Reference your letter, with enclosures, of July 14, 1992, regarding your
plans to place fill materials in approximately 0.5 acre of wetlands of Dog
Branch associated with widening S.R. 1142, between S.R. 1169 and S.R. 1182,
west of Williamston, Martin County, North Carolina, State Project No.
8.7309003, Federal-Aid Project No. HESO-1142(5), T.I.P. Z.D. No. W-2715.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for activities
undertaken, assisted, authorized, regulated, funded or financed, in whole or
in part, by another Federal agency or department where that agency or
department has determined, pursuant to the CEQ Regulation for the Implementing
the Procedural Provisions of the National Environmental Policy Act, that the
activity, work or discharge is categorically excluded from environmental
documentation because it is included within a category of actions which
neither individually nor cumulatively have a significant effect on the human
environment, and the Office of the Chief of Engineers has been furnished
notice of the agency's or department's application for the categorical
exclusion and concurs with that determination.
Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions and provided you receive a Section 401
water quality certification from the N.C. Division of Environmental Management
and, in the coastal area, a consistency determination from the N.C. Division
of Coastal Management. You should contact Mr. John Dorney, telephone (919)
733-1786, regarding water quality certification, and Mr. Steve Benton,
telephone (919) 733-2293, regarding consistency determination. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.

This verification will be valid for 2 years from the date of this letter
unless the NWP authorization is modified, reissued, or revoked. Also, this
verification will remain valid for the 2 years if, during that period, the NWP
authorization is reissued without modification or the activity complies with
any subsequent modification of the NWP authorization. If during the 2 years,
the NWP authorization expires or is suspended or revoked, or is modified, such
that the activity would no longer comply with the terms and conditions of the
NWP, activities which have commenced (i.e., are under construction) or are
under contract to commence in reliance upon the NWP will remain authorized
provided the activity is completed within 12 months of the date of the NWP's
expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend, or revoke the
authorization.

Attached for your information is a copy of the project planning report for
the subject project. The project is being processed by the Federal Highway
Administration as a "Categorical Exclusion" in accordance with
23 CFR 771.115(b). Therefore, we do not anticipate requesting an
individual permit but propose to proceed under a Nationwide Permit in
accordance with 33 CFR 330 Appendix A (B-23) issued November 22, 1991, by
the Corps of Engineers. The provisions of Section 330.4 and Appendix A (C)
of these regulations will be followed in the construction of the project.
We do not anticipate that a permit will be required from the North Carolina
Department of Environment, Health and Natural Resources for this project.

SR 1142 is to be widened o thirty-seven (37) feet which will provide a
continuous left turn Iane?from SR 1169 to SR 1182, a distance of 0.57 +
mile. The proposed widening will provide one eleven (11) foot thru lane
for each direction of travel and an eleven (11) foot continuous left turn
lane for left turns in both directions. The thirty-seven (37) foot cross
section will also include two-foot paved shoulders.
PURPOSE AND NEED:
The lack of a left turn lane coupled with the high density development
with numerous driveways halve resulted in left turn and ran off road type
accidents.
Estimated costs are as follows:
Construction $190,000
Right-of-Way 60,000
Preliminary Engineering 19,000
Total $269,000
This project is being processed as a categorical exclusion (CE) under:
23 CFR 771.117(c)(8) or
23 CFR 771.117(d)(2) X

Environmental Effects
The proposed project consists of a symmetrical addition of an
eleven foot wide left turn lane. The project limits are from SR 1169
to SR 1182, a distance of 0.57 miles. Impacts will remain within the
existing right-of-way. The right-of-way limit is 60 feet.
A site visit was made on January 30, 1992. The study area is
disturbed. Installation of sewer and water lines impact both sides of
the road and extend the entire project length except for 200 feet
located at the southern end of the project. Impacts from installation
of the sewer and water lines extend beyond the proposed impacts of this
project. The 200 foot portion of the study area outside the utility
line installation is maintained grassy road shoulders and lawns.
Protected Species
As of December 10, 1991, the USFWS does not list any federally
protected species in Martin County. According to the NCNHP files, no
records of federal or state protected species are located in the study
area. No impacts to federally protected species will occur from
project construction.
Water Resources
Storm water ditches parallel the majority of both sides of the
road. In three locations, ditches cross the study area. One is a
tributary of Dog Branch. Water quality of Dog Branch is classified as
C by the Division of Environmental Management (DEM). Best usage of
class C waters include aquatic life propagation and survival, fishing,
wildlife, secondary recreation and agriculture.
No High Quality Waters (HQW) are located within one mile of the
project. No impacts to Outstanding Resource Waters (ORW), waters
classified as WS-I or WS-II will occur.
Wetlands
Wetland impacts associated with the three ditch crossings are less
than 0.5 acre of total impact. The study area supports hydric soils,
hydrophytic vegetation and wetland hydrology adjacent to the ditches.
Wetland impacts are likely to fall under a Nationwide Permit 33 CFR
330.5 (a) (14), the road crossing permit.
Noise and Air
The project is located with the Northern Coastal Plain Air Quality
Control Region. The ambient air quality for Martin County has been
determined to be in compliance with the National Ambient Air Quality.
Standards. Since this project is located in an area where the State
Implementation Plan (SIP) does not contain transportation control
measures, the conformity procedures of Title 23, Code of Federal
Regulations (CFR), Part 770 do not apply to this project.

The project will not substantially increase traffic volumes.
Therefore, its impact on noise levels and air quality will be
insignificant. Noise levels could increase during construction but
will be temporary. If vegetation is disposed of by burning, all
burning shall be done in accordance with applicable local laws and
regulations of the North Carolina SIP for air quality in compliance
with 15 NCAC 2D.0520. This evaluation completes the assessment
requirements of 23 CFR 770 (air quality) and 23 CFR 772 (highway
traffic noise) and no additional reports are required.
Historical/Architectural Resources
The area of potential effect (APE) was surveyed by DOT staff.
One property over fifty years old was identified, a one story,
single pile frame house with rear ell. The house has been altered
substantially. Synthetic siding has been added, the front entrance
has been altered, the front porch decking has been replaced with
concrete, the porch roofline has been altered, and porch posts have
been replaced.
Because of its extensive alterations, the house is not
considered a distinctive representative of its type and is
therefore ineligible for the National Register. The State Historic
Preservation Officer concurs with this finding (see attached
letter).
Since there are no properties either listed in or eligible for
the National Register in the APE, no further compliance with
Section 106 is required.
General Construction Comments
Project construction may cause potential impacts to tributary
drainages such as siltation and sedimentation. Stringent erosion
controls should be enforced. Best Management Practices and
Sediment Control guidelines should be implemented during
construction.

Thank you for your letter of May 12, 1992, concerning the above project
We have reviewed the Categorical Exclusion for the above project. We
concur that the one house over fifty years of age in the area of potential
effect is not eligible for listing in the National Register of Historic Places
since the structure has undergone numerous alterations. We also concur
that no National Register-listed properties are in the 'area of potential effect.
The above comments are made pursuant to Section 106 of the National
Historic Preservation Act of 1966 and the Advisory Council on Historic
Preservation's Regulations for Compliance with Section 106, codified at 36
CFR Part 800.

For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for activities
undertaken, assisted, authorized, regulated, funded or financed, in whole or
in part, by another Federal agency or department where that agency or
department has determined, pursuant to the CEQ Regulation for the Implementing
the Procedural Provisions of the National Environmental Policy Act, that the
activity, work or discharge is categorically excluded from environmental
documentation because it is included within a category of actions which
neither individually nor cumulatively have a significant effect on the human
environment, and the Office of the Chief of Engineers has been furnished
notice of the agency's or department's application for the categorical
exclusion and concurs with that determination.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.

This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.
