Current Site Conditions
The subject property is currently comprised of a majority of agricultural land (crop land). The forest cover varies between hardwoods that occur near the existing tributaries,
flood plain/wetland areas, and mixed pine dominated stands on slightly higher elevations. The forest community is dominated by Sweetgum (Liquidambar styraciflua) and red maple
(Acer rubrum), with some mixed oaks and loblolly pine (Pinus taeda).
Jurisdictional waters of the US were classified according to USAGE guidance. The results of the jurisdictional determination investigation (completed by others) indicated that there were
several jurisdictional streams present within the subject property. Streams T1, T2, T3, and T4 are all unnamed tributaries that drain to Bearskin Creek. All of these streams would be
considered non -wetland waters of the US that are a part of the Yadkin -Pee Dee River Basin (HUC# 03040105)(USGS 1974).
Jurisdictional wetlands were also located within the project area. Wetlands W1000, W1100, and W3000 are all adjacent to the Ur to Bearskin Creek (T1-Perennial). Wetland W2000
occurs at the head of the unnamed tributary T2 (Intermittent). Wetland W3100 occurs above the head of the unnamed tributary T3 (Intermittent). Wetland W4000 occurs near the
unnamed tributary T4(Intermittent).

4h. Explain the purpose of the proposed project:*
The growth of the housing market in the greater Charlotte metropolitan area including Union County, has been enormous since the end of the "Great Recession." The demand for
housing has skyrocketed since 2011. However, within the last quarter, inventories have been increasing, suggesting that the housing market may be growing more slowly than in years
past. This slowing of growth has not translated into significant changes in demand, even with the onset of the Covid-19 Pandemic. Currently, demand is still strong in the eastern portion
of the greater Charlotte metropolitan area. With this in mind, the applicant proposes to construct a ±124-acre single family residential development. The overall purpose of the project is
to provide additional housing to meet the growing needs of this area of Union County and the greater Charlotte Metropolitan area.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The project consists the following impact: Impact #1 consists of the placement of fill for a road crossing across a 0.13-acre wetland area. This road fill will affect approbmately 60
percent of the wetland. The remaining 40 % of the wetland area is proposed to be be filled also. This will create one lot. Although the filling of the area for the lot is beneficial for the
development, the remaining wetland area, if left open would be degraded or eliminated completely by the grading and filling of the sub -watershed that feeds this wetland area. With the
water source cut off from this wetland, it would no longer function properly. Therefore, the entire wetland area would be impacted by the proposed development. The filling of this
remaining wetland area will aid the area by not trapping the runoff from adjacent areas and creating an open water ponded area that would have little or no function.
Typical construction equipment will be used for this project. Those pieces of equipment include, but are not limited to: bulldozers, track hoes, dump trucks, etc.

This project consists one impact where a small wetland (0.13-acre) that will be filled for a road crossing (and lot). This road fill will affect appro>mately
60 percent of the wetland. The remaining 40 % of the wetland area is proposed to be be filled also. This will create one lot. Although the filling of the
area for the lot is beneficial for the development, the remaining wetland area, if left open would be degraded or eliminated completely by the grading
and filling of the sub -watershed that feeds this wetland area. With the ureter source cut off from this wetland, it would no longer function properly.
Therefore, the entire wetland area would be impacted by the proposed development.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
The site was designed to minimize impacts to the greatest e)dent practicable. There is a single impact that consists of 0.13-acre of fill associated with a
road crossing and subsequent lot fill which will occur because the wetland will no longer function due to its water source being developed above the
wetland. This 0.13-acre impact represents appropmately 4 percent of the wetland area located on site. The remaining 96 percent (appro)dmately 3-
acres) will not be impacted by the project. Additionally, there are no stream impacts proposed for this site. All ±5,000 linear feet of stream present on
the site will not be impacted by the project. The avoidance and minimization of these areas was made possible by utilizing engineering designs to
avoid grading disturbances in these sensitive areas.

NCSHPO Website (HPOWEB 2.0), however the archaeological component is not viewable by the public. Based on our review of HPO WEB 2.0, no
listed resources with historic significance were located on the subject property. However, there is a portion of a National Register Historic District
located adjacent to the development (UN0501 - Waxhaw-Weddington Roads Historic District) that contains 5 historic structures (The OP Heath House
(UN0457); the Robert B Redwine House (UN0500); the Edward Crow House (UN0496); the Crowds Nest (UN0498); and the Redwine Tenant House
(UN0499). The permittee has included a vegetated buffer area (appro>amately 100 feet wide) that will separate the development area from the historic
district. This buffer area will help protect the viewshed from the portion of the historic district adjacent to the development.
Additionally, there are 5 other designated entities within a 0.5-mile radius of the site. Those include: the John R Welsh House (UN0589); the Houses
(UN0588); the Thomas Gordon House (UN0587); the N W Tharpe House (UN0599); and the Dr. B C Readfearn House (UN0600).

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.

The designation Grantor and Grantee as used herein shall include said parties, their heirs, successors, and assigns,
and shall include singular, plural, masculine, feminine or neuter as required by context.
WITNESSETH, that the Grantor, for a valuable consideration paid by the Grantee, the receipt of which is hereby
acknowledged, has and by these presents does grant, bargain, sell and convey unto the Grantee in fee simple, all that
certain lot or parcel of land situated in the City of Monroe, Township, Union County, North
Carolina and more particularly described as follows:
All that certain tract of land lying in Monroe Township, Union County, North Carolina, being shown and
designated as Tract 1, containing 102.385 acres, more or less, and Tract 2, containing 20.59, more or less,
on Annexation Plat entitled "Annexation of 122.976 Acres of the Secrest Drug Company Inc. Property,"
prepared by Metrolina Engineering & Associates dated October 30, 2017 and recorded as Plat Cab O, File
162, 163 & 164, in the office of the Register of Deeds for Union County, North Carolina, reference to said
plat is hereby made for a more particular description of the premises.
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and appurtenances thereto
belonging to the Grantee in fee simple.
And the Grantor covenants with the Grantee, that Grantor is seized of the premises in fee simple, has the right to
convey the same in fee simple, that title is marketable and free and clear of all encumbrances, and that Grantor will
warrant and defend the title against the lawful claims of all persons whomsoever except for the exceptions
hereinafter stated. Title to the property hereinabove described is subject to the following exceptions:
All valid and enforceable easements, covenants, conditions and restrictions of
record, and 2019 ad valorem taxes, which Grantee assumes and indemnifies
Grantor against any liability therefore.
