Therefore, the State of North Carolina certifies that this activity will not ?xolate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. Should your project change, you are required to notify the DWQ and you may be required to submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If any additional wetland impacts, or stream impacts, for this project (now or in the future) exceed one acre or 150 linear feet, respectively, additional compensatory mitigation may be required as described in 15A NCAC 214.0506 (h) (6) and (7). For this approval to remain valid, you are required to comply with all the conditions listed below. In addition, you should obtain all other federal, state or local permits before proceeding with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. This Certification shall expire three years from the date of the cover letter from DWQ or on the same day as the expiration date of the corresponding Corps of Engineers Permit, whichever is sooner. Condition(s) of Certification: 1. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: NCDOT TIP R-2231, R-3303, DWQ # 000874 Page 3 September 28, 2004 a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. Any reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 2. No waste, spoil, solids, or fill of any kind shall occlut in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Pr6construction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 3. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 4. If an environmental document is required, this Certification is not valid until a FONSI or ROD is issued by the State Clearinghouse. All water quality-related conditions of the FONSI or ROD shall become conditions of this Certification. 5. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened. 6. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit without appropriate modification of this certification. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities. 7. All channel relocations will be constructed in a dry work area, and stabilized before stream flows are diverted. Channel relocations will be completed and stabilized prior to diverting water into the new channel. Whenever possible, channel relocations shall be allowed to stabilize for an entire growing season. Vegetation used for bank stabilization shall be limited to native woody species, and should include establishment of a 30 foot wide wooded and an adjacent 20 foot wide vegetated buffer on both sides of the relocated channel to the NCDOT TIP R-2231, R-3303, DWQ # 000874 Page 4 September 28, 2004 maximum extent practical. A transitional phase incorporating coir fiber and seedling establishment is allowable. Also, rip rap may be allowed if it is necessary to maintain the physical integrity of the stream, but the applicant must provide written justification and any calculations used to determine the extent of rip-rap coverage requested. 8. Compensatory mitigation of 54.58 acres shall be done for 27.29 acres of impacts to jurisdictional wetlands in the Yadkin River Basin. In addition, 2.45 acres of compensatory mitigation shall be provided to offset 2.12 acres of jurisdictional wetlands in the Lumber River Basin. The mitigation shall be provided as described below. For the construction activities for the bridge located from Station 190+00 to 191+53, the NCDOT shall strictly adhere to sediment and erosion control Best Management Practices as described for High Quality Waters entitled "Design Standards in Sensitive Watersheds" (15A NCAC 04B .0024) throughout design and construction of the project. 10. Compensatory mitigation for impacts to streams shall be done for 7249 linear feet of stream impact in the Yadkin Basin and 351 linear feet of impact in the Lumber Basin, at a replacement ratio of 1:1. The mitigation shall be provided as described below. Construction activities related to the section of the Ellerbe Connector (NC 73 Extension, TIP R-3303) located in Richmond County are hereby authorized by this certification. 12. Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed to allow low flow passage of water and aquatic life unless it can be shown to DWQ that providing passage would be impractical. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested in writing by DWQ. 13. The permittee shall require its contractors (and/or agents) to comply with all of the terms of this certification, and shall provide each of its contractors (and/or agents) a copy of this certification. 14. During the construction of the project, no staging of e'?uipment of any kind is permitted in waters of the U.S., or protected riparian buffers. 15. Riparian vegetation must be reestablished within the construction limits of the project by the end of the growing season following completion of construction. 16. The dimension, pattern and profile of the stream above and below the crossing should not be modified by widening the stream channel or reducing the depth of the stream. Disturbed floodplains and streams should be restored to natural geomorphic conditions. 17. Any riprap used must not interfere with thalweg performance and aquatic life passage during low flow conditions. 18. All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 19. The outside buffer, wetland or water boundary as well as along the construction corridor within these boundaries approved under this authorization shall be clearly marked by orange fabric fencing for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities. 20. Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is prohibited. 21. Myrick's Pond: a. The step-pool sequence, associated flood plain, and constructed channel to connect the existing type A basin/permanent impoundment to the existing stream channel shall be constructed in the dry,. Water shall not be turned into the step-pool channel sequence until the sequence is completed and stabilized. Water shall not be turned into the r NCDOT TIP R-2231, R-3303, DWQ # 000874 Page 6 September 28, 2004 relocated step-pool sequence and channel until the USACE and the NCDWQ have conducted a site review of the newly constructed step-pool sequence and associated area. b. If any of the step-pool sequence or associated flood plain riparian areas are determined to be unstable, the area shall be repaired. All repair designs must be submitted to and receive written approval from the Division before the repair work is performed. c. Riparian vegetation, using native trees, shrubs, and herbaceous plants, must be re- established within the flood plain area, as well as the construction area, by the end of the growing season following completion of construction to provide long-term erosion control. d. Rock vanes shall be constructed and placed according to the plan sheets titled Site 6 Impoundment w/ Step Pools, Rip Rap Berm and Cross Vane Rock Weir Detail Sheet received by the Transportation Permitting Unit on September 1, 2004. 22. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the Transportation Permitting Unit of tl? Division of Water Quality upon completion of the project. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties.` This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon the expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. Located in Chowan County, at Bridge No. 4 on SR 1207 over Rocky Hock Creek, this site provides 0.6 acres of riverine wetland restoration, 7.36 acres of river wetland enhancement, and monitoring of 0.04 acres of temporary impacts associated with the B-3435 project. The site was left to naturally re-establish vegetation in 2004; hydrologic monitoring was not required for this project. According to permit conditions, NCDOT was required to monitor the Rocky Hock Creek Bridge Mitigation Site for three years or until success criteria were met; with vegetation monitoring conducted each year. After each growing season, annual monitoring reports were submitted to the appropriate regulatory agencies via the Natural Environment Unit's (NEU) website. After two years of vegetation monitoring, the Rocky Hock Creek Bridge Mitigation Site shows that natural re-vegetation has occurred and that the impacted area has re-attained jurisdictional status. Individual yearly monitoring data is provided within the annual monitoring reports available on NEU's website between 2005 and 2006. NCDOT requests that the appropriate resource agencies provide documentation stating that no further monitoring is required and that the site is closed. Located in Cumberland and Sampson counties, at Bridge No. 46 over the South River on NC 242, this 0.25-acre site provides mitigation for wetland impacts associated with the B-3152 project. The temporarily impacted area adjacent to the on-site detour was revegetated with bottomland hardwood species and must re-attain jurisdictional status at the end of three years; hydrologic monitoring was not required for this project. According to permit conditions, NCDOT was required to monitor the South River Bridge Mitigation Site for three years or until success criteria were met; with vegetation monitoring conducted each year. After each growing season, annual monitoring reports were submitted to the appropriate regulatory agencies via the Natural Environment Unit's (NEU) website. After three years of vegetation monitoring, the South River Bridge Mitigation Site shows that the planted vegetation is surviving and the temporarily impacted area has re-attained jurisdictional status. Individual yearly monitoring data sets are provided within the annual monitoring reports available on NEU's website between 2004 and 2006. NCDOT requests that the appropriate resource agencies provide documentation stating that no further monitoring is required and that the site is closed. This issue is addressed below: Construction Issue Construction at this site involves the draining of a pond near 6+00 Lt -RampB- near NC 55. Runoff from the roadway is discharged from a 450 mm rcp into the drained pond. This is causing stability problems through the bottom of the drained pond. We need to get the runoff through the drained pond and convey it towards the drainage system located downstream of the pond. The Department proposes to install rip rap in the flow line of the drained pond and the breached portion of the dam. The rip rap will provide long-term stability through the system. Permit Analysis This portion of the project is entirely located in the Cape Fear River basin. The proposed activity is located within the permitted footprint of the drained pond. No new additional impacts to streams, wetlands or riparian buffers will occur as a result of this activity. The installation of the rip rap will not result in degradation of downstream jurisdictional resources. Based on this information, we do not believe that a permit modification is required for this action. Please let me know if you agree with my assessment of the issue. As far as the church property goes, just as an update to you, Niki and Danny's unit are still pursuing enforcement... their sediment basin apparently isn't working too well. Hopefully this will get fixed soon so that we'll not have future problems with this. You may recall the numerous correspondence between the NCDOT and your agencies concerning stability issues at Site 2 (near 425+80) on R-2000G. The critical information concerning the issues at this site are briefly addressed below: -NCDOT installed a 900 mm cross line pipe at 425+80 in 2004. Construction activity at the Raleigh Christian Community property (now known as Wake Chapel Church), located topographically above our project in the drainage system, subsequently resulted in the complete degradation of streams, riparian buffers and wetlands within the NCDOT right-of-way. Excessive amounts of sediment filled in the stream channel, forcing water (and more additional sediment) out into the floodplain. The deposition of sediment completely altered the drainage system, resulting in the formation of a headcut above the 900 mm structure. -Personnel from the USACE and NCDENR-DWQ visited the site in 2004 to evaluate methods of stabilization at the 900 mm structure and to assess the drainage area upstream of the structure. Concentrated runoff from the Wake Chapel Church appeared to be the primary source of the destabilization in the drainage system, resulting in the excessive deposition of sediment. The regulatory agencies agreed to investigate enforcement action. The Department was directed to install a temporary pipe inlet protection device in the channel immediately upstream of the inlet. This device was partially located outside of the permitted footprint. -An on-site meeting was conducted on May 26, 2006 attended by Danny Smith, Nikki Maher, Jay Keller (Keller Environmental, representing the Wake Chapel Church) and various NCDOT personnel. The purpose of the meeting was to discuss proposed stabilization of the site upstream of the 900 mm structure in light of the construction schedule for R-2000 G. -The NCDOT sent the regulatory agencies a letter on September 5, 2006 which provided an update on apparent stabilization efforts at the Wake Chapel Church and stability of the channel immediately upstream of the 900 mm structure. At that time, remedial action did not appear to be forthcoming at the Wake Chapel Church and a headcut again formed at the limits of the temporary pipe inlet protection device installed immediately upstream of the structure. The NCDOT had proposed to permanently leave the temporary pipe inlet protection. It was noted that the majority of impacts associated with this construction were located within the previously permitted mechanized clearing of the site. The Department did not propose permitting or mitigation for additional impacts as the stabilization activity was required to provide protection to the structure and downstream jurisdictional resources as a result of off-site action. A revised Permit Drawing 10 of 50 (dated 9/9/06) was attached to the letter. The contractor associated with the construction of R-2000G is attempting to close out activity at the site. A evaluation of the site on May 14, 2007 indicated the following: -A detention basin appears to have been constructed on the Wake Chapel Church in the recent past. However, excess sediment is still located in the stream channel. This sediment appears to be moving downstream and continues to be been re-deposited in the streams, wetlands and riparian buffers immediately upstream of the 900 mm structure. A quick evaluation of the area would indicate that the stream channel has been lost and the wetlands have been completely filled in by the sediment. The first two attached photographs depict the area immediately upstream of the 900 mm structure. Note the sediment in the channel and in adjacent "wetlands." The deposition continues to change the drainage system at the site resulting in the formation of a headcut at the limits of the temporary pipe inlet protection device previously installed immediately upstream of the structure (see last attached photograph). -The R-2000G project is now open to traffic and the contractor is completing construction at all permit sites. The Department proposes to install additional Class B rip rap in the footprint of the headcut and then construct a Class A rip rap berm (maximum of 1.5 in in width and 0.15 in in height) in an attempt to force water into the pipe inlet. The Department does not propose permitting or mitigation for additional impacts as the stabilization activity is required to provide protection to the structure slope and downstream jurisdictional resources as a result of off-site action. We do hold DOT and other road projects to the same design standards. This may sound a little harsh, and I apologize if it does, but unfortunately I think it is the answer to your question. If the BMPs are necessary to comply with environmental regulations (and they are since we required them in the authorizations), then ongoing maintenance of those BMPs is required. In addition, as I see it, whoever is responsible for maintenance of the road is responsible for maintenance of the BMPs. Having said that, it doesn't really matter to us if someone else (other than DOT) wants to maintain the BMPs. All we need is that they be maintained. I do not want to get between the Town and DOT, and further don't believe it is our place to do so. But, someone will need to maintain the BMPs. I will leave that up to you to work out. Just so your know, if the BMPs are not maintained, then unfortunately future site inspections that turn up water quality violations could result in enforcement actions. In that case, the landowner would be held responsible. It is not clear to me from your email who that would be, but I just thought I should add that information so that no one is surprised in the future should something arise. NCDOT shall use Best Management Practices for the Protection of Surface Waters (NCDOT March 1997), specifically using all applicable preventive and control measures during the design, construction and maintenance of this project. These measures shall be implemented prior to any ground-disturbing activities to minimize impacts to downstream aquatic resources. 4. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the • State until the concrete has hardened. 5. Storm water shall be directed to vegetated buffer areas, grass-lined ditches or other means appropriate to the site for the purpose of pre-treating storm water runoff, and must not be routed directly into streams. Mowing of existing vegetated buffers is strongly discouraged, so that they may be utilized for storm water sheet flow. 6. All sediment and erosion control devices shall not be placed in wetlands or waters to the maximum extension practicable. If placement of these devices is unavoidable, they shall be removed and the natural grade restored after the Division of Land Resources has released the project. 7. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit without appropriate modification of this Certification. If this occurs, compensatory mitigation will be required since it is a direct impact from road construction activities. 8. Placement of culverts and other structures in waters, streams, and wetlands shall be placed below the elevation of the streambed to allow low flow passage of water and aquatic life unless it can be shown to DWQ that providing passage would be impractical. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested in writing by DWQ. 9. Compensatory Mitigation: Compensatory mitigation shall be the same as that approved by the US Army Corps of Engineers as long as the mitigation required equals a ratio of 1:1 restoration or creation of lost wetland acres as described in 15A NCAC 2H.0506 (h)(6). The following are the impacts will be incurred: a. Wetland impacts of 2.56 acres of riverine wetlands to be mitigated at a 2:1 ratio (5.12 acres of restoration) at the Long Creek Mitigation Site. b. Total stream impacts of 13,791 linear feet, including 1,727 linear feet of on-site stream relocations. ¦ 12,064 linear feet of stream impacts will be mitigated at a 2:1 ratio through an in lieu payment to WRP for a total of 24,128 linear feet of mitigation. ¦ Due to the failure to provide suitable habitat replacement in the on-site stream relocation, a modification to this original stream mitigation scheme is necessary. NCDWQ understands that 509 linear feet of stream impacts will require mitigation at a 1:1 ratio. NCDOT will purchase an additional 509 linear feet of stream mitigation from WRP. ¦ The remaining 1,218 linear feet of on-site stream relocations shall be designed using natural channel design and performed and maintained according to approved plans before any mitigation credit is given. If this Office determines that the stream restoration or associated riparian area has become unstable, the stream shall be repaired or stabilized using only natural channel design techniques. Additionally, the vegetation in the riparian area shall be maintained and/or replaced according to the approved plans. Rip-rap and other hard structures may only be used if required by the Division of Land Resources or a Delegated 4k Local Program. Additionally, all repair designs must be submitted to and receive written approval from this Office before the repair work is performed. ¦ Since the on-site stream relocations are proposed as compensatory mitigation for project impacts, the restored portions and associated riparian buffer areas shall be preserved in perpetuity through a preservation easement or some other legally binding mechanism or agreement. The above easement or other legally binding mechanism or agreement must be in place before any mitigation credit shall be given. Additionally, physical and biological monitoring plans shall be followed and reports shall be submitted to this Office after the first year for a total of five (5) years. In accordance with 15A NCAC 2R.0500, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). Until plans are received and approved for the stream relocation using natural channel design, wetland or stream fill shall not occur. 10. Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality upon completion of the project. NCDOT is strongly advised to send in photographs upstream and downstream of each culvert to document correct installation. The Applicant shall require its contractors (and/or agents) to comply with all of the terms of this Certification, and shall provide each of its contractors (and/or agents) a copy of this Certification. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: The project as presently proposed calls for replacing a bridge with a culvert. The waters being impacted are classified as WS 11 HQW. The application fails to provide any information regarding the bankfull discharge or cross-sectional area, or stream profile information. Given that the project plans to replace a bridge with a reinforced concrete box culvert, we need the requested information to assist in the determination that the project will not result in a destabilization of the stream. In addition, please assess the.potential for an upstream and downstream cross vane to be constructed at the project site. Also, provide the proposed design specifications for the cross vane installation. If you believe the requested' design changes are problematic, please provide additional information detailing the engineering rationale, and provide an alternative design that provides for stream stability. • The plan will need to incorporate a commitment to the use of sediment and erosion control Best Management Practices as described for High Quality Waters entitled "Design Standards in Sensitive Watersheds" (15A NCAC 04B .0024) throughout design and construction of. the project. • The plan will also need to incorporate a revegetation plan for the entire area located within the construction limits of the project. • Based on the bankfull discharge and cross-section information, NCDOT will need to design the culvert sills such that the elevation of the tops of the high flow sills (outside sills) is equal to the project elevation of the bankfuli discharge. Staff reviewed the information provided and determined that additional information is necessary to establish that the proposed culvert will not result in destabilization of South Hyco Creek. The required additional information is as follows: This Office agrees with your statement that the introduction man-made controls would interfere with the natural equilibrium of this stable stream system. This is why more information and additional measures have been requested by this Office to ensure that the placement of the proposed culvert that restricts the existing floodway will not destabilize the stream. General Water Quality Certification No. 3375 Condition No. 9 states in part: "Design and placement of culverts including open bottom or bottomless arch culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in aggradation, degradation or significant changes in hydrology of wetlands or stream beds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested to do so in writing by DWQ. Additionally, when roadways, causeways or other fill projects are constructed across FEMA- designated floodways or wetlands, openings such as culverts or bridges must be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in aggradation, degradation or significant changes in hydrology of streams or wetlands." The proposed changes to the stream morphology by the addition of the culvert may have a dramatic impact on the stability of the stream, both up and downstream of the proposed impact, by changing the channel's ability to transport its bedload in its current state of equilibrium. Your letter of June 18, 2002 does not include enough information for this Office to determine or predict whether or not the stream's ability to transport its bedload without aggrading or degrading can be achieved with the current culvert design. This is of particular concern in waters classified as WSII HQW (water supply 11, high quality water). As such, you must demonstrate that the proposed culvert will not destabilize the stream and that equilibrium will be maintained. Additionally, based on the cross section drawing provided, it appears that the channel would be widened match the elevation of the proposed outer (higher) sills as opposed to the outer culvert sill elevations being designed to match the "bankfull" elevation of the existing channel. Also, the cross sectional area as well as the width and depth of the opening below the "bankfull" elevation should match that of the existing channel below the bankfull elevation. Finally, the application must include the commitment to use the erosion and sediment control practices and the p.lanting plan requested in our May 10, 2002 correspondence. In any event, I would like to suggest that we schedule a meeting to discuss this matter as similar situations are likely to arise. The aim of this meeting would be to develop specific protocols to address this situation so that we do not have to put these (and similar) projects on hold in the future. The site was planted in 2001 and was designed as wetland mitigation for impacts associated with bridge project B-2608. The mitigation encompasses approximately 2.48 acres of wetland restoration. The restoration effort involved re-vegetating the area that was temporarily impacted due to mechanized land clearing. The area that was impacted by mechanized clearing is being monitored to ensure that it re-attains wetland jurisdictional status. The restoration area was re-vegetated with bottomland hardwood species. No hydrologic monitoring is required for this project; however, vegetation monitoring is required for three years. After the first year of monitoring, the Little River Bridge Site shows, by visual observation, that the planted species in the wetland are surviving and that the impacted area is re-attaining jurisdictional status. NCDOT recommends continuing vegetation monitoring on this site 1.0 INTRODUCTION 1.1 Project Description The Little River Bridge Mitigation Site is located at Bridge No. 4 over Little River and Bridge No. 27 over Little River Overflow and approaches on NC-73 East of Little Mills (Figure 1). The site consists of approximately 2.48 acres of mitigation for wetland impacts associated with project B-2608. 1.2 Purpose In order for a mitigation site to be considered successful, the site must meet vegetation success criteria. This report details the vegetation monitoring in 2003 at the Little River Bridge Mitigation Site. No. 011689 Mr. Eric Alsmeyer: As you are aware, the Department has monitored the Poplar and Marks Creek Bridge Mitigation Sites since construction in August of 2005. Located in Wake County, these two sites are adjacent to the US 64/264 Knightdale bypass (R-2547) at the Poplar Creek and Marks Creek stream crossings. These sites were planted with bottomland hardwood species and monitored to ensure that the wetland and buffer areas where temporary fill was placed have become revegetated. According to permit conditions, NCDOT was required to monitor the Poplar and Marks Creek Bridge Mitigation Sites visually for five years or until the regulatory agencies waive this requirement in writing; hydrologic monitoring was not required for this project. After the growing season, an annual monitoring report was submitted to the appropriate regulatory agencies via the Natural Environment Unit's (NEU) website. After two years of vegetation monitoring, the Poplar and Marks Creek Bridge Mitigation Sites show that the planted vegetation is surviving and the wetland and buffer areas have revegetated. The monitoring data is provided within the annual monitoring reports available on NEU's website for 2005 and 2006. A site visit was held with the resource agencies on April 26, 2007. During the site visit it was determined that both the Poplar and Mark's Creek sites were successful and that no further monitoring would be required. NCDOT requests that the appropriate resource agencies provide documentation stating that no further monitoring is required and that the site is closed. A vicinity map depicting the location of each site is included for reference. Several mitigation ortionc are ourtently_being conside?od_to_offset unaYOidable acts t0- jurisdictional surface waters and wetlands. Potential on-site restoration, creation and enhancement opportunities are being investigated. Additionally, a search for suitable mitigation sites in the Catawba River basin for both surface water and wetland mitigation is currently being conducted. NCDOT has identified several sites containing possible mitigation opportunities. Entry permits have been obtained and feasibility studies are currently underway. In summary, impacts to waters of the United States total 0.78 acres of jurisdictional wetlands and 2,611 linear feet of surface waters due to roadway fill, pipes and culverts. Enclosed is a completed notification form and drawings that depict impacts to waters of the United States. Based on the discussed impacts to waters of the United States, the department requests authorization under a Section 404 Individual Permit to construct the project.
