Salisbury Street Suite 105 Raleigh, NC 27604 Wake Forest, NC 27587 Re: Unicon Property (SAW-2017-01572) Request for NWP 39 & GC 4139 Sage Project #2017.42 On behalf of Puryear Investments, LLC & Moffat Properties), please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) and North Carolina Division of Water Resources (NCDWR) that the activities associated with the commercial development may proceed under Nationwide Permit (NWP) 39 (as an alternative to NWP 12) and the associated General Certification (GC) 4139. Project Purpose and Location The project site is located at the existing terminus of Unicon Drive in Wake Forest, Wake County, NC. The requested impacts will result from the installation of a perpendicular sewer utility crossing that will tie into an existing sewerline along the eastern boundary. The overall project site totals 13.24 acres. The project site is located approximately 1,350 feet east of the US-1 and Height Lane intersection and is bound by railroad tracks on the western property line. Project History Sage Ecological Services, Inc. evaluated and delineated the wetlands and streams on the Site in June 2017. Since all streams shown on the USGS and soil survey are considered perennial, and buffered, a site meeting with NC-DWR was not requested. A request for a preliminary jurisdictional determination was submitted to the USACE on June 19, 2017 and a site meeting was held on July 18, 2017 with Mr. James Lastinger (USACE). The approval for impacts resulting from a road crossing was requested from the USACE and NCDWR in 2017. Authorization for the previously proposed impacts under NWP 39 was issued on October 25, 2017, and the associated 401 and buffer certification (DWR #17-1254) were issued on November 2, 2017. The road crossing was completed in 2019. Avoidance and Minimization The proposed sewerline crossing has been designed as a nearly perpendicular crossing in an effort to avoid additional stream and riparian buffer impacts. A request was made to the City of Raleigh (sewer owner) to allow a 10-foot wide maintenance corridor; however, the City required their typical 30-foot wide corridor. The proposed crossing was positioned at a point where wetlands would not be impacted. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. The project construction and clearing will be phased so as to prevent large areas of land disturbance that could contribute to sediment runoff into the streams and wetlands. Silt fencing will be installed to provide additional protection from runoff. The sewerline site will be dewatered during construction in accordance with Best Management Practices. Project Impacts Stream impacts for the project will total 31 LF and will result from a perpendicular sewerline crossing. No wetland impacts are proposed. Riparian buffer impacts that will result from the proposed perpendicular sewerline crossing are 2,032 sq. ft. of Zone 1 buffer impact and 1,220 sq. ft. of Zone 2 buffer impact. Mitigation No mitigation has been proposed because overall permanent stream impacts have been minimized to less than 150 LF and no wetland impacts are proposed.
