDOT, along with most other team members (USFWS and NCWRC were not present at the meeting) agree with the proposed southern route, primarily on new location. Presently, the DWQ feels that one of the. three northern alternatives (primarily on new location as well) is abetter LEDPA decision. The DWQ is not prepared to make a decision on a specific northern alternative, just presently objects to selecting the southern alternative. 4. Explain the reasons for vour potential non-concurrence. Please include an data or information that would substantiate and support your position. Based on information provided thus far, the DWQ does not feel that the southern route constitutes the Least Environmental Damaging Practicable Alternative. However, the DWQ is willing to reconsider it's position if the requested additional information is provided. Based on information provided at the May 24, 2007 meeting as well as the meeting packet, it appears as though the three northern alternatives may have issues with community impacts and constructability that may not have been fully detailed to date. The DWQ feels more information is required in order to make an informed decision. Primary unanswered questions evolve around the following items: It is unclear to the DWQ as to the actual extent of impacts to the Coharie Native American Community. The DWQ realizes that the community was impacted several decades ago when the Faircloth Freeway was built, and as a result, there is much opposition against impacting the community again. Potential impacts to the community include a proposed interchange in the general area of the community. However, it is unclear from discussions as well as what was shown on the meeting maps as to actual impacts to the Coharie Native American community. The DWQ realizes that it is difficult to actually define the boundaries of the community, which was designated on the map as a circle, located just to the northwest of the proposed intersection (which was not located within the circle). It appeared to the DWQ staff present at the meeting that impacts within the circle were minimal. The NCDOT explained that the community most likely extended up towards Southwood Drive. All three northern routes follow a common path across Southwood Drive, and would take several residences currently located along this street, but it is unclear if these are part of the Coharie Native American community or not. Additionally, the NCDOT states that the common corridor for all three northern alternatives (segment E2) will cut off access to the Faircloth Cemetery. It was unclear to the DWQ staff how access was currently routed using the presentation maps. Staff asked a NCDOT representative, who was unsure. It appears, according to the presentation maps, that if access is currently provided from the east or southeast, then the northern corridor will not affect access to the cemetery. The NCDOT stated during the meeting that all three northern alternatives would impact the Allen Canning Company locate just to the east of Elliot. The presentation maps did not appear to fully substantiate this. It appears that segment F1 B will impact the operation by dividing the property. Segment F1 C appears to impact the extreme northeast corner of the operation with very minimal impacts, while segment F1A does not appear to impact the operation or property at all. The NCDOT stated that these segment would. impact the operation's spray field and possible future expansion plans. DWQ staff inquired about specifics on the location of the existing spray field as well as future expansion possibilities at the plant. The NCDOT responded that the spray fields are to the east of what was being shown as the Allen Canning property, while the expansion will most likely be to the south, as they have already asked for easement rights from the NCDOT. Neither of these areas appeared to be in conflict with segments F1 C or F1A. There were discussions during the meeting about potential stream impacts to the proposed intersection at SR 1934 and SR 1116 along segment E3 of the southern alternative. This will affect approximately 1,200 linear feet of stream. The NCDOT has indicated that the impacted stream is intermittent. However, based on experience, DWQ staff believes that this stream is perennial. If the estimated 1,200 linear feet of stream in question are in fact perennial, then an estimated 1,874 linear feet of stream would be impacted, or 40 percent (736 linear feet) more than for the highest northern route (1,138 linear feet). This would leave an estimated 3,673 linear feet of intermittent stream impacts, 30 percent higher than for any of the northern alternatives. It was brought to the DWQ staff's attention, outside of the general meeting, that there may be some constructability issues with railroad crossings in the northern routes. Some of the alternatives cross the railroad tracks twice. Due to the nature of the proposed road, the crossings must be grade separated. It appears as though some of the crossings will be at a significant skew, and may pose design and construction issues. Possible issues surrounding the constructability of these crossings were not adequately discussed by the NCDOT, neither during the meeting nor in the meeting packet. If more information can be provided, then we may alter our position on the LEDPA. Additionally, there are several other reasons why the DWQ feels that the southern route is not the LEDPA. These include (according to Table 1 in the CP3 informational meeting packet): The southern alternative will impact the greatest linear footage of streams - the southern alternative is projected to impact a total of 5,547 linear feet of streams, compared to 3,604 linear feet for the highest northern alternative. Broken down, the southern route will impact 1,674 linear feet of perennial streams and 3,873 linear feet of intermittent streams. The highest for the northern route is 1,138 linear feet of perennial stream and 2,585 linear feet of intermittent streams. The southern alternative has the highest total number of relocations - the southern route has a total of 55 relocations (all residential), compared to a high of 36 for the northern alternatives. The southern alternative has the most impacted noise receptors - the southern route has 16, compared to 13 for the northern alternatives. The southern alternative impacts the most hazardous materials sites - The southern route impacts nine sites versus a high of seven for the northern routes. Coleman Boulevard, Concord, 28027. The purpose of this workshop is for NCDOT representatives to provide information, answer questions, and accept written comments regarding this project. NCDOT proposes to replace Bridge No. 266 over the Southern Railway on SR 1002 (Cabarrus Avenue), make improvements to intersections as well as close the at-. grade rail crossing on Corban Avenue. Traffic will be maintained on site during the construction process. The projects are included in the 2006-2012 North Carolina Transportation Improvement Program (TIP). The alternatives under consideration at this time for each of these bridge replacement projects are as follows: B-4517, Replace in place with offsite detour; B-4519, Replace in place with offsite detour. Please note that this represents a change from the original alternatives for B-4517 and no change to the previously identified alternatives for B-4519. I would appreciate any information you might have that would be helpful in evaluating potential environmental impacts of the project. Your comments will be considered in the completion of a federally funded Programmatic Categorical Exclusion. This document will be prepared in accordance with the National Environmental Policy Act. It is desirable that your agency respond by July 6, 2007 so that your comments can be used in the preparation of this document.
