Columbia Street Chapel Hill, NC 27516-2124 Dear Sir. You have our approval to place fill material in 0.60 acres of wetlands or waters for the purpose of developing a recreational facility and road at Northern Community Park in Chapel Hill, as you described in your application dated 27 September 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3022, 2671 and 2733. These certifications allow you to use Nationwide Permit Numbers 12, 26 and 14 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Stormwater management must be conducted as described in your application. A conservation easement or deed restriction shall be added to remaining wetlands to prevent future fill. The road culvert shall be placed below the bed of the stream so as not to prevent aquatic life management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. I rated the wetland at the proposed soccer fields and discussed storm water concerns (see attached letter) during this site visit. To date I have not visited the location of the proposed road crossing, but they adequately addressed this issue in their application. The RRO recommends issuance. Note: the town of Chapel Hill is planing to route storm water from a* near by subdivision through a 400 foot grassed water way at a 1% slope. This water once went through a narrow portion of the wetlands proposed to be impacted by the soccer field. In addition they are also proposing to build three areas that they call constructed wetlands (totaling 0.36 acres). They plan to plant native wetland plants and'route stormwater in these areas as well. They will also manage storm water through detention basins (dry). please call if you have any questions . This v+sit was. at your request in order to provide you (Chapel Hill) information regarding the value of the subject wetlands that are being considered for impact and the respective influences this project may represent to water quality. Sfnce this proposed activity in below current DEM wetland acreage *.hrpsholds no wetland permit application is required by DEM (a 4 l Water Quality Certification is required when 0.33 acres or more of wetlands are being proposed to be filled). Further, the comments offered and the RRO's intention for its use is to provide Chapel Hill assistance in their apparent proactive resourc6 decision making process. Accordingly, the comments offered do not represent a permit, regulatory conditions, or contain an agenda regarding Chapel Hill's policy decision methodology with respect to this wetland fill. General Information: The subject wetlands were rated using the "Guidance for Rating the Values of Wetlands in North Ca.rGline". This ,ranting system 19 a tool for making decisions regarding 401 wdtar Quality Certifications by the Divisipn of Environmental. Man6CJ&Ment. As the the emphasizes this rating system is for guidance and dohs not dictate the Division's 401 (wetland certification) deci8iOns. This rating system is designed to evaluate the vall:eg cif `'"R wetland with respect to the protection vi water-quality. That .is, this system rates the value of the wetland based on "ability" and "opportunity". For example# a disturbed area adjacent to a wetland 3900 Barrett Drive, Suite 101. Rdelgh. The wetland values that are considered include 1) water storage, 2) bank/shoreline stabilization, 3) pollutant removal, A) wildlife habitat, S) aquatic life value, and 6) recreation/educatlon. Site description: Thy P"1"-;-,,.+ :.,et land is a small (approximately 0.25 acral i„termittunt dra=in. it emanates from an adjacent subdivision (Rainbow Ele! g;;ts? y where it is narrow. The wetland continues down slope and broadens somewhat to its confluence with Booker Creek (Class S NSW, Cape Fear River Basin). Wetland water Quality Issues it was noted that this wetland receives stormwater from the up slope subdivision, where stormwater flows through the wstland and is spread out to the a creek bottom of Bookar Crook. This allows for pollutant removal and dissipates the velocity of storm event flow. However, the wetland offers a limited amount water storage. The wetland rating was 52. This represents a moderate score. (Note: FYI - I would consider a score of 25 as low and 70 a high score) Discussion: Does this wetland have value? Yes... However, except for amall ra's zven'ts (though aepecialli important from a water, duality perspective) this wetland has limited "abi l i.tv" for nutrient remova?1 considering that large surface area draining into this small wetland. Therefore it is important to understand that this wetland is not the "best thing around". A possihle consideration: If Chapel Hill chooses to put a sacCrr field in this location stormwater could be diverted into a permanent- (w€?t retention) stormwater pond and then spread or sheet flowed into a maintained grassea water-way between the two soccer fields- xn many respects this may vitimately accomplish at greater protection to surface writer quality than simply avoiding the wetland. (Due to the treatment of stormwater from both soccer fields and the adjacent subdivision). Issuelt : -. During the site visit i discussed several possible a:lternativ0s for positioning of the soccer field. you satisfactorily explained the Iimitations /constrai.nts of the site given the multi-resource demands of the proposed park. Regardless of the final placement of any of the baseball and soccer fields at the Northern Community Park, care should be taken to insure that Rest Management Practices are in place during routine maintenance of these fields. Several small detention ponds were observed in the proposal foot- print of the project. I recommend using permanent wet retention ponds for stormwater. These structures offer significantly greater protection of water quality. In addition, I recommend that these ponds have a velocity dissipater and perhaps a spreader device located at their out fall. This reduce the velocity of water and limits scour. (Although.I have not discussed this project with him, Mr. Warren Faircloth with Orange county planning Department at (919) 732-8181 ext. 2586 may be able to provide valuable assistance with this issue. Also, Mr. Bradley Bennet with DEM`s Central office may also be able to provide additional information regarding stormwater structure design specifications (919) 733-5083 ext. 525.) Biologists with the Wildlife Resources Commission have reviewed the subject document. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq,). County.- Town of Chapel Hill proposes to develop a community park on a 46-acre tract in Orange We have no objections to the proposed project provided the certification is conditioned as follows: 1. A minimum 100-foot forested buffer of native trees and shrubs should be maintained and/or established adjacent to each side of Booker Creek. Maintenance of this buffer aid development of klormwater control structures as proposed in the application should protect water quality in Booker Creek. 2• Place steed restrictions on this property to prevent further impacts to wetlands and miti areas witlihi this tract of land, bation 3. Require any culverts to be installed 12 inches bolow the stream bed to prevent Fragmentation of ? aquatic habitat. 4. Require that the hydrology ofremaining wetlands be rttaintained. Suf7icient stormwater should be routed to remaining wetlands to maintain hydrology, however, energy should be dissipated to prevent erosion o1' wetland areas. Road Crossing: Access to the western third of the site requires crossing wetlands. The private land owner will not grant access over the adjacent property west of the site. Access from the east would require crossing Booker Creek and its substantial floodplain. The wetland proposed to be crossed is primarily alder swamp and/or swamp forest along an unnamed intermittent stream which joins Booker Creek approximately 150 feet below the proposed crossing. Impact Minimization: Proposed road crossing is as perpendicular to the wetlands as site conditions allow. 2. Fill for Soccer Field: The Town of Chapel Hill has identified a strong need within the community for soccer fields and ballfields and believes that it is in the best interest of the community to provide two of each in this park. Construction of the second soccer field will cause the loss of approximately 0.24 acres of headwater forest wetland. This wetland is located between the Rainbow Heights housing project and Booker Creek. It drains approximately 7.4 acres, primarily from Rainbow Heights. The stormwater from Rainbow Heights passes through an existing detention basin above the wetland area. Other locations for the soccer field were considered; the only possible alternative outside of the forested floodplain is the wooded knoll west of Rainbow Heights. This area has the most extensive collection of mature hardwoods on the site as well as scenic rock outcrops. The park plans propose preservation of this area for picnicking and childrens' play in the heart of the park. The proposed arrangement of facilities also separates the two field areas and allows for a more attractive interweaving of play fields and woodland. Proposed Mitigation Measures: The drainage from Rainbow Heights which currently flows through the wetlands to be filled will be rerouted to flow through a 400 foot long grass lined channel with a 1 % slope. The existing watercourse through the wetlands is approximately 280 feet long. Three constructed wetlands totalling 0.36 acres in size are proposed as part of stormwater management measures in this project. These wetlands will be planted with native wetland plants. Stormwater will also be managed by means of dry bottomed detention basins and outlet control at catchbasins. These basins will maintain a post development discharge rate which does not exceed pre-development conditions. Utilities and pedestrian bridge crossings: An 8" water line and a future 4"-8" sewer line are proposed to cross Booker Creek to provide a looped water line through the park and sewer service for the future Wetland Impacts - Northern Community Park, Chapel Hill - Page 2 community center. Construction of these lines and of the pedestrian bridges will temporarily impact a small section of Booker Creek (approximately 40') as well as the edge of a small wetland area west of the creek. The amount of wetland temporarily impacted will not exceed 0.01 acre. Preservation and protection of Booker Creek and its floodplain have been important considerations throughout the park planning process. Park facilities have been kept out of the floodplain as much as possible while providing a balance of active and passive recreational elements. Clearing and grading is kept to a minimum within the floodplain to preserve the natural bottomland hardwood forest. Wetland impacts were carefully considered by Chapel Hill's Town Council, as well as by the park designers, before it was decided, on balance, that the benefits to the Town justified the loss of wetlands caused by construction of the second soccer field.
