The DWQ has determined that the application will require additional information to meet the requirements of the Neuse Buffer Rule (15A NCAC .0233). Please provide the following information so that a Buffer Authorization may be issued: You have provided engineered stormwater management facilities as an alternative to the diffuse flow provisions of the Neuse Buffer Rule. However, there is a discrepancy between the construction plans (which indicate the use of wet detention ponds) and the worksheets and calculations (which indicate the use of extended detention wetlands). In order to meet the nitrogen removal requirements of the Neuse Buffer Rule when level spreaders are not an option, DWQ requires the use of either extended detention wetlands or bioretention areas. Please submit revised plans and calculations that indicate the use of either extended detention wetlands or bioretention areas that have been designed in accordance with the 1999 DWQ Stormwater Best Management Practice Manual. DWQ also allows the use of wet detention ponds that direct all discharge to a level spreader adjacent to protected buffer areas. If the project were able to obtain local approval for a level .spreader, the wet detention ponds combined with level spreaders would be an allowable option to DWQ to meet Neuse Buffer Rule requirements. 2. A planting plan for the stormwater management practices with plant species and densities must be provided. 3. A site specific, signed and notarized operation and maintenance agreement must be provided. 4. The drainage areas for each of the stormwater management facilities appear to be incorrect. Please provide assurance that all drainage from the site is being treated by an appropriate stormwater management practice before being discharged through the protected buffer. Please be aware that future phases of this project that require a 401 Certification for impacts to streams, wetlands or open waters will require one of the following stormwater management practices to meet nutrient control requirements: extended detention wetlands, bioretention areas or wet detention ponds with forested filter strips. Please respond within three (3) weeks of the date of this letter by sending three (3) copies of your revised subdivision plans to me. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the impacts to protected buffers application review and does not authorize any impacts to wetlands or waters of the state. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
