Coverage (CoC) NCG500188 under General Permit NCG500000. It is issued pursuant to the requirements
of North Carolina General Statue 143-215.1 and the Memorandf Agreement between North Carolina
um o
and the US Environmental Protection agency dated October 15, 2007 [or as subsequently amended].
If any parts, measurement frequencies or sampling requirements contained in this General Permit
are unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.
Contact the Asheville Re Tonal Office Prior to any sale or transfer of the permitted facility.
Regional Office staff will assist you in documenting the transfer of this CoC
This permit does not affect the legal requirements to obtain any other State, Federal, or Local
governmental permit that may be required. If you have any questions concerning the requirements of the

Subject: Review of Progress Energy's "Walters Hydroelectric Plant, Federal Energy Regulatory Commission
Project No. 432, 2007 Water Quality and Biotic Indices Studies, Appendix A Requirements"
Environmental Sciences Section staff have reviewed the subject document which was received on October 27, 2009. Eric
Fleek, Debra Owen, and Bryn H. Tracy reviewed the sections on benthic invertebrate community, water quality, and fish
community, respectively. In our opinion, the document fulfills the license obligations for conducting the triennial biological
and chemical monitoring of the Pigeon River and Walters Lake following NCDENR-approved methods. Our comments
and observations regarding our review of the 2007 data are listed in the order in which they were presented in the report
and are not necessarily in order of priority:
Comments and Observations
1. In the future, please send one additional copy of the triennial monitoring report to Mr. Roger Edwards, Surface
Water Protection Supervisor, DWQ Asheville Regional Office, 2090 US Highway 70, Swannanoa, NC 28778.
2. Walters Lake was last sampled by DWQ in 2002. Water quality conditions documented by DWQ during the 2002
drought were similar to those reported by Progress Energy during the 2007 drought. In Walters Lake, elevated
nutrient concentrations, observed in July and August 2007, were similar to those observed by DWQ, indicating
that this reservoir is nutrient enriched, capable of supporting periodic nuisance bluegreen algal blooms, and
further study of the causes and frequency of these blooms is warranted. It was noted that 2 of the 12 chlorophyll
a samples exceeded the state water quality standard (40 pg/L).
3. Please provide us with the time of day water quality and chemistry samples and data are collected to aid in our
interpretation of the results.
4. On page 9 of the report, it was noted that: "The use of a U.S. Standard Sieve Size No. 50, a white enamel pan,
and a winnowing technique were substitutes for the NCDWQ method prescribing the use of a plastic basin, PVC
cylinders, and Nitex® bag." On November 24, 2009, Eric Reek spoke to Rick Smith with Progress Energy
regarding these collection methods for benthic macroinvertebrates and it was determined that Progress Energy
does in fact use a Nitex® bag. This correction in the sampling method should be included in future reports.
5. Although Progress Energy benthic macroinvertebrates data seems to be extremely comparable with DWQ data at
Station PR 0, there seems to be some slight difference in EPT taxa (EPT S) and Total Taxa (S) at Station PR 1
between the Progress Energy and DWQ collections (Table 1).

This slight discrepancy may be accounting for 2 of the 3 consecutive Fair bioclassifications (September 2001 and
July 2007) produced by Progress Energy (the post -hurricane November 2004 Progress Energy sample was not
included in this discussion) vs. the three consecutive Good -Fair bioclassifications (July 1997, September 2002,
and July 2006) collected by DWQ. To ensure that sampling techniques continue to be comparable between
Progress Energy and DWQ, a series of overlap samples (particularly at Station PR1) may be needed. Eric Fleek
contacted Rick Smith on December 3, 2009 and overlap sampling will occur tentatively in August 2010.
6. It was noted that the biological ratings at Station PR1 (the Pigeon River at Hepco Bridge at SR 1338) have been
Fair or Poor since 2001. At Station PR 2 (the Pigeon River at Harmon Den) the biological ratings have ranged
from Good -Fair to Fair for the benthic macroinvertebrate community and from Poor -Fair to Fair for the fish
community since 2001.
7. Guidance for electronic submission of the water quality and chemistry data and the benthic macroinvertebrate and
fish community rating data may be found at: http://h2o.enr.state.nc.us/tmdl/General_303d.htm. Electronically
submitted data will be considered in assessing the health of the waters in the Pigeon River basin and is relevant
in the development of the French Broad River Basinwide Water Quality Plan.

The Walters Plant has a single discharge point (001). The wastewaters consist of turbin guide cooling water
and powerhouse sumps. The wastewaters are collected in a sump equiped with oil monitor, level alarms,
pump controls and sump pump. The discharge point is between turbines #1 and #2. This system appears to
be working well and is regularly Inspected and cleaned.
The Plant has excellent monitoring records. Monitoring is done quarterly and no violations were noted in the
records reviewed.
The Plant appears to have an excellent maintenance staff and is very clean.

Comment: The permit expires in a little over 6 months. Ms. Robin Bryson is preparing
the permit renewal for this and the other 3 Progress Energy sites. Remember this
renewal information is to be submitted 180 days prior to expiration (07/31/2007). I
instructed Ms. Bryson to enter the flow as an average instantatous flow during operation
in units of DFS on the renewal. We also discussed that there was no need to submit
maps with the renewal application.

The facility listed above is covered under NPDES General Permit NCG500000. NCG500000 expires
on July 31, 2007. Federal (40 CFR 122.41) and North Carolina (15A NCAC 2H.0105(e)) regulations require
that permit renewal applications must be filed at least 180 days prior to expiration of the current permit. If
you have already mailed a renewal request, you may disregard this notice.
To satisfy this requirement, the Division must receive a renewal request postmarked no later than February 1 2007. Failure to request renewal by this date may result in a civil penalty assessment. Larger
penalties may be assessed depending upon the delinquency of the request. This renewal notice is being sent
well in advance of the due date so that you have adequate time to prepare your application.
If any discharge previously covered under NCG500000 will occur after July 31, 2007, the
CoC must be renewed. Discharge of wastewater without a valid permit would violate North Carolina
General Statute 143-215.1; unpermitted discharges of wastewater may be assessed civil penalties of up to
$25,000 per day.

Dear Mr. Whisnant:
On February 24, 2006, our office received your letter dated February 23, 2006, reporting that the
quarterly monitoring of discharges for pH had not been performed at the Walters Hydroelectric Plant as
required in Part I, Section A(3) of the General Permit NCG500000 that became effective on August 1,
2002. It was also stated in your letter that while some pH data existed, it was collected from in -stream
monitoring points instead of the normal sample point and only performed on a semi-annual basis. As
you are aware, both the frequency and the location of the existing pH data is in direct violation of the
General Permit. Based on this information, the Division of Water Quality issues this Notice of
Deficiency for noncompliance with the General Permit.
Since your letter details the identification of this deficiency and offers corrective actions that
have already been taken to comply with the permit, we are not requesting a Plan of Action at this time.
Please insure that these measures are followed and that all permit requirements are met to avoid any
future deficiencies.

on July 31, 2002. Division of Water Quality (DWQ) staff is in the process of rewriting this permit with a
scheduled reissue in the summer of 2002. Once the permit is reissued, your facility would be eligible for continued
coverage under the reissued permit. mued
In order to assure your continued coverage under the general permit, you must apply to the DWQ for renewal of
your permit coverage. To make this renewal process easier, we are informing you in advance that your permit
coverage will be expiring. Enclosed you will find a general permit coverage renewal application form. This
will serve as your application for renewal of your permit coverage. The application must be completed and
returned with the required information by February 01, 2002 in order to assure continued coverage under the
general permit. There is no renewal fee associated with this process. Your facility will be invoiced for the annual
permit fee at a later date.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of wastewater from your facility
without coverage under a valid wastewater NPDES permit would constitute a violation of NCGS 143-2 5.1 and
could result in assessments of civil penalties of up to $10,000 per day.
If the subject wastewater discharge to waters of the state has been terminated, please complete the enclosed
rescission request form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.
