Oak [D EHNF1 July 9, 1997 Onslow County WQC 401 Project #960650 You have our approval, in accordance with the attached conditions, to fill in 0.01 acres of wetlands or waters for the purpose of bank stabilization at New River Air Station, as you described in your application dated 19 June 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3102. This Certification allows you to use General Permit Number 080 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. The applicant is required to contact the Wilmington Regional Office of the N.C. Division of Coastal Management before the wetland or water impact occurs to determine whether a CAMA Permit is needed for this project. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The first of the two new areas (Area 3), is located in a residential portion of the Air Station. The same high bluff conditions as in areas 1 & 2 are present in this location. The difference is that there is no room to naturally grade back the slopes. Therefore, the improvements include a four-foot high bulkhead in combination with a reinforced 1.5: 1 fill slope which tie into the existing grade. The remaining site (Area 4) is a low profile area located near the Officers Club building. The improvements for this area call for the placement of rock revetment and regrading of the adjacent slopes. The overall grading for this area is minimal. We have included a copy of the General Permit issued by the U.S. Army Corps of Engineers, dated 6/13/97, and a set of the latest construction drawings for this project. This general permit is applicable only along shorelines which are void of wetland vegetation or where construction is accomplished landward of such vegetation. All activities authorized by this general permit that involve the discharge of dredged or fill material in waters of the United States will be consistent with applicable water quality standards, effluent limitations and standards of performance, prohibitions, pre-treatment standards and management practices established pursuant to the Clean Water Act (33 U.S.C. 1344) and applicable State and local law. If the proposed activity involves the discharge of dredged or fill material in waters of the United States, prior to the commencement of any work, the applicant will satisfy the North Carolina Division of Environmental Management (NCDEM) regarding the need for a water Quality Certification pursuant to Section 401 of the Clean Water Act. b. There are two distinct sites which will receive these stabilization measures. The first is located next to the marina area and contains about 880 linear feet. The second is located just south of the marina area and contains about 420 linear feet. The rock revetment should minimize the erosion occurring at the toe of the existing slopes. A geotechnical analysis was performed to determine a side slope which would be naturally stable. This study yielded a 2.5:1 side slope. These slopes will be permanently protected with centipede sod. The construction plans call for silt fence to be located along the entire shoreline being stabilized. In addition, silt fence will be placed daily at the top of the slope where grading operations commence. Please call if you have any questions or require additional information.
