Authorization is hereby granted for the construction and operation of an on -site septic system servicing a 3-bedroom residence with a design flow of 360 GPD. The wastewater treatment facility will consist of the following components: ➢ One 1,000 gallon Septic Tank, ➢ One 1,200 gallon pump tank, ➢ Recirculating sand filter with 72 W of surface area, ➢ Recirculation box, ➢ Chlorinator and De -chlorinator, ➢ Contact chamber and ➢ Cascade aerator. All applicable setbacks must also be met and complied with. All cleanouts are to be housed in meter boxes below the surface. This system must be at least 50 feet from the dwelling and property lines and at least 100 feet from water supply wells on and off the site. The system must also be constructed and protected from a 100-year flood. Sandfilters must be lined with a minimum 30-mil polyethylene liner. If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to you, you have the right to submit an individual permit application and letter requesting coverage under an individual permit. Unless such demand is made, this decision shall be final and binding. The Authorization to Construct is issued in accordance with Part III, Paragraph 2 of NPDES Permit No. NCG550000, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NCG550000. Sullins, Director Division of Water Quality By Authority of the Environmental Management Commission NPDES Permits Unit MAR 21 2007 Division of Water Quality 1617 Mail Service Center T Raleigh, North Carolina 27699-1617 d Attention: Toya Fields` — Application for coverage under NCG550000 Regarding: Notice of Intent, Clay County Dear Ms. Toya Fields: We are writing to apply for coverage under General Permit NCG550000: Single Family Domestic Units discharging less than 1000 gallons per day of domestic wastewater. The proposed Onsite Wastewater Disposal System is designed for a 3 bed room house, with a design flow of 360 GPD. Based on the Soils Report by Kirk McEachern, LSS, of SOILS, Inc. the proposed site (Lots 6 and 8 Whitewater Subdivision, Clay County, NC) is unusable for wastewater application via surface drip, subsurface drip, or conventional systems. In Mr. McEachern's opinion the surrounding sites were also unsuitable for wastewater application. Large stone, rock outcrops, mandated setbacks from creeks, and cut slopes greater than 3 feet high leave areas too small for application. This report can be found in Attachment A. The site was deemed unsuitable for a ground absorption sewage system by the Clay County Health Department Environmental Health Division (Attachment B). F. Mason Gardner, Clay County Environmental Health Specialist noted the following reasons in his April 12, 2006 letter: 1. Unsuitable soil topography and/or landscape position (Rule .1940) 2. Unsuitable soil depth (Rule .1943) 3. Insufficient space for septic system and repair area (Rule .1945) 4. Unsuitable for meeting required setbacks (Rule .1950) At this time there are no adjacent properties available for purchase to allow for a soil absorption wastewater disposal system. A letter dated January 11, 2007 from the property owner, Bobby McKown, is provided as Attachment C stating that there are no properties available for sale. In addition, the report from SOILS, Inc. states that the surrounding lots were also unsuitable for soil absorption disposal. The nearest Regional or Municipal Sewer Collection System is the Clay County Wastewater Treatment Plant located in Hayesville, with the closest sewer line ending at the Ridges Golf Course on Mountain Harbor Road, 7.6 miles away, There are no plans to expand the sewer line to the proposed location in Whitewater Subdivision. Using a conservative estimate of $40 per foot of gravity PVC sewer line and $1,800 per manhole every 400 ft, it was calculated that an 17 ARLINGTON STREET • ASHEVILLE, NORTH CAROLINA 28801 • (828) 232-4700 • FAx (828) 232-1331 expansion to the proposed site would cost approximately $1,786,000. The actual cost would be higher because force mains would be required for part of the extension. The proposed wastewater treatment system for Lots 6 and 8 of Whitewater Subdivision consists of a 1,000 gal septic tank (STB-232) and 1,200 gallon pump tank (PT-232) by Cherokee Septic Tanks. A recirculating sand filter designed based on a 5 GPD/ft2 loading rate provides 72 ft2 of surface area for treatment. A 4:1 recirculation ratio box by American Manufacturing is used to rout % of the flow back to the pump tank via gravity flow where it is recirculated through the sand filter. Chlorination and de -chlorination apparatus by American Manufacturing are used for disinfection. The tablet chlorinator consists of a housing and two tablet feed tubes. Slow dissolving JET-CHLOR tablets dissolve at a rate proportional to the flow. A contact chamber provides approximately 100 minutes of detention time after both the chlorination and de - chlorination apparatus. A cascade aerator provides aeration before the effluent discharges to the stream. Systems operating under General Permit NCG550000 are required to provide an effluent with a monthly average BOD less than 30 mg/l, total suspended residue less than 30 mg/l, and fecal coliform less than 200/ 100 ml. Systems are required to have daily maximum values less than 45.0 mg/l BOD, 45.0 mg/1 total suspended residue, and 400/ 100 ml fecal coliform. Recirculating sand filter systems typically produce effluent that meet or exceed these standards having no more than 10 mg/1 cBOD5 and TSS and nitrate levels less than 30 ppm. A check for the permit fee of $50.00 made payable to NCDENR and final plans for the treatment system stamped "Final Design Not released for construction" have been included. Soi I On site Investigation and Landuse Surveys May 20, 2006 305 Creek Road W., Greenwood, S.C. 29646 mceack@emeraldis.com 864.993.4096 Kirk McEachern, NCLSS 1212, GACS5149, SCCSC 56 RE: Soils opinion for Lots 6 and 8, Whitewater Subdivision, Clay County, NC A review of soils on lots 6 and 8 in the Whitewater Subdivision in Clay County for application of wastewater via either conventional or drip irrigation with advanced treatment in an engineered individual wastewater treatment system was performed. The site was visited to observe the soils and site conditions for this assessment. The site, in my opinion, is unuseable for wastewater application via either surface drip, subsurface drip or conventional systems. The reason is primarily due to the mandated setbacks from creeks and cut slopes greater than 3 feet high leave only a 30 foot wide strip of lot 8 and a 25 foot wide strip of lot 6 available for consideration. The square footage left in both instances is insufficient for any kind of system. In addtion, the area availabl'b for consideration on lot 8 has large boulders present and the are on lot 6 has a driveway through the middle of available space and also has rock outcrops and large stone on the surface. The relevant sections of the North Carolina Adminstrative Code are defined in Rules .1901-.1968 Title 15A Subchapter 18A. The specific rules relevant to this site are rules .1945 (a) Avaialble Spce; .1950 (a) (1) and (a) (13) Location of Sanitary Sewage Systems; and rule .1943 (a) Soil Depth. The site fails to meet the minimum criteria. for all these sections and is therefor, in my opinion, not suitable for a septic system whether conventional or alternative. In most cases a solution can be found to most sites which do not meet one or more of the rules. In this case the only solution possible is to find a suitable area outside the mandated setbacks which lacks the rock and boulders and pump the wastewater to that site for treatment and dispersal to the soil. The site would need to be somewhere other than these two lots or the surrounding lots. I did not extensively canvass the surrounding lots but a review of the plat shows that they will have the same concerns as the lots 1 did review. If an off - site area can be found I would be glad to assist with site reciew and permit application. IM ATTACHMENT C " Clay County Health Department Environmental Health Division P.O. MGK.Own, The Clay County Health Department, Environmental Health Division evaluated the above -referenced property at the site designated on the plat/site plan that accompanied your improvement permit application. According to your application. -the site is to serve a 3 bedroom residence with a design wastewater flow of 360 gallons per day. The evaluation was done in. accordance with the laws and rules governing wastewater systems in North Carolina General Statute 130A-333 including related statutes and Title 15A, Subchapter 1.8A, of the North Carolina Administrative Code, Rule. 1900 and related rules. Based on the criteria set out in Title 15A, Subchapter 18A, of the North Carolina Administrative Code, Rules .1940 through .1948, the evaluation indicated that the site is UNSUITABLE for a ground absorption sewage system. Therefore, ,your request for an improvement permit is DENIED. The site is unsuitable based on the following: 1, 'Unsuitable soil topography and/or landscape position (Rule _ 1940) 2. Unsuitable soil depth (Rule ,1943) 3, Insutficient space for septic system and repair area (R.. We .1945) 4. Unsuitable for meeting required setbacks (Rule .1950) These severe soil or site limitations could cause premature system failure, leading to the discharge of untreated sewage on the ground surface, into surface waters, directly to ground water or inside your structure. The site evaluation included consideration of possible site modifications, .and modified innovative or alternative systems. However, the Health Department has determined that none of the above options will overcome the severe conditions on this site. A possible option might be a system designed to dispose of sewage to another area of suitable soil or off -site to additional property. For the reasons set out above, the property is currently classified UNSUITABLE, and no improvement permit shall be issued for this site in accordance with Rule .1948(c). Nor are there any known USGS records of discharge for locations on Mill Creek. In the absence of data that would permit a site -specific, low -flow analysis at your point of interest, low -flow characteristics can be estimated by assessing a range of low - flow yields (expressed as flow per square mile drainage area, or cfsm) that may be considered applicable to your point of interest. No drainage -area information is recorded in our files for your location on Mill Creek. A "quick-n-dirty" basin delineation above your point of interest using mapping software suggests the drainage area is in the range of 0.8 to 1.0 sgmi. The "most recent" low -flow information published for this area is contained in a statewide report completed in the early 1990's. It is USGS Water -Supply Paper 2403, 'Low -flow characteristics of streams in North Carolina" (Giese and Mason, 1993). An online version of the report is available through http://pubs.er.usgs.gov/usgspubs/wsp/wsp2403. The report provides the low -flow characteristics (based on data through 1988) via regional relations and at -site values for sites with drainage basins between 1 and 400 sgmi and not considered or known to be affected by regulation and/or diversions. If you access the report, please note the online report files are provided in the ".DJVU" format and require a particular Lizardtech plug-in, also available through a link displayed on the page. Or you can click an adjacent link that will allow you to view the report as a group of images without the need for a plug-in. A couple pieces of information from this report can be considered: (a) In Table 1 of this report, there are 3 nearby sites for which 7Q10 discharge estimates are provided. Expressing these estimates as 7Q10 low -flow yields (again, flow per square mile of drainage area, or cfsm) provides some indication of the yield range that could potentially be applicable to your location. The 7Q10 low - flow yield range is from about 0.35 to about 0.83 cfsm (average 0.65 cfsm), and this appears to be a wide range. The closest site (located on Shooting Creek) is that which has the lowest yield (about 0.35 cfsm) in the above range. The other two nearby sites with 7Q10 low -flow yields close to 0.8 cfsm are located on the Nantahala River near the Macon/Clay County lines, and use of these yields may result in an over -estimate of the 7Q10 discharge in Mill Creek (b) Use of the regional 7Q10 equation provided in this report for this area (Hydrologic Area 10) produces 7Q10 flow estimates with yields equal to about 0.39 cfsm. Putting together the above pieces of information would suggest that an appropriate 7Q10 yield is in the range of 0.35 to 0.4 cfsm. And in the absence of further data and/or analyses, use of this yield range may be the most appropriate and would be consistent with the yield associated with the nearby site on Shooting Creek. Once you know a more definitive value for the drainage area at your specific location, you can apply the yield range to 2/15/2007 Page 2 of 2 obtain 7Q10 flow estimates. Please be aware that this estimate is based on natural -flow conditions and does not account for the presence of regulation and/or diversions, if any, that may exist in Mill Creek. The proposed system is to be located at 3461 Fires Creek Road in mit Clay County, North Carolina.
