Dear Mr. Holderman:
RE: Bridge Replacement # 28 on SR 1301, Surry County
On March 11, 1992, I received an application from you for a
401 Water Quality Certification for your project entitled Bridge
Replacement # 28 on SR 1301 in Surry County. Our existing
regulations (15A NCAC 2H .0501 (a)) require that all applicants
for 401 Certifications submit seven complete copies of 401
Applications. These copies must be supplied by the Division of
Environmental Management to various state and Federal agencies as
specified in the same regulations. Having copies available for
simultaneous review by other agencies will reduce the overall
processing time for your permit application. In the past, we
have not enforced this requirement and have seen processing time
slowed significantly.
Therefore, please send six additional copies of your 401
Certification application so we can initiate the comprehensive
review required by our rules. I am unable to do this copying
since there are numerous applications with this problem and our
regulations state that the applicant must supply these copies.

The North Carolina Department Of Transportation Bridge Maintenance
Unit, proposes the following project for youfissuance of a Section 404
Permit. The project involves a designated mountain county in Western
North Carolina and we believe this project can be accomplished under
General Permit No. SAWC082-N-000-0031.

STREAM: Unnamed, tributary to South Fork Mitchell River
DESCRIPTION: Replace existing bridge # 028 with 1 line of 95" x 67" CMPA

A stringent erosion and sedimentation control program will be implemented

SUBJECT: Proposed replacement of Bridge No. 028 by NCDOT with 1
line 95" X 67" CMPA on SR 1301, Surry County
Dear Mr. Jolly:
The North Carolina Department of Transportation (NCDOT) is
requesting a letter of concurrence from the North Carolina
Wildlife Resources Commission (NCWRC) to obtain a 404 permit from
the U. S. Army Corps of Engineers. The NCWRC has reviewed
information provided by the NCDOT, and professional biologists on
our staff are familiar with habitat values in the project area.
A site visit was not conducted. These comments are provided in
accordance with provisions of the Clean Water Act of 1977 (33
U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661-667d).
Based on the information provided by the applicant and our
information on the range of trout in the project area, this
project will not impact trout waters. Therefore, we do not
object to the project as proposed.

project. If we can be of further assistance, please advise.

Reference is made to your letter of March 5, 1992, requesting Department
of the Army permit authorization for the placement of fill material into an
unnamed tributary of South Fork Mitchell River in association with the
replacement of Bridge No. 028 with metal pipe arch on S.R 1301, north of
Elkin, Surry County, North Carolina. Reference is also made to Mr. Dennis
Stewart's letter of February 27, 1992, in which the North Carolina Wildlife
Resources Commission expressed no objections to the planned road improvements
provided that:
a. No heavy equipment is operated in the live streams in order to
minimize sedimentation and prevent introduction of other pollutants, and
b. Erosion control measures should be implemented where soil is disturbed
and maintained until project completion.
On January 1, 1992, we renewed general permit No. CESAW-C082-N-000-0031
(enclosed) that authorizes the placement of fill material associated with the
construction, repair, or replacement of bridges across navigable waters and
waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT).
Special conditions of this regional general permit state that before
discharging dredged or fill material into waters of the United States
occurring within the twenty-five mountain counties of North Carolina that
contain trout waters, the applicant will obtain a letter of approval from the
North Carolina Wildlife Resource Commission. Review of the information you
have provided, and the comments submitted by the North Carolina Wildlife
Resources Commission, reveals that your proposed bridge replacement can be
authorized by this general permit provided you comply with all permit
conditions and the recommendations set forth by the Wildlife Resources
Commission.

Please read the enclosed permit to prevent an unintentional violation of
Federal law. As this Department of the Army general permit does not relieve
you of the responsibility to obtain any other required approvals, you should
contact appropriate State and local agencies before beginning work.
