The North Carolina Wetlands Restoration Program (NCWRP) received check
number 494004 which includes $ 324,000.00 as payment for the compensatory
mitigation requirements of the subject U. S. Army Corps of Engineers Section
404 permit (Action ID 199400662) and 401 Water Quality Certification (DWQ #
970501) issued to the North Carolina Department of Transportation.
The NCWRP, by acceptance of this payment, acknowledges that the
NCWRP is responsible for the compensatory mitigation requirements associated
with Action ID 199400662, and agrees to provide the compensatory mitigation as
specified in Special Conditions (b) of this permit. As specified in Special
Conditions (b) , the NCWRP will restore 27 acres of non-riparian wetlands in
Cataloging Unit 03020101 of the Tar-Pamlico River Basin.

MINUTES COVERING PERMITS MEETING

A meeting was held on September 29, 1999, in the Conference Room at the Wilson Division office,
to discuss the permits for the above referenced project. The following persons were in attendance:

Ms. Oglesby welcomed everyone and asked that Eri c Alsmeyer cover the permits associated with
the construction of the NC 43 Bypass project.
This permit was issued sometime around the end of June. DOT shall notify Corps of Engineers in
advance as to when construction will commence and work is completed. The permit has a
completion dated of December 31, 2002. The Contractor does not have not to have the entire
project completed by this date, but he should make sure all work in the wetlands area is completed
by that date. If additional time is needed, the Contractor shall submit a request for a time extension
to the Resident Engineer and it will be forwarded to the Corps of Engineers for consideration at least
1 month prior to permit completion date.
Should the Contractor discover any previously unknown historic or archeological remains while
performing work he should stop work, advise the Resident Engineer, who in turn with notify the
Corps of Engineers.
Mr. Alsmeyer advised the most important thing is that the Contractor contains his work within the
footprints shown on the drawings in this permit. He advised, at the end of the meeting, he would
compare the drawings in the permit to see if they match up with the construction plans. If they do
not match, we will have to modify.
Under Special Conditions on page 210 of the contract, Mr. Alsmeyer reviewed the following:
Item b- Mr. Alsmeyer stated that written confirmation from the NCWRP has not been received.
Ms. Oglesby is to check with Michael Wood in the DOT Raleigh office regarding this. A reply will
be forthcoming.
Item c - If items a and b have not been complied with, a directive will be issued for ceasing all
ongoing and permitted work within waters and/or wetlands associated with this project.

Item d - Prior to construction within jurisdictional waters latest version of project construction
drawings need to be forwarded to the Corps of Engineers. Ken Cates will forward a copy to Eric
Alsmeyer.
Item e - This permit meeting complies with this condition.
Item f-- No excavation from, or waste disposal into, jurisdictional wetlands or waters outside the
limits of this permit without appropriate modification of permit. If there is need to exceed beyond
permitted areas make sure the permit is modified. This includes all borrow areas also.
Item g - Make sure they are not jurisdictional areas. Comply with conditions noted.
Item h - Copy of permit and drawings in contract.
Item i - Comply with conditions in water quality certificate issued 06/24/98.
Item j thru I - The Contractor should comply with sediment and erosion control measures in
wetlands or waters and restoration of those areas.
Item m - Previously discussed.
The remainder of the conditions is standard. Most important is that work be contained within
construction limits and maintain erosion control measures be maintained.
If any eroded material gets into wetlands the Contractor will need to check with the DOT and the
Corps of Engineers on whether and how to remove material.
Concerning the 401 Water Quality Permit, if permission has not been received from WRP you will
be in violation of the 401 Water Quality Permit. 401 Permit was issued on 06/24/99. Mr.
Alsmeyer advised the DOT should check with WRP and make sure the permit has been signed.
Mr. Alsmeyer stated the only other thing he would like to do is go over the drawing and check
them against the plan sheets.
Ms. Oglesby asked the Contractor if he had gone over the plans and permit drawings to make sure
they concur.
Mr. Sherrod advised that mechanized clearing is shown, but it does not include grubbing. Eric
advised it could be grubbed if necessary; however, impact should be held to a minimum.
All permit drawings were checked against the plan sheets and were found to be in agreement.
Mr. Alsmeyer advised that a compliance review will be held sometime during the life of the project
and the Contractor should keep a close check on erosion control devices.
There were no further comments and/or discussion and the meeting was adjourned.

The purpose of this letter is to notify you that the North
DIRECTOR Carolina Wetlands Restoration Program (NCWRP) is willing to accept
{ payment from the North Carolina Department of Transportation
(NCDOT) for wetland impacts associated with the subject project in
accordance with the Memorandum of Understanding between the
NCWRP and the U.S. Army Corps of Engineers. Based on information
supplied by the NCDOT in a memorandum dated March 26, 1999, the
a impacts associated with the subject project are as follows: 13.35 acres
of wetlands. Assuming a 2:1 ratio for compensatory mitigation, the
NCWRP will provide the amount and type of required mitigation in
Cataloging Unit 03020101 of the Tar-Pamlico River.

By letter dated June 3, 1999, the North Carolina Department of Transportation provided the`
Fish and Wildlife Service (Service) an updated protected species report requesting our U.S.
concurrence with the results of surveys for the red-cockaded woodpecker (Picoides borealis) and
the Tar spinymussel (Elliptio lanceolata) in the vicinity of the proposed connector from NC 43 to
US 64 Alternate at Rocky Mount, Edgecombe County, North Carolina (TIP No. U-2218). This
report is provided in accordance with provisions of the Fish and Wildlife Coordination Act (16
U.S.C. 661-667d) and Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C.
1531-1543).
On June 23, 1997, the NCDOT personnel conducted a field survey for RCWs as outlined by
published guidelines from the Service. One stand of pines meeting the nesting age and density
requirements for the RCW was identified in the project area. Line transects were walked
throughout the stand. No nesting cavities or birds were observed in the project area durin the
survey. In addition waters in the project vicinity were surveyed for the Tars in g
impacts to this species are anticipated. Based on this survey information the NCDOT cone udes
that implementation of this project will have "No Effect" on any federally-protected species in
Edgecombe County.
The Service considers this updated report to be an accurate representation of the surveys and
results for the referenced species, and their habitats. Based on the information provided, the
Service concurs that this project, implemented as described, will not impact either the RCW or
the Tar spinymussel. Note, however, that this concurrence applies only to the referenced species
up to the date of this letter. Should additional information become available relative to other
listed species, or the referenced species, additional surveys may be required.
The Service appreciates the opportunity to comment on this document. Please advise us of any
changes in project plans. If you have any questions regarding these comments, contact Tom

SUBJECT: REVISED MITIGATION PROPOSAL FOR NC 43 BYPASS, FROM NC
43 TO US 64 ALTERNATE, EDGECOMBE COUNTY, U-2218.
On June 26, 1997, the Public Notice (Action ID #199500517) was issued for the
subject project. At that time, NCDOT proposed to utilize the Mildred Woods Mitigation
Site to compensate for the 13.38 acres of wetland impacts. Due to problems with the
mitigation site, NCDOT submitted a letter, dated June 17, 1998, to withdraw the
application until an alternative mitigation plan was conceived.
As you are aware, NCDOT has been negotiating with the North Carolina
Wetlands Restoration Program (WRP) to provide mitigation for 21 high priority projects,
one of which was this project. Attached is an April 1, 1999 letter from the WRP stating
their acceptance to provide the mitigation for the project.
NCDOT hereby requests the USACE and the North Carolina Division of Water
Quality (NCDWQ) to reinstate the project for review for a 404 Individual Permit and a
401 Water Quality Certification utilizing the WRP to compensate for the wetland
impacts. If you have any questions or need additional information, please contact Mr.
