E. Impact Justification and Mitigation U
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Using the information gathered during the delineation, road crossings were placed to avoid wetland areas, and to utilize an existing crossing, and
headwalls will be used to minimize stream impacts
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
all work to be done in dry conditions, no staging in jurisdictional areas.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State
2a. Does the project require Compensatory Mitigation for impacts to Waters of the U.S. or Waters of the State?
r Yes r No
2b. If this project DOES NOT require Compensatory Mitigation, explain why:
Channel impacts are below the mitigation threshold.
F. Stormwater Management and Diffuse Flow Plan (required by DWR)
1. Diffuse Flow Plan
1a. Does the project include or is it adjacent to protected riparian buffers identified within one of the NC Riparian Buffer Protection Rules?
r Yes r No
If no, explain why:
Overall impervious surface for this project will be low.
2. Stormwater Management Plan
2a. Is this a NCDOT project subject to compliance with NCDOT's Individual NPDES permit NCS000250?*
r Yes r No
2b. Does this project meet the requirements for low density projects as defined in 15A NCAC 02H .1003(2)?

Riparian Buffer Rules (15A NCAC 2B .0200)? *
r Yes r No
3. Cumulative Impacts (DWR Requirement)
3a. Will this project result in additional development, which could impact nearby downstream water quality?*
r Yes r No
3b. If you answered "no," provide a short narrative description.
all wetland areas and streams will be avoided as this project naves forward. Stormwater will be handled in a fashion to keep sediment out of all
jurisdictional areas.
4. Sewage Disposal (DWR Requirement)
4a. Is sewage disposal required by DWR for this project?*
r Yes r Nor WA
5. Endangered Species and Designated Critical Habitat (Corps Requirement)
5a. Will this project occur in or near an area with federally protected species or habitat?*
r Yes f No

r- Yes r No
5j. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat?
A review of the NCNHP data base was conducted, and a review request submitted to the USFWS Asheville office. The USFWS expressed concern
about dwarf -flowered heartleaf, and noted that if bald eagles were found to be nesting in the area, that appropriate measures were to be taken. A
survey of potentially suitable DFHL habitat facing impact was conducted, and no DFHL was noted. The report was submitted to USFWS

Re: Castle Bridge Dwarf-flowered Heartleaf Survey and Bald Eagle evaluation
Mr. Hamstead:
In your letter dated 13 February 2020, you requested surveys be conducted for the federally
Threatened species, dwarf-flowered heartleaf (Hexastylis naniflora) (DFHL) in areas of
potentially suitable habitat facing potential impact during the appropriate survey season within
the Proposed Castle Bridge development site, located in Caldwell County, North Carolina. Your
letter also addressed the potential for bald eagle (Haliaeetus leucocephalus) nesting.
The site survey work was conducted on 27-28 March 2020 by Ecologist, Jan Gay. Mr. Gay has
more than 28 years of professional experience in natural resource work, and has direct
experience with the both target species, including identification of previously unknown
populations of DFHL which extended the known range of the species by more than 11 miles.
The Castle Bridge site covers approximately 435 acres in Caldwell County. The site has been
subjected to intensive forest practices, which has severely impacted the site. The majority of the
site is currently vegetated with loblolly pine, with scattered areas containing red maple,
American beech, American holly, and mountain laurel.
Dwarf-flowered Heartleaf
Habitat for DFHL is listed as “acidic soils along bluffs and adjacent slopes, in boggy areas next
to streams and creek heads, and along the slopes of nearby hillsides and ravines”
A jurisdictional delineation effort was conducted on this site in 2019. This effort identified 5
stream reaches and several wetland areas within the study area. All wetland areas are being
avoided. Stream impacts area very limited, with 3 crossings deemed necessary to access the
property. Two of the proposed channel crossings are in new locations, and the third crossing
involves the extension of an existing culvert.

Castle Bridge DFHL Survey
Prior to initiation of the survey effort, a reference population was evaluated to determine
flowering status.
All areas of potentially suitable habitat facing potential impact were evaluated. For this site, the
potential for impact is limited to the proposed roadways. The stream channels and adjacent hill
sides were reviewed at each proposed road crossing, as well as upstream and downstream of the
proposed impact site for a distance of 100 feet.
Additionally, surveys were conducted in and around the headwater wetland areas within the site.
Although these areas will not be impacted, the evaluation was conducted.
No individuals of the target species, dwarf-flowered heartleaf, was observed within any areas
reviewed on the property.
Bald Eagle
Bald eagle nesting habitat typically consists of a large tree with limbs strong enough to support
the large nest, in close proximity to open water.
No nest sites have been identified within the study area. No known nest sites have been
identified within 0.5 mile of the study area. If either of these situations change, we will
immediately notify the Service, and proceed accordingly.
Summary
Potentially suitable habitat for the federally Threatened dwarf-flowered heartleaf is very limited
with the study area. A survey in areas of potentially suitable habitat facing potential impact did
not identify any individuals of this species.
No bald eagle nest sites are known to be present within or within 0.5 mile of the study area.
We appreciate your attention to this matter. If you have any questions or comments, or need any
additional information, please contact me at (828) 772-0269.
Sincerely,
Jan Gay, CNRP
