No. U-0977A Dear Mr. Lund: The Division of Water Quality has reviewed the public notice for the proposed project. After reviewing our files and discussing the project with our regional office, we are concerned with the large amount of impacts to streams (8325 linear feet) and that appropriate avoidance and minimization has not occurred for this project. Consequently, pursuant to 15A NCAC 211.0507(a)(3), we are placing the processing of the 401 Water Quality Certification on hold until we can verify the project's impacts have been minimized to the maximum extent practicable. Furthermore, until we are able to verify appropriate minimization as occurred, we respectfully request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold, as well. It should be noted that the DWQ is not necessarily opposed to the project in its present form, rather that more information be provided so that we may feel comfortable in approving the permit. Hopefully, we can all work together to expedite the processing of the permit application. Gilmore, Manager, Project Development and Environmental Analysis Branch, Post Office Box 25201, Raleigh, North Carolina 27611-5201 has applied for a Department of the Army (DA) permit TO DISCHARGE DREDGED OR FILL MATERIAL INTO APPROXIMATELY 8325 LINEAR FEET OF STREAM CHANNEL AND 0.67 ACRES OF WETLANDS ADJACENT TO THE HIWASSEE RIVER, MARTIN CREEK, HAMPTON CREEK, McCOMB BRANCH AND UNNAMED TRIBUTARIES TO FACILITATE THE RELOCATION OF A 4.9-MILE LONG SECTION OF US HIGHWAY 64 BETWEEN MURPHY AND PEACHTREE, CHEROKEE COUNTY, NORTH CAROLINA (TIP NO.R-0977A). The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed construction of a new two-lane road on four-lane right-of-way relocating US 64 to a location south of the existing highway. The proposed right-of- way varies in width from 170 to 500 feet depending on terrain. Rural sections of the 4.9-mile long project would have a 46-foot wide median. Two new bridges would be constructed spanning the Hiwassee River, one at the west end of the project near Murphy and the other near the eastern end of the project at Peachtree. Temporary construction and access fills within the Hiwassee River are proposed to facilitate bridge construction. Approximately 0.9 acres of temporary rock fill would be required at the west bridge and 0.2 acres required at the east bridge. Six small herbaceous marsh and scrub shrub wetlands ranging in size from 0.02 to 0.27 acres would be impacted by the proposed construction. A total of 0.67 acres of wetlands would be eliminated by the proposed construction. The project would also result in the loss of 8325 linear feet of stream channel from pipe and culvert installation, 7512 linear feet of which has important aquatic function. These stream channels range in size from unnamed tributaries to the. Hiwassee River which are 2-3 feet wide and less than 6 inches deep, to Martin Creek which is 20-30 feet wide and in excess of 2 feet deep in places. Most of the streams have perennial flow and a substrate of sand, gravel, and cobble. The fisheries are characterized as cool water including northern hog sucker, rock bass, smallmouth bass, redbreast sunfish, greenside darter and various species of dace, chub and shiner. Martin Creek would flow under the proposed roadway through an I Ix 12-foot, triple box culvert.. This proposed crossing would result in the filling of 767 linear feet of stream channel. A double, 8x8-foot box culvert would be installed at the crossing of Hampton Creek, resulting in the loss of 971 linear feet of channel. At Site No. 11 on an unnamed tributary to the Hiwassee River, the proposed roadway crossing and 2 resultant relocation of a secondary road would result in 2001 linear feet of channel piping and 1761 linear feet of channel relocation. The proposed crossing of McComb Branch would result in 1056 feet of channel loss from piping. There would be a net loss of 5751 linear feet of functional stream channel as a result of the proposed work. The applicant is currently proposing to mitigate for these stream losses by contributing to the North Carolina Wetland Restoration Program (WRP). The WRP has identified potential stream restoration sites on Shooting Creek and Junaluska Creek within the Hiwassee River Watershed. An Environmental Assessment (EA) for the proposed work was approved by the Federal Highway Administration on July 29, 1994. The purpose of the proposed work is to provide a safer road facility with provisions for additional capacity as traffic volumes grow. US Highway 64 serves as an important connector route between Murphy and the Peachtree and Brasstown areas. Plans showing the proposed work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Department of Environment and Natural Resources (NCDENR) has determined the applicability of a Water Quality Certificate as required by PL 92-500. The Tennessee Valley Authority will review this public notice to determine the need for the applicant to obtain an authorization under Section 26a of the Tennessee Valley Authority Act of 1933. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the 3 conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need fora public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Waxer Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the CleanWater Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Water Quality (NCDWQ), 4401 Reedy Creek Road, Raleigh, North Carolina 27607. The North Carolina Department of Transportation proposes to construct a new two-lane facility on four-lane right-of-way (ROW) south of the Hiwassee River. A 46-foot median is proposed for the ultimate rural typical section. Bridges will be constructed across the Hiwassee River at two locations. The proposed project is approximately 4.9 miles in length, and the proposed ROW varies in width between 170 and 500 feet, due to the mountainous terrain. Partial control of access is proposed with a minimum of one access point per parcel. Traffic will be maintained during construction on the existing roadway which will remain open to serve local traffic after construction. Existing US 64 is currently a two-lane facility connecting the town of Murphy and the Peachtree community. Existing= ROW varies from 60 to 100-feet providing a 20 to 24-foot pavement section with some areas not containing a shoulder section. There is no control of access. Existing horizontal and vertical alignments are substandard with the horizontal alignment including 1 1 curves over four degrees, one of which is a twenty degree curve at Racetrack Bend. Additionally, there are seven- percent grades in the vicinity of Racetrack Bend. The substandard geometry reduces operating speeds and highway capacity. Passing sight distances are restricted in 89 percent ofthe length of the highway with few areas to pass Or pull oft the road. This has resulted in a hazardous stretch of highway with sharp curves, steep grades and poor sight distances. The accident rate in the project vicinity is 12 petc;:nt higher- than the statewide average. The Ank 2 community of Peachtree also contains a hospital and a community college. The proposed improvements will provide a safer access to the hospital and to Tri-County Community College with provisions for additional future capacity as traffic volumes grow. The environmental impacts, including the alternative selection process, were evaluated in an Environmental Assessment dated July 28, 1994 and a Finding of No Significant Impact (FONSI) dated February 28, 1995. These documents contain studies that investigated impacts to natural systems and protected species. No Threatened or Endangered Species will be impacted by the proposed project. However, one Endangered freshwater mussel species, the little wing pearly mussel (Pegias fabula) is listed for Cherokee County. Intensive field surveys were conducted for this species along areas of the Hiwassee River and its tributaries that may be affected by the proposed project on May 26-27, 1998. Representatives from the U. S. Fish and Wildlife Service (FWS), the North Carolina Wildlife Resources Commission (WRC), and NCDOT were in atter,Zance. A copy of the WRC report on these surveys will be forwarded as soon as it becomes available. Wetland delineations were performed by NCDOT biologists on January 30-31, 1997 using delineation criteria prescribed in the "Corps of Engineers Wetland Delineation Manual" (Environmental Laboratory, 1987). Their report is included for reference. Construction of the proposed project will require impacts to waters of the United States, including both jurisdictional wetlands and surface waters. Wetlands will be impacted by the placement of fill as well as excavation. Surface waters will primarily be impacted by the construction of new pipes and culverts at stream crossings as well as channel relocation. The NCDOT has attempted to minimize impacts to waters of the United States wherever practical. During the right-of-way consultation phase, several environmental commitments were made to ensure that impacts to waters were minimized. At the crossing of Martin Branch Creek rock plating was used upstream of the inlet of the proposed culvert to eliminate 624.0 feet of channel change. Bridge piers at the two crossings of the Hiwassee River will be oriented approximately parallel to the stream flow to minimize disturbance of flow. Maximum span lengths were used in the design of the crossings in order to have as few bents as possible located in the channel. Culverts at both Martin Branch Creek and Hampton Creek were oversized by 0.3 meters to allow for stockpiled bed material to be placed on the floor of the culverts. Additionally, a temporary work pad will be required for the construction of the bridges over the Hiwassee River. The work pad on the eastern end of the project will require 0.96 acre of temporary fill be placed in the Hiwassee River, and 0.17 acres of temporary impact will occur at the second crossing on the western end of the project. The causeways will be removed with minimum disturbance to the sti-eambed as soon as construction is complete. We are providing one copy of the full-size roadway plans to the Asheville regulatory field office for their review. The department has also prepared permit drawings, which depict the impact areas. The enclosed permit drawings include a summary of the project impacts 3 in metric units. Currently, this is one of only two projects in the Transportation Improvement Program (TIP) for the Hiwassee River basin that are anticipated to require compensatory mitigation. The other project is TIP number A-0009. Only about 5 miles of one section is within the Hiwassee River basin. Construction is tentatively scheduled to begin in 2004, but could be delayed. The ultimate construction of two additional lanes of R-0977 is the only other project in the foreseeable future, but it is currently unscheduled. NCDOT feels that this project provides an ideal situation to make use of in lieu payments. The Hiwassee River basin is isolated in the extreme western part of the state, covering only parts of Cherokee and Clay Counties. Due to the singular nature of mitigation needs in this basin, the process of searching the basin for suitable mitigation sites, evaluating the sites for success potential, acquiring the sites, and creating and implementing a mitigation plan would be costly and time-consuming. It would be more efficient to allow the WRP to incorporate mitigation for this project into their restoration plans for the Hiwassee River Basin. In summary, impacts to waters of the United States total 0.67 acres of jurisdictional wetlands and 8,325 linear feet of stream due to roadway fill, pipes and culverts. Enclosed is a completed notification form and drawings that depict impacts to waters of the United States. Based on the discussed impacts to waters of the United States, the department requests authorization under a Section 404 Individual Permit to construct the project. The NCWRP is in the process of developing comprehensive watershed restoration plans for portions of cataloguing unit 06020002 of the Hiawassee River Basin. These plans are being developed in Y ?i cooperation with the Clay County Soil and Water Conservation District, Cherokee County Soil and Water Conservation District, Natural Resources Conservation Service, and the Hiawassee River l Watershed Coalition. As indicated by the attached letters from the Clay County Soil - and Water Conservation District and the Natural Resources Conservation Service, approximately 10,000 linear feet of stream in need of restoration have been identified. In addition, eight to ten acres of potential wetland restoration have been identified. The stream restoration projects will involve stabilization and reconfiguration of the existing stream channel with the goal or re-establishing the natural stream geomorphology and the establishment of a vegetated buffer adjacent to the stream. No. R-0977A; Action ID No. 199930528) This is the report of the U.S. Fish and Wildlife Service and the Department of the Interior with regard to a public notice dated March 26, 1999, for a permit application subm.itteci. by the North _ Carolina Department of Transportation (NCDOT), Project Development and Environmental Analysis Branch, to impact waters of the United States in conjunction with the construction of improvements to US 64 on a new location, from Peachtree to near Murphy, in Cherokee County, North Carolina. This report is based on a site visit, a review of information in the public notice, and the July 1994 document entitled "Environmental assessment for U.S. 64 relocation from U.S. 19 in Murphy to east of NC 141, Cherokee County, North Carolina." This report is submitted in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Protected species The public notice indicates that the District Engineer determined that the proposed project will not affect threatened or endangered species or critical habitat. In our August 7, 1990, letter, in which we responded to a scoping notice, we indicated that we had no records of federally listed or proposed species within the action area. However, we also noted in that letter that obligations under Section 7 of the Act must be reconsidered if new information reveals potential impacts not previously considered or if new species are listed. Since our letter of concurrence in 1990, new species have been listed and new information is available about potential impacts not previously considered. The environmental assessment (page 3-36 and Table 3-10) considered nine candidate species known at the time from Cherokee County. The environmental assessment did note that there appeared to be appropriate habitat. for the knotty rocksnail (formerly known as the knotty elimia), Hiwassee crayfish, olive darter, and hellbender. 1 4- ly proteCted, hdangered and threatened The enclosed pages provide are updated list of federal species known from Cherokee County that may occur within the area of influence of this proposed action. These pages also contain a list of species of Federal concern that are currently under status review by the Service and which may occur in the project impact area. Species of Federal concern are not legally protected under the Act and are not subject to any of its provisions, including Section 7, unless they are formally proposed or listed as endangered or threatened. We are including these species in our response to give advance notification. We do have records of several of these species within the project area. In terms of aquatic fauna in the project area, there is significant new information available since preparation of the environmental assessment. 1. During a visit to the Hiwassee RiverBrasstown Creek area on May 27, 1998, our staff, NCDOT biologists, and North Carolina Wildlife Resources Commission staff observed a number of aquatic species in the project area. The mussel fauna of the Hiwassee River, in the project area, includes the mountain creekshell (Villosa vanuxemensis), spike (Elliptio dilatata), another Elliptio species, wavy-rayed lampmussel (Lampsilis fasciola), Tennessee clubshell (Pleurobema oviforme), and rainbow mussel (Villosa iris). They also observed the sicklefin redhorse (Moxostoma sp.), a species of Federal concern, in the Hiwassee River and Martins Creek, .xr? ere it is reported .0 spawn. A status survey should be completed in the summer of 1999; preliminary indications are that this species appears to be a candidate for Federal listing. The hellbender (Cryptobranchus alleghanensis), a large aquatic salamander and a species of Federal concern, was observed foraging in the Hiwassee River. 2. The Hiwassee crayfish (Cambarus hiwasseenis) has been found in Martins Creek. The type locality for this species is an unnamed tributary to Peachtree Creek. On August 6, 1998, our staff located what we have identified as the knotty rocksnail (Lithasia christyi) and possibly the smooth rocksnail (Leptoxis virgata), both species of Federal concern, in the Valley River in Murphy. 2 3. We have records of the endangered Cumberland bean (Villosa trabalis) and tan riffleshell (Epioblasma walkeri) in the Hiwassee River in Tennessee just downstream of Apalachia Lake. There are historic records of the littlewing pearlymussel (Pegius fabula) in the Valley River. The endangered Appalachian elktoe (Alasmidonta raveneliana) has been found in similar habitat in other areas of the Tennessee River basin, often in association with several of the mussel species found last year in the Hiwassee River. There appears to be suitable habitat for the threatened spotfin chub (Hybopsis monacha) in the project area. This fish has been overlooked before in areas where it is relatively abundant and is known from drainages all around the Hiwassee River. There is a rather diverse mussel and fish assemblage in the Hiwassee River, and the habitat appears suitable for any of these listed species. Therefore, it is not unreasonable to expect that these species could occur in the Hiwassee River within the project area. Based on the information provided in the environmental assessment and a review of our records and site visits, we can no longer agree that the project will have no effect on federally listed species. We are particularly concerned about the potential impacts the proposed action could have on listed or proposed endangered or threatened species and on stream and wetland ecosystems within the project impact area. We recommend surveys for all the species (aquatic and terrestrial) on our list of known species, as well as those mentioned above as being likely to occur, for which suitable habitat exists. Section 7(a) of the Act requires Federal agencies to evaluate their actions with respect to any species that is proposed or listed as endangered or threatened and with respect to critical habitat if any is designated. Regulations implementing this interagency cooperation provision of the Act are codified at 50 CFR Part 402. Section 7(a)(2) of the Act requires Federal agencies to ensure that activities they authorize, fund, or carry out are not likely to jeopardize the continued existence of a listed species or to destroy or adversely modify its critical habitat. If a Federal action may affect a listed species or its critical habitat, the responsible Federal agency must enter into formal consultation with the Service. Wetland and stream impacts In our review of any subsequent permit applications for this project, we will likely recommend the following conditions: (1) proper sequencing should be followed that would permit only the most necessary wetland and stream impacts, (2) a mitigation plan should be developed for any unavoidable impacts, (3) temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of any ground-disturbing activities in order to prevent soil erosion, and (4) a vegetated buffer (deep-rooted woody species) of at least 25 feet should be maintained along all stream banks. Minimization. Since most of the jurisdictional wetlands and most of the streams within the proposed project site are potentially affected, either directly by filling or with culverts or 3 indirectly by the removal of stream-side vegetation, there does not appear to have been sufficient consideration for avoiding or minimizing impacts to streams and wetlands within the project area. With the current design of two lanes on a four-lane right-of-way, it appears that the proposed impacts have not been minimized and impacts to some stream channel segments are not necessary. Inappropriate mitigation. Although we support the efforts of the North Carolina Wetlands Restoration Program, we believe that, after proper sequencing, ample opportunities will be discovered to offset the unavoidable impacts to wetlands and streams within or adjacent to the project boundaries. Additionally, we recommend the removal of culverts and restoration of the associated stream channel at old road crossings where feasible. Will the existing facility be abandoned after completion of the proposed improvements? Recommended mitigation for unavoidable impacts. We favor on-site, in-kind mitigation for unavoidable impacts to streams and wetlands. If adequate mitigation potential is unavailable on site, we recommend all mitigation be accomplished within the same, or adjacent, subbasins as the proposed impacts. We have observed opportunities for stream-bank restoration and protection on Martins and Hampton Creeks, several unnamed tributaries, and the Hiwassee River. Because of the level of impact proposed, we recommend that mitigation for stream impacts, focusing on riparian restoration, be accomplished at a ratio of at least 2:1. Following are additional mitigation recommendations we recommend for any stream mitigation developed for unavoidable impacts associated with this project: Riparian vegetation should include native woody species, such as alder (Alnus spp.), rhododendron, leucothoe, and dogwood, as well as sedges, grasses, and rushes. Exotic vegetation should be screened from any plant material. Large woody species will provide thermal cover as well as deep bank-stabilizing root systems along the constructed stream channel. 2. Stream channel construction and vegetation establishment should take place prior to the diversion of water into the new channel. Sequential construction of segments and temporary pipe diversions can be utilized to ensure channel stability. We would like to have an opportunity to inspect stream segments for stability prior to the water diversion. 3. Stream channel design should mimic slope, riffle slope, pool slope, valley slope, meander geometry, sinuosity, cross-sectional dimensions, entrenchment ratio, bed material (pebble count), and bankfull discharge of a nearby reference reach of stable stream of the same classification (Rosgen 1996). We would like to review the final design of the stream channel and wetland creation portion of the project. 4. Monitoring and any needed maintenance should continue for at least 5 years following channel and wetland construction. Annual reports should be 4 submitted to the resource agencies, and they should be notified of problems with success or function of the stream or wetland mitigation within 30 days of detection. 5. An appropriate regional conservation organization should hold title to the deed restrictions on the mitigation site(s). The title to the conservation easement should be conveyed along with an endowment for future monitoring, management, and any contingencies to ensure success of the mitigation. The endowment should also make provision for any required periodic legal filing. 6. Details need to be provided in the final mitigation plan relative to what measures will be taken to control watershed conditions and prevent sediment pollution and increased water discharge that would influence stream stability downstream of impacted segments. Because extensive segments of "unimpacted" stream are shown as being hand cleared in maps included with the public notice, we are concerned that these segments will, in fact, be impacted by uncontrolled sediment, chemical and nutrient pollution, and flashy run-off. Storm-water management. We are also concerned about the potential impacts of storm-water run-off from the proposed roadway. The proposed project will increase impervious surface, thereby affecting natural hydrology. Since the proposed route includes steep areas and is in an area of high precipitation, we believe storm-water effects could be significant. Storm-water control measures should be addressed in detail in any subsequent document prepared for this project. The velocity, thermal, and chemical parameters of storm water should be considered in the revisions. Wildlife impacts Wildlife crossings. In their August 2, 1995, response to our comments on the environmental assessment, the Federal Highway Administration indicated that wide-ranging species, such as the black bear, could cross the proposed facility beneath the bridge crossings and culverts. We do not believe enough detail was provided in that explanation. Further, our understanding of wildlife crossings has been expanded since that time. We recommend more details be included in a revised environmental document for this project. The effects of highways. such as that proposed here can be characterized as: (1) habitat fragmentation, (2) direct mortality, (3) direct habitat loss, (4) displacement and avoidance, and (5) problems associated with human development. We believe it is important to reduce the impacts of the proposed road construction on local populations and to preserve the ecological processes that are related to landscape continuity and metapopulation dynamics. One obvious measure to minimize any unavoidable fragmentation effects of highways to wildlife is to provide crossings. Wildlife crossings may effectively reduce impacts to wildlife populations, reduce mortality due to vehicles, and reduce corresponding hazards to human life and property. Wildlife crossings should be planned so as to 5 take advantage of current wildlife movement corridors to maximize their potential effectiveness. Openness factors should be calculated for underpasses so that target species are not repelled. General designs for wildlife passage include overpasses, underpasses, viaducts, expanded bridges, upland culverts, and/or fencing. Other measures, such as habitat conservation, may offset the direct loss of habitat and the indirect effects of fragmentation and noise/edge effects for area-sensitive species. Therefore, we believe successful minimization/mitigation features depend entirely on a clear definition of species-level and natural community-level objectives. What wildlife species will be affected by the proposed project? Which natural communities? Which guilds? How will fragmentation affect resident wildlife? What area-sensitive species inhabit the largely undeveloped areas of the northern bypass alternatives? Monitoring is a critical element of any plan for mitigation of highway impacts to wildlife. What is the plan for monitoring? We believe each of these questions should be addressed in the revised document. In summary, we do not concur with the determination of "no effect" to listed species. We recommend that the Federal Highway Administration revise and update the environmental assessment, addressing all our concerns as stated above, and a subsequent reevaluation of the finding of no significant impact. 'In the November 4, 1997, Federal Register (55822-55825), the northern population of the bog turtle (from New York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south to Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land-management activities by private landowners in North Carolina, part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss. The aggregate length of channel for these sites was subtracted from the "channel length created" total. This reduced the "channel length created" total by 296.0 linear feet. Site 07 (88.0 linear feet) and Site 09 (725.0 linear feet) were determined to be intermittent jurisdictional surface waters not requiring mitigation. A mitigation requirement column was added in Table IA to indicate total mitigation requirements for surface waters. In summary, 813.0 feet of the 8325.0 feet of channel loss will not require mitigation. An additional 1761.0 feet of channel will be created on-site. Therefore the net loss of stream channel requiring compensatory mitigation is 5751.0 linear feet. Thank you for your continued review of this application. The aggregate length of channel for these sites was subtracted from the "channel length created" total. This reduced the "channel length created" total by 296.0 linear feet. Site 07 (88.0 linear feet) and Site 09 (725.0 linear feet) were determined to be intermittent jurisdictional surface waters not requiring mitigation. A mitigation requirement column was added in Table IA to indicate total mitigation requirements for surface waters. In summary, 813.0 feet of the 8325.0 feet of channel loss will not require mitigation. An additional 1761.0 feet of channel will be created on-site. The North Carolina Department of Transportation proposes to construct a new two-lane facility on four-lane right-of-way (ROW) south of the Hiwassee River. A 46-foot median is proposed for the ultimate rural typical section. Bridges will be constructed across the Hiwassee River at two locations. The proposed project is approximately 4.9 miles in length, and the proposed ROW varies in width between 170 and 500 feet, due to the mountainous terrain. Partial control of access is proposed with a minimum of one access point per parcel. Traffic will be maintained during construction on the existing roadway which will remain open to serve local traffic after construction. Existing US 64 is currently a two-lane facility connecting the town of Murphy and the Peachtree community. Existing ROW varies from 60 to 100-feet providing a 20 to 24-foot pavement section with some areas not containing a shoulder section. There is no control of access. Existing horizontal and vertical alignments are substandard with the horizontal alignment including I 1 curves over four degrees, one of which is a twenty degree curve at Racetrack Bend. Additionally, there are seven- percent grades in the vicinity of Racetrack Bend. The substandard geometry reduces operating speeds and highway capacity. Passing sight distances are restricted in 89 percent of the length of the highway with few areas to pass or pull off the road. This has resulted in a hazardous stretch of highway with sharp curves, steep grades and poor sight distances. The accident rate in the project vicinity is 12 percent higher than the statewide average. The 9 2 community of Peachtree also contains a hospital and a community COZY ' 4 1I7'proposed improvements will provide a safer access to the hospital and to Tri-County Community College with provisions for additional future capacity as traffic volumes grow. The environmental impacts, including the alternative selection process, were evaluated in an Environmental Assessment dated July 28, 1994 and a Finding of No Significant Impact (FONSI) dated February 28, 1995. These documents contain studies that investigated impacts to natural systems and protected species. No Threatened or Endangered Species will be impacted by the proposed project. However, one Endangered freshwater mussel species, the little wing pearly mussel (PegiasAbula) is listed for Cherokee County. Intensive field surveys were conducted for this species along areas of the Hiwassee River and its tributaries that may be affected by the proposed project on May 26-27, 1998. Representatives from the U. S. Fish and Wildlife Service (FWS), the North Carolina Wildlife Resources Commission (WRC), and NCDOT were ill attendance. A copy of the WRC report on these surveys will be forwarded as soon as it becomes available. Wetland delineations were performed by NCDOT biologists on January 30-31, 1997 using delineation criteria prescribed in the "Corps of Engineers Wetland Delineation Manual" (Environmental Laboratory, 1987). Their report is included for reference. Construction of the proposed project will require impacts to waters of the United States, including both jurisdictional wetlands and surface waters. Wetlands will be impacted by the placement of fill as well as excavation. Surface waters will primarily be impacted by the construction of new pipes and culverts at stream crossings as well as channel relocation. The NCDOT has attempted to minimize impacts to waters of the United States wherever- practical. During the right-of-way consultation phase, several environmental commitments were made to ensure that impacts to waters were minimized. At the crossing of Martin Branch Creek rock plating was used upstream of the inlet of the proposed culvert to eliminate 624.0 feet of channel change. Bridge piers at the two crossings of the Hiwassee River will be oriented approximately parallel to the stream flow to minimize disturbance of flow. Maximum span lengths were used in the design of the crossings in order to have as few bents as possible located in the channel. Culverts at both Martin Branch Creek and Hampton Creek were oversized by 0.3 meters to allow for stockpiled bed material to be placed on the floor of the culverts. The causeways will be removed with minimum disturbance to the streambed as soon as construction is complete. We are providing one copy of the full-size roadway plans to the Asheville regulatory field office for their review. The department has also prepared permit drawings, which depict the impact areas. The enclosed permit drawings include a summary of the project impacts 3 in metric units. Currently, this is one of only two projects in the Transportation Improvement Program (TIP) for the Hiwassee River basin that are anticipated to require compensatory mitigation. The other 4 project is TIP number A-0009. Only about 5 miles of one section is within the Hiwassee River basin. Construction is tentatively scheduled to begin in 2004, but could be delayed. The ultimate construction of two additional lanes of R-0977 is the only other project in the foreseeable future, but it is currently unscheduled. NCDOT feels that this project provides an ideal situation to make use of in lieu payments. The Hiwassee River basin is isolated in the extreme western part of the state, covering only parts of Cherokee and Clay Counties. Due to the singular nature of mitigation needs in this basin, the process of searching the basin for suitable mitigation sites, evaluating the sites for success potential, acquiring the sites, and creating and implementing a mitigation plan would be costly and time-consuming. It would be more efficient to allow the WRP to incorporate mitigation for this project into their restoration plans for the Hiwassee River Basin. In summary, impacts to waters of the United States total 0.67 acres of jurisdictional wetlands and 8,325 linear feet of stream due to roadway fill, pipes and culverts. Based on the discussed impacts to waters of the United States, the department requests authorization under a Section 404 Individual Permit to construct the project. DIRECTOR Dear Mr. Lund: Subject: US 64 Relocation in Cherokee County TIP Project #: R-0977A Cherokee County The purpose of this letter is to notify you that the North Carolina Wetlands Restoration Program (NCWRP) is willing to accept payment from the North Carolina Department of Transportation (NCDOT) for wetland and stream impacts associated with the subject project in accordance with the Memorandum of Understanding between the NCWRP and the U.S. Army Corps of Engineers. The NCWRP is in the process of developing comprehensive watershed restoration plans for portions of cataloguing unit 06020002 of the Hiawassee River Basin. These plans are being developed in cooperation with the Clay County Soil and Water Conservation District, Cherokee County Soil and Water Conservation District, Natural Resources Conservation Service, and the Hiawassee River Watershed Coalition. As indicated by the attached letters from the Clay County Soil and Water Conservation District and the Natural Resources Conservation Service, approximately 10,000 linear feet of stream in need of restoration have been identified. In addition, eight to ten acres of potential wetland restoration have been identified. The stream restoration projects will involve stabilization and reconfiguration of the existing stream channel with the goal or re-establishing the natural stream geomorphology and the establishment of a vegetated buffer adjacent to the stream. The NCWRP will continue to work with these parties to identify and implement additional stream and wetland restoration projects in accordance with the watershed restoration plan. P.O.
