On 30 October 1995 you wrote to the Division of Environmental Management requesting a
401 Water Quality Certification for your project to fill wetlands for lot fill at Lot 42, North Topsail
Beach in Onslow County. We have been informed by the N.C. Division of Coastal Management that
this project will require a Permit from the N.C. Division of Coastal Management. We carrot continue
to process your application until the Division of Coastal Management (DCM) begins the permitting
process. Therefore I must hereby place this project on indefinite hold until you and the Division of
Coastal Management gather the necessan- information to develop an acceptable DCM permit
application. Also by copy of this letter, I am also notifying the U.S. Army Corps of EngiLeers that
this project will need processing by the Division of Coastal Management.
If you believe that this decision is in error, please call me at 919-733-1786 to discuss the
matter.

The North Carolina Division of Coastal Management has reviewed the above-referenced application for a
?. Nationwide Permit dated October 24, 1995. Your application for the Permit was forwarded to us from
#t other sources, not through the regular review channels. Please excuse the response time on your
application caused by this error. Based upon our review, we have determined that the proposed activity is
located within an Area of Environmental Concern (AEC).
Therefore, before you are elizible to receive a Nationwide Permit from the Army Corps of Engineers, you
must receive a CAMA Permit from the North Carolina Division of Coastal Management for the proposed
activity. The State position on consistency of the proposal with the North Carolina Coastal Management
Program is provided by the Division's CAMA Permit decision.
