Dear Mr. Ward:
Reference is made to your letter of May 29, 1992, requesting Department of
the Army permit authorization for the placement of fill material into South
Buffalo Creek in association with the relocation of US 220 (Freeman Mill Road
and interchange with I-40, TIP # U-60B/8.1491101), Greensboro, Guilford
County, North Carolina. Plans furnished with your letter showed the proposed
project of stream relocations and box culvert constructions will result in
impacts to 3.81 acres of jurisdictional wetlands. Reference is also made to
the meeting of July 14, 1992, where you proposed mitigation for the project
impacts of:
a. planting of the relocated stream banks with native bank vegetation of
River Birch (Betula nigra), Black Willow (Salix nigra), American Sycamore
(Platanus occidentalis), and Tag Alder (Alnus rugo9a).
b. 3:1 debit to the Roanoke River Mitigation Bank.
On January 1, 1992, we renewed general permit No. 198200031 (enclosed)
that authorizes the placement of fill material associated with the
construction, repair, or replacement of bridges across navigable waters and-
waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT).
Review of the information you have provided reveals that your proposed
project can be authorized by this general permit provided you comply.with all
permit conditions and the agreed upon mitigation set forth in the
aforementioned meeting of July 14, 1992.
Please read the enclosed permit to prevent an unintentional violation of
Federal law. As this Department of the Army general permit does not relieve
you of the responsibility to obtain any other required approvals, you should
contact appropriate State and local agencies before beginning work.

SUBJECT: Guilford County, Relocation of US 220 (Freeman Mill
.Road and interchange with I-40 south of Greensboro
(TIP # U-60B, 8.1491101)
The North Carolina-Department of Transportation (NCDOT)
intends to relocate US 220 along a section of Freeman Mill
Road in Greensboro, North Carolina. This-will also involve
the construction of a new interchange between I-40 and the
relocated US 220. This roadway has a long history, and the
permit requirements have been negotiated with your agency
several times through the years.
NCDOT first applied for the required 404 permit and 401
certification March 28, 1978. Both of these permits were
issued in following months, and the 404 permit had an
expiration date of December 31, 1981. This deadline was
extended several times, until 1981 when the project was
dropped due to a lack of funding, and the permit terminated.
NCDOT re-applied for the permits April 27, 1987, and both
were reissued.
Subsequent.to this action, the plans for the proposed
project were revised, and the project divided into two
sections (U-60A and U-60B). On March 15, 1991, NCDOT applied
for, the required permits for U-60A. The Corps of Engineers
authorized this section of the project under General Permit
31 March 27, 1991, and the Division of Environmental
Management authorized the project under General Water Quality
Certification No. 2176 April 25, 1991.
An Equal Opportunity/Affirmative Action Employer
This application covers project U-60B, which includes
the immediate vicinity of the proposed US 220 - I-40
interchange. Construction of this project will involve
unavoidable impacts to streams and wetlands in the area at
four sites. The first site (B-1) involves the relocation of
about 2100 linear feet of South Buffalo Creek (Sheets 2 and
3). One existing 3 barrel 121x 12' box culvert will be
extended and a barrel added, creating a 4 barrel 12'x 12'
culvert under I-40 (Sheet 2). Another 4 barrel 131x 13' box
culvert will be needed in South Buffalo Creek to accommodate
proposed US 220 and interchange ramps (Sheet 3). These
activities will require the placement of fill in 1.5 acres of
wetlands and 0.84 acres of open water.
Site B-2 involves the placement of fill in 1.33 acres of
wetlands on the northwest side of South Buffalo Creek due to
the extent of new fill slopes for the proposed I-40
relocation (Sheets 8-9). Two 3-span prestressed girder
bridges will be used for the crossing of I-40 and South
Buffalo Creek, which will not require any fill in waters of
the United States.
Sites 3 and 4 are both 2 barrel 8'x 7' concrete box
culverts in Piedmont Creek north of the proposed interchange.
Site 3 is on Meadowview Road and will require fill in 0.05
acres of open water. Site 4 is on Freeman Mill Road and will
require fill in 0.03 acres of open water. Ordinarily, both
of these crossing would be authorized under Nationwide 33 CFR
(A)(14).
The proposed project will require the placement of fill
in a total of 2.83 acres of wetlands and 0.92 acres of open
water. It is NCDOT's position that these impacts are
unavoidable and that we have done everything possible to
minimize these impacts. NCDOT anticipates the need to
mitigate for these unavoidable impacts. At the present time,
we do not have a specific mitigation plan to propose.
However, a great deal of preparatory work has been done to
identify a suitable mitigation site for projects in the
Greensboro area.
NCDOT has coordinated with numerous agencies in this
search. During August and September 1991, members of our
Environmental-Unit met with the Greensboro Parks and
Recreation Department to discuss utilization of degraded
wetlands throughout the city for wetland restoration
projects. These plans proved unsuccessful, as the Parks and
Recreation Department decided that these wetlands should be
maintained as mowed greenways. Since that time, NCDOT has
pursued other possibilities. Given the scarcity of extensive

degraded bottomland hardwood sites in Guilford County and the
general unwillingness of property owners to sell their land,
only a few potential mitigation sites have been identified.
NCDOT is continuing to coordinate with private landowners,
developers, non-profit organizations, and public agencies in
an attempt to locate suitable mitigation sites. We have
conducted a field review and solicited early comments from
regulatory agencies for several potential sites. Agencies we
have coordinated with in this regard include the N.C.
Division of Environmental Management, the U.S. Army Corps of
Engineers, the N.C. Wildlife Resources Commission, and the
U.S. Fish and Wildlife Service. To date, the N.C. Division
of Environmental Management is the only regulatory agency
which has provided comments on our field review of potential
mitigation sites. NCDOT intends to use these comments as a
guide to select and proceed with a specific site. We fully
intend to coordinate and develop an acceptable mitigation
plan for this site which will compensate on a 1:1 acreage
basis for the wetland impacts of U-60B and possibly other
area projects. It may also be possible to develop guidelines
to create the relocated stream channel to simulate a natural
stream, community.
NCDOT hereby applies for the required 404 authorization
for this project. By copy of this letter, we are also
requesting issuance of the required 401 Water Quality
Certification from the N.C. Division of Environmental

County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2675 issued January
21, 1992. A copy of the.General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Regional General Permit No. 031. An additional
condition is that DOT must provide wetland mitigation at no
less than a 1:1 ratio as described in DOT's May 29, 1992
submittal..

by General. Water Quality Certification No. 2675 issued January
21, 1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Regional General Permit No. 031. An additional
condition is that DOT must provide wetland mitigation at no
less than a 1:1 ratio as described in DOT's May 29, 1992
submittal.

Reference is made to your letter of May 29, 1992, requesting Department of
the Army permit authorization for the placement of fill material into South
Buffalo Creek in association with the relocation of US 220 (Freeman Mill Road
and interchange with I-40, TIP # U-60B/8.1491101), Greensboro, Guilford
County, North Carolina. Plans furnished with your letter showed the proposed
project of stream relocations and box culvert constructions will result in
impacts to 3.81 acres of jurisdictional wetlands. Reference is also made to
the meeting of July 14, 1992, where you proposed mitigation for the project
impacts of:
a. planting of the relocated stream banks with native bank vegetation of
River Birch (Betula nigra), Black Willow (Salix nigra), American Sycamore
(Platanus occidentalis), and Tag Alder (Alnus rugosa).
b. 3:1 debit to the Roanoke River Mitigation Bank.
On January 1, 1992, we renewed general permit No. 198200031 (enclosed)
that authorizes the placement of fill material associated with the
construction, repair, or replacement of bridges across navigable waters and
waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT).
Review of the information you have provided reveals that your proposed
project can be authorized by this general permit provided you comply with all
permit conditions and the agreed upon mitigation set forth in the
aforementioned meeting of July 14, 1992.
Please read the enclosed permit to prevent an unintentional violation of
Federal law. As this Department of the Army general permit does not relieve
you of the responsibility to obtain any other required approvals, you should

After a site visit on June 18, 1992, the sites were determined
for the relocation that would contribute significantly to wetlands
losses. These were U-60 B-1 and U-60 B-2. A second site visit was
conducted on June 23, 1992 with the assistance of Mr. Randall Turner
and Mr. Gordon Cashin of the NCDOT. There were no survey markers
in place during these inspections and only two (2) survey stakes were
found, both of which were laying on the ground. Due to the intensity
of previous development in the area and the impact of these existing
developed areas, plus the suspected impact of the original I-40 to the
wetlands, it was difficult to assess the areas.
The impact of the B-1 area should be reviewed for additional
stream disruption as the site plan isolates the downstream section of
the creek. This does not seem to be included in the total "fill in
surface waters" tabulation (see attached map). Streamflow will bypass
this old alignment of the stream so that there may be additional losses.
These two areas are obviously important to water quality
concerns especially in the event of a chemical spill situation at B-2,
but were rated with a consciousness of the surrounding land uses. The
value of these areas (especially B-2) for urban wildlife habitat in this
heavy traffic and dense population area may be quite substantial to the
nearby city dweller. Associated with the B-2 area, three (3) potentially
significant and very large oak trees were found that appear to be
Overcup oaks. According to a forestry resource, this may be the outer
range fringe for this species.

Further review of the significance of this find (and scientific
construction. The State and National Champion Overcup Oak Tree is
located in Bertie County. That tree has a circumference of 258" (82"
diam.), and is 156' tall with a crown spread of 120'. The trees at this
site are not believed to be that large.
B-3 and B-4 were not evaluated due to size and location.
The WSRO is not aware of any significant historic or wildlife
sites located on the proposed worksite(s).
WSRO recommends that if these wetlands must be lost that
significant mitigation be forthcoming in the immediate piedmont
community. According to Mr. Henry Moone of the DOT Real Estate
section, mitigation lands are becoming very difficult to find in Guilford
County. The DOT could even consider revitalizing a wet area or
constructing a wet area somewhere along the I-40 corridor. There
may be such an opportunity at the I-40/421 split west of Winston-
Salem in conjunction with ongoing/proposed DOT landscaping
projects. If you have any questions or comments, please do not

SUBJECT: N. C. Department of Transportation (NCDOT) request
for 401 Water Quality Certification, US 220,
Guilford County, North Carolina, TIP No. U-60B,
DEM Project No. 92290.
The N. C. Wildlife Resources Commission (NCWRC) has
reviewed the subject application for 401 Water Quality
Certification, and our comments are provided in accordance
with the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661-667d).
The proposed project involves relocation of an
interchange between US 220 and I-40, involving wetland loss
at four sites within the construction area. The NCDOT has
documented attempts to identify mitigation sites in the
vicinity of the project, with only partial success. The
letter of application (B. J. O'Quinn, May 29, 1992) proposes
cooperative development of a mitigation plan which will
compensate on a 1:1 acreage basis for wetland loss. In a
subsequent coordination meeting (July 14, 1992), it was
agreed that a 3:1 compensation ratio would be acceptable to
the reviewing agencies, although the poor availability of
local mitigation sites could warrant debiting the Company
Swamp mitigation bank for at least part of the anticipated
wetland impact from this project.
The NCWRC supports the NCDOT in pursuing wetland
mitigation at a 3:1 ratio for this and similar projects.
However, we must stress that all possible opportunities for
on-site mitigation should be explored before debiting the
Company Swamp bank. Also, given the distance between the
impacted site and the preservation bank, functional
differences between Coastal and Piedmont forested wetland

ecosystems, and the cumulative loss and increasing rarity of
such habitat in the region, the NCWRC urges the NCDOT to
pursue development of mitigation bank sites within the
Piedmont region. Restoration or preservation of large
contiguous tracts of such habitat would better compensate
for unavoidable wetland losses in North Carolina's major
urban areas and enhance regional wildlife habitat diversity.
The NCWRC offers its enthusiastic cooperation in development
of such mitigation plans.
In light of the NCDOT's proposal to maximize on-site
mitigation and pursue a 3:1 compensation ratio for any
necessary off-site mitigation, the NCWRC offers no objection
to aproval of 401 Water Quality Certification for this
project.
