Reference is also made to your letter of of March 22. 1993, in which you requested that the Special Condition of a no work period from November 1 through April 15 to protect trout egg and fry stages from sedimentation be waived. Final reference is made to Mr. Joe Mickey's letter of March 24, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the waiver provided that: a. Adequate erosion controls are maintained during the life of the project. Based on our review of your request, with compliance with Mr. Mickey's comments concerning this matter, Special Condition of the no work period is hereby waived. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed project and road addition to the State system parallels Rush Branch, a tributary to the North Fork New River which is Designated Public Mountain Trout Water. The North Fork New River below the project contains populations of wild brown and brook trout (NCWRC 1991 and 1992 data). Based on fish population surveys from other upper North Fork New River tributaries, it is expected that Rush Branch contains wild brook trout, however, no fish data has been collected from this stream. Based on the fact that this project has the potential to impact trout populations through sedimentation, we will not object to the project provided that the following stipulations are implemented: WTI- Mr. Jolly Page 2 December 22, 1992 1. Construction within the 25-foot buffer zone is prohibited during the trout spawning period of November 1 to April 15 in order to protect the egg and fry stages from sedimentation. 2. Erosion controls should be installed where soil is disturbed and maintained until project completion. 3. Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent vegetation in these same areas should be established within 15 days of ground disturbing activities to provide long term erosion control.
