Ross Jr., Secretary Alan W. Klimek, P.E., Director Coleen H. Sullins, Deputy Director Division of Water Quality The subject permit was issued through the Division of Water Quality Fast -Track permitting program. With the Fast -Track process, technical reviews are not conducted prior to permit issuance as the applicant and professional engineer certification on the permit application indicates that the design is in compliance with applicable regulations and minimum design criteria. Upon completion of construction, a final Engineering Certification, drawings/plans and associated calculations (as applicable) are required to be submitted to the Division prior to the operation of the permitted facilities. This notice is to notify you that the subject project has been randomly selected and reviewed as part of the Division's Fast Track Permitting Process Audit. This audit disclosed the following deficiencies in the design, construction, and/or certification of the permitted project: 1. An insufficient number of anti -seepage collars were utilized where the outfall crossed wetlands. The Town of Southern Pines, as the permittee, is responsible for ensuring compliance. Violations of Water Quality Statutes and Regulations can result in the assessment of civil penalties of up to $25,000 per day, per violation. We are also sending a separate letter to the engineer of record for this project. Please inform the Fayetteville Regional Office, in writing, within 20 days of the receipt of this letter regarding the expected submittal date of a permit application and the corrective action that will be taken.
