Upon completion of all work approved within the 401 Water Quality Certification and Buffer Rules,
and any subsequent modifications, the applicant is required to return this certificate to the
401 /Wetlands Unit, North Carolina Division of Water Quality, 1621 Mail Service Center, Raleigh,
NC, 27699-1621. This form may be returned to DWQ by the applicant, the applicant's authorized
agent, or the project engineer. It is not necessary to send certificates from all of these.

Approval of Final Placement of Rip-Rap In Channel Near Road Crossing
Dear Mr. Thames:
On January 24, 2006, you were issued approval to place fill within or otherwise impact 19 linear feet of perennial
stream, 1,325 square feet (ft') of protected Zone 1 Neuse River basin riparian buffer and 375 square feet (ft) of
protected Zone 2 Neuse River basin riparian buffer and the impacts are covered by General Water Quality
Certification Number(s) 3374 (GC3374). This Certification(s) allows you to use Nationwide Permit(s) NW 12 when
issued by the US Army Corps of Engineers (USACE).
On March 19, 2007, Ian McMillan and Brian Wrenn of the DWQ met with you and others at the site to discuss the
current state of the rip-rap that had been placed in the stream near the road crossing as shown on your approved
plans. The consensus was that the rip-rap height in the stream was too high to allow aquatic life passage during low
flow periods and it was agreed that some of the rip-rap would be removed by hand and photo documentation of the
final volume (and height) of the rip-rap lined channel would be provided to the DWQ.
On April 13, 2007, the DWQ received email correspondence and photo documentation that the rip-rap had been re-
placed so as to allow aquatic life passage. The DWQ approves of the current placement of the rip-rap in the channel
as shown in the photo documentation received on April 13, 2007.
This letter only addresses the final resolution of the rip-rap in the channel as discussed above, and does not approve
any activity within Waters of the United States or Waters of the State. If you have any additional questions or
