Dear Mr. Herndon:
Reference your email dated September 27, 2005, notifying us of your intentions
of repairing existing highways damaged by,Hurricane Ophelia. These emergency repairs
are to be completed within the existing footprint of roadways listed on the attached
summary and will have only minimal impacts on wetlands located adjacent to the
proposed repair sites. This summary also lists those projects that do not require a DA
permit for the proposed storm repairs.
For the purposes of the Corps of Engineers Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on
November 22, 1991, lists nationwide permits. Authorization pursuant to Section 10
of the River and Harbors Act of 1899 and Section 404 of the Clean Water Act, was
provided by Nationwide Permit 3 for the repair, rehabilitation, or replacement of any
previously authorized, currently serviceable structure or fill; or of any currently
se. iceable structure or 1:11 constructed prior to the requirement for authorization,
provided that the structure or fill is not to be put to uses differing from those uses
specified or contemplated for it in the original permit or the most recently authorized
modification.
Your work is authorized by this nationwide permit (enclosure) provided it is
accomplished in strict accordance with the enclosed conditions. This nationwide permit
does not relieve you of the responsibility to obtain any required State or local approval.
This verification will be valid until March 18, 2007 unless the nationwide authorization
is modified, reissued or revoked.
