Wiggins Bridge Maintenance Superintendent Post Office Box 289 Siler City, North Carolina 27344 Dear Mr. Wiggins: i iL;?,ADS G,'GUP 06LITY 4616 ., (Road Crossing) and Access and Dewatering) Reference your application of January 4, 1993, for Department of the Army authorization to discharge fill material into 0.7 acre of wetlands adjacent and below the headwaters of Terrells Creek for the purpose of constructing a minor road crossing and temporary access fill and cofferdams. Specifically, the worksite is located at Bridge No. 92 on S.R. 1520, approximately 7-8 miles north of Pittsboro, Chatham County, North Carolina. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and .mot -2- e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists NWPs. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for temporary structures and discharges, including cofferdams, necessary for construction activities or access fills or dewatering of construction sites; provided the associated permanent activity was previously authorized by the Corps of Engineers of the U.S. Coast Guard, or for bridge construction activities not subject to Federal regulation. Your proposed activities are authorized by these NWPs provided they are accomplished in strict accordance with the enclosed conditions. These NWPs do not relieve you of the responsibility to obtain any required State or local approval, including a Section 401 Water Quality Certification. This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Department of Transportation (NCDOT) request for 401 Water Quality Certification, Bridge work on SR 1520 over Terrells Creek, Chatham County, North Carolina, DEM Project No. 92760. The N. C. Wildlife Resources Commission (NCWRC) has reviewed the subject application for 401 Water Quality Certification, and our comments are provided in accordance with the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed project involves bridge replacement on new location, with .04 acres of wetland loss associated with placement of bridge supports and construction easements. The NCWRC supports the NCDOT in its use of a spanning structure, since permanent loss of aquatic habitat will be minimized. However, erosion and sedimentation from construction may affect downstream habitat, particularly that of the endangered Cape Fear shiner. Stringent erosion control measures should be implemented and maintained during and after construction. Prior to instream work, the project engineer should contact John Alderman, NCWRC endangered species biologist, at (919) 542-5331, so that the site may be inspected during construction. Impervious surfaces of abandoned roadway should be removed and revegetated as part of this project. The NCWRC offers no objection to approval of 401 Water Quality Certification for this project, provided the recommendations above are included as conditions of the certification.
