Reference the 401 Water Quality Certification issued by
the Division of Environmental Management on October 2, 1992
and Nationwide Permit authorization issued by the Corps of
Engineers on October S. 1992. Reference also the August 22,
1994 corresponence from NC-DOT to the Corps concerning delays
of mitigation site plantings. Please see the attached letter
dated June 8, 1994, in which we requested an extension of the.
permit and planting schedule. This letter is contained in
our computer file, but was apparently not distributed due to
an administrative error. Although this does not compensate
for the fact that a permit violation has since occurred, we
hope that this will demonstrate that no negligence was
intended.
As detailed in the August 22, 1994 letter to the Corps'
Regulatory Field Office in Raleigh; we expect to complete the
bottomwood hardwood plantings at the mitigation sites by
March 15, 1995. We hereby request a modification of the
permit to continue work on the mitigation sites in the time
necessary-.

Procedures For the Bridge Over Oak Hollow Lake

The Division of Environmental Management (DEM) has reviewed the draft proposed
construction procedures for the bridge over Oak Hollow Lake. DEM offers the following
comments:
a) The turbidity curtain shall be installed prior to the sheet pile cofferdam. If more
than two widths of curtain are required, then the fabric shall be sewn together.
The turbidity curtain shall not be removed as long as turbidity inside the curtain
exceeds 25 NTU's.
b) The excavated material inside the cofferdam should be disposed of in a pre-
approved upland site. This upland site will require a nationwide permit 16 from
the Corps of Engineers and general certification 2668 from DEM if there is a
discharge from the disposal site.

FLOATING TURBIDITY CURTAIN
The contractor shall install a floating turbidity
curtain to enclose the pier site on all bents on concrete
seals for the bridges at stations 174 + 58.00 -L- and 174 +
08.00 -L-. The curtain is to deter silt suspension and
movement of silt particles into Oak Hollow Lake duri:--

designs for US 311 bridge over Oak Hollow Lake
Forsyth County
As DOT requested on 2 April 1993, DEM Central Office and
Winston-Salem Regional Office have reviewed the plans for two.
different designs for the new bridge over Oak Hollow Lake. I
have delayed sending our comments until after our meeting with
the City of High Point on 18 June 1993 in order to hear their
concerns and get their input. As you know since you were present
at that meeting, the City expressed strong concerns about the
erosion which has entered Oak Hollow Lake from the land clearing
associated with the U.S. 311 Bypass. From our meeting, I believe
that DOT will take measures (with David Foster's help) to
remediate this situation.
We believe that DOT can use the cofferdam construction
method and protect the lake from water quality impacts if the
following measures are taken:
1) A Turbidity curtain should be used around the cofferdams
to reduce sedimentation.
2) No seals should be poured if lake level rises due to a
storm.
3) DOT shall develop a draft written procedure for the
construction of the footings and cofferdams, their pump-out and
any spoil handling including barging and sediment traps on the
barge as well as on land. This procedure shall be circulated by
DOT to DEM , Division of Land Quality (Doug Miller in the
Winston-Salem Office) and the City of High Point in order to get
their input into these operational plans. Comments received from
the state review agencies should be resolved and placed into the
procedure manual. The final specification from the procedures

shall be written into the construction contracts. Any changes
from these specifications shall be sent back through DEM, DLQ and
the City of High Point for a review and approval within two
weeks.
4) In order to alleviate water quality concerns similar to
those which have developed on clearing of the U.S. 311 bypass
alignment, DOT should consider measuring turbidity levels at the
bridge construction site as well as uplake and down-lake during
construction at weekly intervals to-document any changes in
turbidity due to the construction. DEM would be glad to review
any proposed water quality sampling plan.

Review of the U. S. 311 Bypass construction presently being
conducted by the Department of Transportation found the site to
be substantially irx compliance with BMP's in place. Some minor
alterations were suggested in some measures to improve their
effectiveness. one measure of particular concern to the City of
High point representative simply needed to be moved 3 feet so
that a cross drain carrying clean water did not outlet into it;
this move mould make the design adequate.
bin O'Neal has repeatedly expressed concern about the
turbidity in the lake. A better measure of the effectiveness of
the installed measure is settleable solids which High Point is
not checking. I also checked with Ernest Cain of the Water
Supply Branch. Mr. Cain thought algae or a lake "turning over"
could.be contributing to the high oxygen demand which Mr. O'Neal
stated he was experiencing.
We are continuing to monitor this situation. With the
overview this project is getting, I am anticipating good
operation and maintenance of BMPs by DOT.

Review of the proposed construction procedures to limit
tutbidity around the bridge pier construction has been
completed. The procedures seem reasonable though two areas
may need to be addressed. Safety sheeting or similar
catchment is needed for material which might be "stopped"
out of device used to move excavated material to or from the
barge or other haul device. Aiso,'the size-of the sediment
containment bin used during the pumping operation should be
specified for different pumping rates to ensure adequate
settling efficiency. This should not fall to the resident
engineer to decide.

Following our meeting on June 18, I met with Berry Jenkins (Manager, Construction & Mads.
Branch) and Bill Johnson (Head, Roadside Environmental Unit) to share your concerns over the 311 project.
I spoke by phone to Doug Waters (Division Engineer for division 9), and Mr. Jenkins briefed Wayne Bailey
(Chief Engineer for operations). They began an immediate internal review of the sedimentation and erosion
control plan for adequacy and following that review we have scheduled a field meeting at the site to determine
any changes that should be made (I have requested Brian Sullivan attend so that we can get his input and Doug
Miller is coordinating with Brian).
Mr. Waters has requested that all practicable measures be utilized to minimize impacts to the lake.
Mr. Waters also assured me of his concern over the tenor of the past communications and his desire to work
with the city to protect their water supply to maximum extent practicable.
Our department has experienced an ever improving relationship with NCDOT over the past three years.
This relationship has faced tremendous difficulties that have been overcome by our mutual commitment to
continual improvement. I hope that corrections can be made on this project in such a way as to facilitate that
same type of relationship between the City of High Point and NCDOT.

PROPOSED METHOD OF FOUNDATION CONSTRUCTION FOR THE DUAL
BRIDGES OVER OAK HOLLOW LAKE ON US 311 (HIGH POINT BYPASS)
The proposed method of foundation construction consists
of using deep water concrete seals with spread footings. The
seals will be constructed by the use of cofferdams. The
proposed construction process is as follows:
1. A turbidity curtain shall be placed around the
construction site. A steel sheet pile cofferdam
will be driven to the dimensions of the concrete
seal.
2. Material inside the cofferdam shall be excavated to
firm material. Excavated material shall be
deposited in a bin or suitable containment to
facilitate removal from the lake and disposed of by
the contractor or used as fill material if suitable
for such use.
3. Concrete shall be placed in the cofferdam by the use
of tremies to the elevation shown on the ;Mans and
allowed to set for seven days.
4. After allowing the seal concrete to set for seven
days, the cofferdam will be dewatered. Wren pumping
to dewater the cofferdams, the discharge shall be
into an acceptable sediment containment bin to
prevent siltation of the lake.
5. The concrete footing and columns will be built and
then the cofferdam and turbidity curtain removed.
Note: The remaining construction of the bridge will not
disturb the lake bottom.

FLOATING TURBIDITY CURTAIN
The contractor shall install a floating turbidity
curtain to enclose the pier site on all bents on concrete
seals for the bridges at stations 174 + 58.00 -L- and 174 +
98.00 -L-. The curtain is to deter silt suspension and
movement of silt particles into Oak Hollow Lake during
excavation for and pouring of the concrete seals.
The curtain material shall be made of tightly woven
nylon, plastic or other non-deteriorating material. The
material shall have a tensile strength of 350 lbs. in one
direction and 200 lbs. in the other direction. The material
shall not exceed 7 percent open area and the size of openings
shall be equivalent to U.S. Standard Sieve No. 70 (.210 mm).
In the event that more than one width of fabric is required,
a six inch overlap of the material shall also be required.
The curtain material shall be supported by a floatation
material having over 29 lbs./ft. bouyancy. The floating
curtain shall have a 5/16 inch galvanized chain as a ballast,
and dual 5/15 inch galvanized wire ropes with a heavy viny-
coating as load lines.
The floating turbidity curtain shall be maintained in a
satisfactory condition by the contractor until its removal is
requested by the engineer.
The quantity of floating turbidity curtain to be paid
for under this item shall be the actual number of square
yards of curtain installed as specified and accepted.
The quantity of floating turbidity curtain as measured
above will be paid for at the contract unit price per square
yard for "Floating Turbidity Curtain". Such price and
payment will be full compensation for the work as described
in the above paragraphs including but not limited to
furnishing all materials, tools; equipment, and all
incidentals necessary to complete the work.

Thank you for the opportunity to review your proposed permit conditions for the US 311 bridge over Oak
Hollow Lake. I would like to make the following suggestions:
-in item (3), consider deletion of the word "manual". The written procedure should be one to two QV/
pages long and the term "manual" may communicate a different expectation. If amendments to the accepted
procedure are to be reviewed by the city, DEM, and LQ, a time limit should be stated (such as two weeks) to
insure timely comment.
- in order for turbidity testing to be meaningful, it would require a fairly extensive testing of the water
column and cross section of the lake while allowing an adequate mixing zone. In light of the ongoing
monitoring being done by the city this would be redundant, especially since the city is going to give more
credence to their own testing regardless of the DOT results. Since one of our goals is to maintain the ci 's
confidence in the process, I ask that you consider deleting item (4) entirely. d ?s ayee Si S

As DOT requested on 2 April 1993, DEM Central Office and
Winston-Salem Regional Office have reviewed the plans for two
different designs for the new bridge over Oak Hollow Lake. I
have delayed sending our comments until after our meeting with
the City of High Point on 18 June 1993 in order to hear their
concerns and get their input. As you know since you were present
at that meeting, the City expressed strong concerns about the
erosion which has entered Oak Hollow Lake from the land clearing
associated with the U.S. 311 Bypass. From our meeting, I believe
that DOT will take measures (with David Foster's help) to
remediate this situation.
We believe that DOT can use the cofferdam construction
method and protect the lake from water quality impacts if the
following measures are taken:
1) A Turbidity curtain should be used around the cofferdams
to reduce sedimentation.
2) No seals should be poured if lake level rises due to a
storm. 9'
3) DOT shall develop a draft wri ten procedure OU1 for
the construction of the footings and c fferdams, their pump-out
and any spoil handling including bargi g and sediment traps on
the barge as well as on land. This shall be circulated by
DOT to DEM , Division of Land Quality (Doug Miller in the

the state review agencies should be resolved and placed into the

construction. DEM shall approve the exact sampling plan.

Sec4--ion 4,04 Permit authorization for the US 311 Vpuss
( =ich Pont East Eelt) from 'Test of the High Point Reservoir
to the Interchange at US 29/'70 was issued on October 8. 1992.
The Sectio:_ 401 Water X;ual,.ty Certs.f=cation was issued on
October 2, 19'2. Included in this project is a crossing at a
finger of Oak Hollow Lake, which was authorized under
Nationwide Permit No. 25 for structural discharges.
NCDOT is considering two alternative methods of
:construction of the bridge at Oali Hollow Lake. The first
alternative (see drawing, option 1) would involve driving of
cofferdams approximately eight feet below the lake bottom.
The material excavated from the lake bottom would be placed
on a construction barge and transported to a suitable upland
disposal site. Each cofferdam would consist of four metal
sheet piles, which would overlap at the edges. The
overlapping edges would allow some infiltration of-water
until a concrete seal is poured. This would allow some
material to escape through the edges and cause some siltation
of the lake. After each cofferdam is sealed and dewatered,
construction of footings, columns, and caps would proceed.

The second alternative (see drawing, Option 2) under
consideration would involve drilling of a steel shaft into
the lake bottom and penetration of bedrock approximately ten
feet. The bottom material would be trapped in the shaft, as.
there would be no open edges to allow it to escape. Instead,
the material would be removed with an auger, placed on a
construction barge, and transported to 'a suitable upland
disposal site. This method would also involve some siltation
of the lake as the shaft is driven. After all bottom
material is removed from the shaft, the steel casing would
then be filled with concrete to the cap.
Both methods would require construction of approximately

may exceed the cost of the cofferdam method by approximately

Subject: Construction Alternatives for the Bridge at Oak Hollow Lake, Guilford County
A copy of the April 2, 1993 letter for the subject project was sent to WSRO.
Mr. Ron Linville offered the following comments: a) boating would be safer with option
2, b) would like to have DOT perform a cost/benefit analysis on the two options, and
c) which option does the City of High Point want. Although these comments are good,
they do not address issues which we have a charge, namely water quality.
Ms. Cyndi Bell was contacted to see if turbidity screens would reduce turbidity
for option 1. Ms. Bell was informed by personnel within DOT that the turbidity screens
would not be effective for the depth of water at the proposed location(s), however,
DOT was willing to use the turbidity screen as an additional protective measure (this
method was successfully implemented for B-1249). Ms. Bell was also contacted to
see if there would be a "stop construction window" after a storm. This would prevent
the turbidity in the reservoir from exceeding "background levels" and reduce the water
treatment necessary at the water plant. DOT indicated at the May 20th meeting that
elevated turbidity levels would only occur when the seals are poured. No seals could
be poured if the lake level rises, therefore, during a storm event, construction should
stop. DOT has indicated that there would be approximately 2 days of excavation and
3 days to pour the concrete for each bent. Spoil will?ransported to an upland site.
This construction method (option 1 with turbidity screens) should protect the water
quality within the reservoir.
I recommend you contact the City of High Point to assure them that the
cofferdam with sheet piling and turbidity screens would not adversely affect the
reservoir. DOT should be allowed to use option 1 to construct the bridge with the
condition that construction stop if the water level in the reservoir rises, and turbidity
screens be in place at all times.

We have reviewed the alternative methods for the bridge construction
across Oak Hollow Lake and recommend the installation method as
detailed in Option 2 for several reasons.
Although High Point has two drinking water reservoirs, repairs to
High Point City Lake will preclude the use of this reservoir, and
Oak Hollow will become the City's sole drinking water supply. Since
our primary responsibility is to insure a high quality drinking
water, we strongly advocate the use of the safest and least damaging
construction option.
Throughout the Public Hearing and Preconstruction conference of the
311 By-pass, we were continually assured that off-site sedimentation
would be prevented and extreme care exercised during construction of
the project. We have seen evidence to the contrary. Sedimentation
basins appear to be inadequate and off-site sedimentation is
occurring in the lake. There has been a pattern of understating the
environmental impacts due to construction activities. Because of
this, we favor the option which would have the lowest possible risk
to the environment.
Based on.the information provided, we are concerned that the
overlapping sheet piling used in Option 1 could allow for an
excessive amount of concrete loss into the reservoir. Between the
use of a spread footing (as shown in option 1) and the use of a
friction footing (as shown in Option 2), our preference is for the
friction footing so as to minimize the volume of concrete handled in
our reservoir. The lack of elevations dimensioned on the drawing
make it impossible to assess the boating hazards associated with the
changing pier dimensions underwater.
It appears that the erosion control methods as shown on the plans
were sized based on outmoded methods. Instead of using surface area
to define the size of the basins, basins were sized based on storage
area required for sediment. For instance, in the area near the box
culvert at Hillside, the surface area of the basin placed in the
creek was approximately 1/16 of an acre. According to calculations
done by one of the City's registered professional engineers, the
required surface area should have been 2 acres, based on City of
High Point Design Standards. The City of High Point Development

erosion control on the first phase of the 311 Bypass. At
that time I communicated to you that several sediment basins
were undersized. In some locations, controls were not
installed and the creek along Aberdeen was filling up with
sediment. You asked me to identify the basins that were
undersized and fax you the information.
After looking at the plans on file with the City of High
Point, I find I am unable to properly size the sediment
basins because of the inadequate information provided on the
plans. There is no topography on the plans nor were
drainage calculations included. This is the reason you have
not received the information requested.
I have once again inspected several of the sediment basins
and find evidence of all of them being undersized.
Therefore I am sending you excerpts from the City of High
Point Development Ordinance with the requirements for
constructing near a lake or natural water course. Also
enclosed are excerpts from the "North Carolina Erosion and
Sedimentation Control Planning and Design Manual" that
covers practices, standards and specs for temporary sediment
traps (section 6.60); sediment basins (section 6.61); rock
check dams (section 6.63); and design methods from the State
Manual for sediment basin design (section 8.07).

the devices on this project were sized and designed by or under
direct supervision of a registered professional engineer using the
North Carolina Erosion and Sedimentation Control Planning and
Design Manual. There is also a copy of this manual along with a
Field Manual and an Inspector's Guide in my office. The erosion
control plans are also designed with the approval and review of
DEHNR.

Dear Mayor Smothers:
Since our meeting Wednesday afternoon, May 12, on the new
U.S. 311 site I have spoken to Lindy Leonard of the
Department of Environment, Health and Natural Resources,
Land Quality Division, Winston-Salem, NC. Mr. Leonard is
the inspector who will be responsible for any inspections
by the Department of Environment, Health and Natural
Resources on this particular site. I asked him if he had
reviewed, prior to construction, the DOT plans for the
site in question and he said he had not. He has visited
the site once in the early stages of clearing and grading
and felt like the erosion control was in fair shape for a
DOT site.
I did some digging in the communications file between my
department and the Department of Environment, Health and
Natural Resources and found a letter from them concerning
procedures for construction activities requiring coverage
under Federal NPDES Permit System. The comment was
regarding placement of erosion control measures in
streams and lakes. I will quote from it. "Avoid the
approval of in-stream devices and existing lakes as
sediment basins. This has been our policy in the past
and is now included in federal regulations. In the event
a project has no reasonable alternative to such devices
you will need to alert the Division of Environmental
Management (D.E.M.) Regional Supervisor. DEM will
determine if special conditions will apply to the permit
requirements."
The box culvert below the intersection of Marywood,
Rolling Road and Hillside is one situation I feel DOT has
no alternate solution.
Several other places on the site where erosion control
measures were placed in the stream had obvious
alternatives and the placement of these measures in the
stream was not necessary.
Therefore, I believe the State maybe breaking NPDES storm
water discharge regulations.
