Subject: Permit modification request for Kitty Hawk Beach Nourishment Project, Dare County.
Permit Action Id. # 20031051.3/Kitty Hawk Beach Nourishment
The North Carolina, Department of. Transportation received an Individual permit from the Corp of
Engineers and a permit from the Division of Coastal Management for the nourishment of beach above and
Io the High Water Mark. The nourishment is for the purpose of preventing storm damage to NC l2
a1 6%a 1300 feet area. in Kitty Hawk. The area of concern is between. Kitty Hawk Rd. and Historic Street in
the wn of Kitty Hawk, The COE permit for the project has a condition that specifically defines approved
locations where sand may be taken from cornmerci.al. pits and used. ib the beach nourishment project. Since
the issuance of the permit an additional. sand source has been tested 6d reviewed by the USFWS for
compatibility with the native beach sand in the Kitty Hawk project area. This sand source was tested using
the same requirements and methods used on the previously tested siies. It was determined. that the sand
source did have suitable material for. beach nourishment. A letter from the USF WS is included with this
request that details the locations within the borrow site that has suitable material for the beach nourishment
project. NCDOT is requesting the COE pemit condition be modified to include this borrow site as a
potential sand source for the beach nourishment project.

This letter is in response to Mr. Gregory Smith's letter of November. 19, 2004 whi.ola provided.
th.e U.S. Fish and Wildh.fe Service (Service) with the gradation analysis results of soil. samples
taken at the Barnhill Construction Company's McPherson Pit located in Currituck County, North.
Carolina. These comments are provided in accordance with section 7 of the Endangered Species
Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543).
The North Caroli.ta.a Department of Transportation (NCDOT) has previously Teceived a
Department of the Army Section 404 permit (200310613) to discharge fill material. into the
Atlantic Ocean for the nourishrnent of approximately 1300 linear feet of beach to assist in the
protection of NC 12 from. storm damage at Kitty Hawk in Dare County. As a special. condition
of. that permit, certain. conservation measures were required to protect nesting sea turtles. Special.
Condition 8(b) required "high quality, beach-compatible sand_ that is similar to that already
existing at the beach site in, both coloration and grain sire distribution,." In. addition, the
deposited material must contain no "greater than 10 percent fines (i.e. silt and clay; passing the
##200 sieve) and sh.al.l not contain, on, average, greater than 5 percent coarse gravel or

analysis results on three other sand. mining pits (in a July 15, 2003 letter to the U.S. Army Corps
of Engineers). NCDOT is now requesting ari evaluation of a fourth, site.
The native sediments at the NC 12 Kitty Hawk beach were previously sampled in 18 locations
throughout the project area. These sediments are tan to gray, mcdi.um to coarse grained sands
which averaged 20% coarse material (greater than 2 m..m in size) and 0% fines (less than 1/16
mm in. size). The Barnhill - McPherson site was sampled in. three locations on October 26, 2004,
Upon evaluation of the results, the Service finds that location MMP-1 is compatible (with regard
to sea, turtle nesting substrate) from a depth of 4 - 25.5 feet. The depth range of0 - 4 feet
contains excessive fines. Location MMP-2 is compatible from 8 - 24 feet. The depth range of 0
- 4 feet contains excessive fines, the d.epih range of4 - 8 feet.contai,ns an average particle size
too dissimilar to the native sediments at the NC 12Kitty Hawk beach and the depth range of 24-
25.5 feet contains an incompatible gray/dark gray color. Location MMP-3 is compatible from. a
depth of 4 - 22 feet. The depth range of 0 - 4 feet contains excessive fines.

The above findings translate into compatible sand. being located (with reference to Figure 2 in
the submitted information):
1. from. 4 - 25.5 feet on the western portion of the proposed. excavation area located
between the two ponds
2. &oni 4 - 22 feet on the eastern portion of the proposed excavation area located between
the two ponds
3. ffrom 8 - 24 feet within the eastern pond
