Land Narrative and Project Description Project for Ralph I Land 303 Greenview Rd Moyock, NC. 27958 Project Location Lot 4 Innsbrook Subdivision 115 Kingsview Ct Merry Hill, NC. 27957 Project to consist of placing a span of approximately thirty-two feet (32'0) of bulkhead existing bulkhead as shown in diagram to allow fill of two thousand and twenty five square feet of wetlands to be graded to be consistent with existing lot grade. All bulkhead material will be consistent with material described and previously determined to proper as per requirements and identical to that that now exist reference permit # 176-05. All fill material will be obtained from off site borrow pit, material will be placed di into fill area and will not require aforementioned material to be stored on the site h described in this permit application. Upon completion fill area will be stabilized as required by permit. Ralph J. Land Lot No. 4, Innsbrook Subdivision Bertie County Project setting The project site is located off SR 1511 at 115 Queensview Ct. (Lot no. 4) within the Innsbrook Subdivision located adjacent the Chowan River in Bertie County near Merry Hill, North Carolina. The site is a.97-acre residential lot owned by Mr. Ralph J. Land. The rectangular lot measures ±161 feet on the River and has a depth of ±260'. Currently a single-family residence outside of any Area of Environmental Concern (AEC) is under construction on lot no. 4. A bulkhead/retaining wall within the Innsbrook Subdivision was authorized by Express CAMA Major Permit No. 176-05 issued on 9 November 2005. Express CAMA Major Permit No. 176-05 also authorized 399 single-family lots, a golf course with clubhouse, access roads and parking areas. The N.C. Division of Water Quality issued Water Quality certification #20051871 on 4 November 2005 and Stormwater Permit SW7050941 on 18 November 2005. The N.C. Land Quality Section approved Sedimentation Erosion Control Plan Berti-2006-012 on 1 May 2006. The U.S. Army Corps of Engineers (USCOE) issued General Permit # 198000291 on 8 November 2005. A wetland delineation was conducted by Hobbs Upchurch &Associates, P.A. for the entire Innsbrook subdivision. The wetland delineation plat was signed by USCOE, Regulatory Specialist, Tracey Wheeler on 21 June 2005. A finger of these wetlands which is separated from the Chowan River by a ±25' wide sand overwash berm extends into what is now Lot no.4. This sand overwash berm acts as a dam to impound water in the wetland area. The bulkhead authorized by CAMA Major Permit # 176-05 was constructed on the landward edge of the wetlands under the jurisdiction of the USCOE. Major Permit # 176-05 did not allow any fill in wetlands to be processed under the Express Permit review so the area was boxed out with the understanding that a permit may be pursued in the future to fill the existing wetland area. The bulkhead creates a trapezoid on Lot no. 4 which measures ±75' deep by ±22' wide at the upper end. The open end of the trapezoid adjacent the River is ±32' wide. Other than the bulkhead and a single-family residence under construction no other man-made features exist on the lot. The lot is vegetated with lawn grasses. The adjacent property on the downstream (east) side is bulkheaded with no other man-made features. In addition to the bulkhead on the upstream (west) side property three old wooden groins extend ±70' into the River. The project site is approximately 18 feet above normal water level. The Chowan River in this area is classified B-NSW by the Environmental Management Commission and is closed to shellfishing. The Chowan River in this area is Coastal fishing waters. The Division of Cultural Resources has identified site BR33 immediately north of the project site. Project description The applicant proposes to bulkhead ±32' of shoreline on the same alignment as the upstream and downstream bulkheads. This alignment will place the bulkhead on average ±1' waterward and a maximum distance of ±2' waterward of NWL. The applicant also proposes to backfill the trapezoid area filling ±2,025 ft' of wetlands under the jurisdiction of the USACOE. Anticipated impacts The construction of the bulkhead and installation of backfill as proposed will result in the filling of approximately 32 ft2 of River bottom. The backfill for the bulkhead will result in the filling of approximately ±2,025 ft2 of wetlands under the jurisdiction of the USACOE. The project will result in localized turbidity as a result of the construction of the bulkhead.
