Klimek, P.E. Director Division of Water Quality DWQ Project # 06-1381 County: Beaufort On August 25, 2006, the Division of Water Quality (DWQ) received your application dated August 22, 2006 to impact 1,500 square feet of Zone 1 of the protected riparian buffers and 1,000 square feet of Zone 2 of the protected riparian buffers to grade and revegetate the slope of the hill on the referenced property to lessen erosion. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0259(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: Grading and Revegetating the Buffers You have proposed impacts to Zones 1 and 2 of the protected riparian buffers to grade and revegetate on your property to alleviate erosion. Grading and revegetating in Zone 2 of the protected riparian buffers are allowable in the Tar-Pamlico Buffer Rules (15A NCAC 02B.0259). However grading and revegetating in Zone 1 of the buffers is prohibited. You must stay out of Zone 1 with your grading and revegetating activities or apply for a Major Variance which must be heard before our Water Quality Committee. You can download our Major Variance application at the following website: http://h2o.enr.state.nc.us/ncwetlands/major.doc Please respond within three weeks of the date of this letter by sending this information to me in writing and Kyle Barnes of the DWQ Washington Regional Office.
