Subject: Western Wake Freeway (R-2635) and Triangle Parkway (U-4763B)
Dear Mr. Alsmeyer and Mr. Ridings,
The NC Turnpike Authority (NCTA) previously received approvals from the NC Ecosystem
Enhancement Program (EEP) to accept payment for impacts associated with the Western
Wake Freeway (R-2635) and Triangle Parkway (U-47638) projects in accordance with the
Memorandum of Understanding (MOU) between NC Department of Environment and
Natural Resources (NCDENR) and US Army Corps of Engineers (USACE) dated
November 4, 1998.
The purpose of this letter is to notify you of the NC Department of Transportation's
(NCDOT) recent decision to allow EEP to provide compensatory mitigation for the impacts
associated with the Western Wake Freeway (R-2635) and Triangle Parkway
(U-47636) projects in accordance with the Memorandum of Agreement (MOA) among the
NCDENR, NCDOT and USACE dated July 22, 2003, as amended in June 2004 and
March 2007. The funding for this mitigation has been previously provided by NCDOT.
Please see the attached letter dated June 25, 2009 from NCDOT to EEP regarding this
decision.
The 401 Water Quality Certification (No. 3756) for Triangle Parkway was issued on
November 25, 2008. The Section 404 permit (SAW-2006-20445-232) was issued on
February 5, 2009. The 401 Water Quality Certification (No. 3734) for Western Wake

Freeway was issued on March 17, 2008 and revised on September 22, 2008. The Section
404 permit (SAW-2007-02903-292) was issued on April 22, 2008.
The Western Wake Freeway and Triangle Parkway permits indicated the required
compensatory mitigation would be provided in accordance with the MOU. At this time,
NCDOT has agreed for EEP to provide mitigation in accordance with the MOA.
This letter is being provided to request your agreement to this change; if your agency
agrees with this change, please sign below and return a copy of this letter to NCTA.
