II. SOC COMPLIANCE HISTORY:
Please attach a listing of all violations this facility has had under this Order. Include any
violation of interim dates, relaxed permit parameters, and existing permit limits.
III. ADDITIONAL FLOW OR REALLOCATION OF EXISTING FLOW:
Only facilities owned by a unit of government may request to add additional flow to the
treatment system as part of this SOC Amendment in accordance with NCGS 143-215.67(b).
Additional flow may be allowed under an SOC amendment only in specific circumstances.
These circumstances may include eliminating discharges that are not compliant with an NPDES
or Non-discharge permit as specified in the original SOC. These circumstances do not include
failure to perform proper maintenance on treatment systems, collection systems or disposal
systems. When requesting additional flow, the facility must include its justification and
supporting documentation. If the requested additional flow is non-domestic, the facility must be
able to demonstrate the ability to effectively treat the waste and dispose of residuals. The
applicant must provide a detailed analysis of all constituents in the proposed non-domestic
wastewater.

The total domestic additional flow requested: 0 gallons per day.
The total non-domestic additional flow requested: 0 gallons per day.

If a reallocation of existing additional flow is needed the facility must provide justification as to
why this reallocation is needed.
Any additional flow that may be allowed will be determined by an analysis of projected adverse
impacts on the wastewater treatment facilityand/or surface waters.

IV. WHY AN SOC AMENDMENT IS NEEDED:
Please provide a detailed explanation as to why the SOC amendment is being requested. Include
actions already taken to avoid noncompliance with the existing SOC. Also provide details on
activities that were delayed.
THE DIVISION OF WATER RESOURCES WILL NOT ACCEPT THIS APPLICATION
PACKAGE UNLESS ALL OF THE APPLICABLE ITEMS ARE INCLUDED WITH THE
SUBMITTAL.
Required Items:
a. One original and two copies of the completed and appropriately executed application
form, along with all required attachments.
• If the SOC Amendment is for a City / Town, the person signing the SOC must be
a ranking elected official or other duly authorized employee.
• If the SOC Amendment is for a Corporation / Company / Industry / Other, the
person signing the SOC must be a principal executive officer of at least the level
of vice-president, or his duly authorized representative.
• If the SOC Amendment is for a School District, the person signing the SOC must
be the Superintendent of Schools or other duly authorized employee.
Note: Reference to signatory requirements in SOCs may be found in the North
Carolina Administrative Code [T15A NCAC 2H .1206(a)(3)].
b. The non-refundable Special Order by Consent (SOC) processing fee of $400.00. A
check must be made payable to The Department of Environment and Natural
Resources.

Currently the Interim Schedule Dates read as follows:

operation of the wastewater disposal system.
3) On or before April 1,2019,begin Construction of the proposed modifications to the
wastewater disposal system.
4) On or before July 1, 2020, complete construction of the proposed modifications to
the wastewater disposal system.
5) On or before September 1,2020, achieve compliance with all permit limits.
6) Provide the Washington Regional Office with quarterly reports. Reports are due
within 30 days following the end of each calendar quarter, starting the first quarter
after signing the SOC.
The proposed modified Interim Schedule Dates are as follows:

Justification:
The Town of Pikeville is progressing with two construction projects that will assist them
to become compliant. Contract No. 20 is a Sewer Rehabilitation Contract with Bridge
Point Civil, LLC, which will reduce I/I tributary to the WWTP. Contract No. 16 is a
WWTP Improvements Contract with Ralph Hodge Construction, which will improve the
WWTP's ability to handle the flows tributary to the Town's WWTP.
At this point most of the work for Contract No. 20 is complete. The new Pump Station
was expected to come on line in middle to late February. The Pump Station has been
taken through startup and tested. It is ready to receive wastewater as soon as the
collection system can be certified. The contractor had to video tape the lines and survey
the pipe inverts. He determined he needed to re-install the sewer from manhole 2 through
manhole 6. Manhole 4 had to be replaced. This work has been done. Leaks for the piping
have been stopped. Manhole inverts have been surveyed. We are awaiting results of
videotaping. Once the videotaping has been reviewed the contractor will begin pavement
patching. After pavement patching the fencing around the pump station can be
reinstalled. The owner of the Mobile Home Park must tie into the new collection system,
before the Town can legally abandon/demolish their old collection system. The Mobile
Home Park Owner has filed a lawsuit against the Town. The soonest the case will go to
court is in late June, 2020. Only after the case is resolved, and the connections have been
completed, can the Town proceed with the abandonment that is part of this construction
contract.
Work for Contract No. 16 is proceeding. The contractor has made some repairs to the
existing center pivot. The new center pivot has been installed but is not yet operational.
Piping has been completed to the new Center pivot. Much of the yard pipe for the WWTP
modifications has been installed. Two new irrigation pumps have been installed in the
existing pump cans. Most of the potable water lines have been installed, and hose bibs
have been disconnected from reclaimed water. Reclaimed water piping to the elevated
storage tank has been disconnected. Positions for the monitoring wells have been staked
and reviewed by the Washington Regional Office. The monitoring wells have been
installed, and have been sampled for background readings. The contractor has recently
located clay that can be used for the core of the dike. The new effluent storage structure is
finally under construction. The Substantial Completion Date is April 18, 2020. The
Contract Completion Date is May 23, 2020. This contractor is not be able to comply with
their original contract completion date because of soils issues.
The next item scheduled in the SOC is due on or before July 1, 2020. The SOC requires
the Town to complete construction on or before that date. Because of the legal issues, and
soils issues the contractors are not going to be able to complete construction by July 1,
2020. At this point we expect both construction projects to be complete by January 1,
2021, and compliance by March 1, 2021.

In the meantime, the Town of Pikeville continues to isolate additional areas of concern.
When within the Town's ability, the Utilities Staff is making some identified point
repairs. The Utilities Staff have been lifting manhole lids during heavy rains to identify
additional sources of I/I in the collection system. A review of pump run times indicates
that the Collingwood subdivision has excessive flows. The Town has applied for grant
funding to replace the Collingwood pump station and do more work to remove I/I within
the Collingwood subdivision.

A review of the June 2019 Non-Discharge Monitoring Report (NDMR) for the subject facility revealed the
violations indicated below:

A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's Non-discharge Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.

If you wish to provide additional information regarding the noted violation, request technical assistance, or
discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A
review of your response will be considered along with any information provided on the submitted Monitoring
Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no
response is received in this Office within the 10-day period, a civil penalty assessment may be
prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.
Reminder: Pursuant to Permit Condition IV in Section 17 (e), the Permittee is required to verbally notify the
Regional Office as soon as possible, not to exceed 24 hours, from first knowledge of any
non-compliance at the facility including limit violations, bypasses of, or failure of a treatment unit. A
written report may be required within 5 days if directed by Division staff. Prior notice should be given
for anticipated or potential problems due to planned maintenance activities, taking units off-line, etc.
