Attached please find updated permit drawings (sheets 1-4 have changed) that incorporate Friendship Station (Phases 1-
4) into the PCN for Little Beaver Creek Sewer, as you have requested. Also included is the wetland impact table from the
PCN (with a supplemental sheet attached). With combining Phases 1-4, the overall wetland disturbance increased to
.435; however, the total forested wetland impact resulting from clearing remains the same at 0.203 acre. An additional
0.027 acre of permanent wetland disturbance from road grading is being added to the 0.203 for a total mitigation
requirement of 0.23 acre. The mitigation SOA will be updated to account for the 0.23 acre of mitigatable impact.
I've attached photos that show the areas where the additional impacts occur (Impact #3 and #10)
We are asking that USACE and NCDWR resume the review of the Section 404/401 application for this project.
We have received the buffer permit from the Town of Apex and it is attached here.

Thank you for the additional information and I apologize for my delayed response. I checked with the project managers
and the decision is consistent with pervious decisions in our office.
Based on my understanding of the information provided the proposed activities are for a connection to a future
development. Although the proposed project will serve more than just the initial development it will ultimately need to
be permitted in conjunction with the initial project that it is designed to serve.

Mr. Phillips,
Just wanted to circle back and see if you have made a final decision regarding moving forward with this sewer PCN. We
would certainly like to permit it as a stand alone because although Friendship Station may have future impacts, I doubt
that they have been designed far enough for me to prepare any accurate drawings. The Friendship developer knows
that we will likely need to permit all of that together but he's just trying to get the sewer in so that at least the backbone
of activities in that basin can be in place per Apex's plan. With Covid I'm not even sure how far out that project may get
pushed, or even revised, but I'm sure it will have somewhat of an effect on it.

Thank you for your response. I am attaching an email from the Town of Apex regarding the sewer line for your
consideration. Although I realize that how the Town separates projects is not the same process as USACE, I believe it
may help define the sewer line's overall purpose, well beyond any development associated with Friendship Station.
Via this email I am asking the engineers to comment on phases 4-6 that you mention below as I have not reviewed any
plans for those phases to date. We do acknowledge that the PUD, if wetlands and WOUS impacts are proposed, may
need to be permitted concurrently to identify any potential mitigation requirements per Section 404. We would,
however, prefer to permit the sewer separately so that it's proposed construction timelines can be met. Compensatory
wetland mitigation for the sewer line has been secured per your initial RAI letter.
In the meantime, the Friendship Station project could proceed with designs and plans suitable for inclusion into a
separate Section 404 application. Thanks for your time and assistance.

Thank you for providing additional information.
Based on the information provided in your PCN, and information obtained through the Town of Apex website, it appears
that the proposed sewer line expansion is a result of the proposed Friendship Station planned urban development
(PUD). Based on review of the delineation of Friendship Station and the conservation easement the approved
"Friendship Station, Sections 4-6" appears to impact wetland and non -wetland waters.
The Friendship Station planned urban development (PUD) including the approved Friendship Station, Sections 4-6, appears
to result in further loss to waters of the U.S., therefore these impacts must be considered together before we are able to
determine the appropriate Department of the Army permit for the proposed project.
Under conditions of nationwide permit 12 and 29 an application/pre-construction notification is considered complete only
if the activity is deemed a single and complete project. For non -linear projects "single and complete" is defined as the
total proposed or accomplished by one owner/developer or partnership, and must have independent utility. Single and
complete non -linear projects may not be "piece mealed". Please provide more information on the complete project.
Project plans should depict the entire project, including all impacts to jurisdictional features, roadways, utility lines, lot
lines, greenway trails etc. Project plans should be no larger than 11x17.

With regards to your RAI dated 3/12/2020 for the Little Beaver Creek Sewer, I am attaching the Little Beaver Creek
Sewer Study prepared for the Town of Apex along with their Sewer Basin Map. This portion of the LBC Sewer Line is
having to be built and paid for by the future developer of Friendship Station because it is the first leg of the
route. However, multiple end users will connect to the line as identified in the report and map. The initial 2 phases of
Friendship Station have been designed to avoid wetland/WOUS impacts. No information is known for any phases other
than Phase I and II. Future phases have not been designed to be best of my knowledge. Therefore, we are requesting
that the PCN and the impacts resulting from this initial segment of the LBC sewer line be reviewed as submitted.
Regarding mitigation, 0.203 acre of forested wetlands will be cleared for the sewer line project. As requested, the
applicant is currently requesting compensatory mitigation for these impacts through a private mitigation bank. Since
the impacts to these wetlands will not be a loss of wetland acreage, merely a conversion, we are not proposing a full 2:1
replacement ratio, but are asking that USACE consider a lesser ratio. I will forward the appropriate mitigation
acceptance letter immediately upon receipt.

Dear Mr. Harbor,
The Town of Apex has received a Request for a “No Practical Alternatives” determination for the
subject private development project. In accordance with UDO Section 6.1.11(G)(4), you have our
authorization to impact the riparian buffer as shown in the table below for the purposes of
constructing required sanitary sewer infrastructure for the subject project.

This authorization certificate and mitigation approval is for the purpose and design that is
described in your application and shown on approved construction plans. If you modify your
project, you must notify the Town and you may be required to submit a new application. If the
property is sold, the new owner must be given a copy of this authorization letter and is thereby
responsible for complying with all conditions. As always, you should obtain or otherwise comply
with any other federal, state or local permits before you begin your project. This authorization
requires you to follow the conditions listed on the following page.

The Additional Conditions of the Certification are:
1. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface water standards. The erosion and
sediment control measures for the project must be designed, installed, operated, and
maintained in accordance with the most recent version of the North Carolina Sediment and
Erosion Control Planning and Design Manual, Town standards, and the Town Soil Erosion
and Sedimentation Control ordinance.
a. The design, installation, operation, and maintenance of the sediment and erosion
control measures must be such that they equal, or exceed, the requirements specified
in the most recent version of the North Carolina Sediment and Erosion Control Manual,
Town standards, and Town Erosion Control ordinance. The devices shall be maintained
on all construction sites, borrow sites, and waste pile (spoil) projects, including
contractor-owned or leased borrow pits associated with the project.
b. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
c. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the application. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed such that no violations of state water
quality standards, statutes, or rules occur.
3. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive
velocities through the protected stream buffers and will not re-concentrate before
discharging into the stream as identified within 15A NCAC 2B .0267(8) and Town UDO
Section 6.1.11.
Any disputes over determinations regarding this Authorization (associated with the approved
buffer impacts to Zones 1 and 2) shall be referred in writing to the DEQ Director within thirty (30)
days of receipt of this notice for a decision.
To contest the Director’s decision, you must file a petition for an administrative hearing. You may
obtain the petition form from the office of Administrative Hearings. You must file the petition with
