Upon review of your request for Water Quality Certification
to place fill material in less than one acre of wetlands or
waters in Cabbage Creek for upgrading of SR 1307 in Ashe County,
we have determined that the proposed fill can be covered by
General Water Quality Certification No. 2732 issued January 21,-
1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 14.

DATE: January 11, 1993
On January 8, 1993, I met with Department Of Transportation
personnel from the Wilkes County District Office. We drove to SR
1307 in Ashe County and discussed the proposed road widening and
stream crossings associated with this road improvement project.
Most stream crossings are presently culverted. In some instances
the culvert pipes will be lengthened or replaced by a larger
diameter. The Land Quality Section of DEHNR will review the
proposed erosion control structures for the project and should make
inspections during the actual grading and construction. These
devices, if properly installed and maintained, should control the
sediment and preserve the quality of the surface water.
Therefore, the Winston-Salem Regional Office recommends that the
401 Permit be granted.

Dear Mr. Bennett:
Reference is made to your letter of July 23, 1992, (received on
October 5, 1992) requesting Department of the Army permit authorization for
the placement of fill material into Cabbage Creek in association with the
replacement and/or extensions of seven existing pipe culverts with the paving
upgrade of SR 1307 (Cabbage Creek Road), Ashland, Ashe County, North Carolina.
Reference is also made to Mr. Dennis SteFrart's letter of October 9, 1992, in
which the North Carolina Wildlife Resources Commission expressed no objections
to the planned road improvements provided that:
a. Work within the 25-foot buffer zone is prohibited during the brook
trout spawning period of November 1 through April 15 in order to protect egg
and fry stages from sedimentation.
b. Erosion/sedimentation controls must be installed prior to construction
and maintained until project completion.
c. Temporary ground cover should be placed on bare soil as soon as
construction is complete. Permanent vegetation in these same areas must be
established within 15 days of project co pletion to provide long-term erosion
control.
d. No heavy equipment is operated in the live streams in order to
minimize sedimentation and prevent introduction of other pollutants.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for fills for roads
crossing waters of the United States (including wetlands and other special
aquatic sites) provided:

a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than one-third acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
c. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected high flaws and the movement
of aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water
of the United States; and
e. For fills in special aquatic sites, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition.
Special conditions of this permit state that before discharging dredged
or fill material into waters of the United States occurring within the 25
mountain counties of North Carolina that contain trout waters, the applicant
will obtain a letter of approval from the North Carolina Wildlife Resource
Commission. Review of the information you have provided, and the comments
submitted by the North Carolina Wildlife Resources Commission, reveals that
your proposed work of a minor road crossings on the aforementioned creek,
is authorized by nationwide permit provided it is accomplished in strict
accordance with the enclosed conditions and the reconcendations set forth
by the Wildlife Resources CmMission. This nationwide permit does not relieve
you of the responsibility to obtain any required state or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity ccuplies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to conmemc>ee in reliance upon the nationwide permit will remain
authorized provided the activity is ccupleted within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Please review the attached plans for grade, drain, base, and
pave of SR 1307 (Cabbage Ck. Rd.) in Ashe county. This work
may impact the waters of Cabbage Creek and unnamed
tributaries to Cabbage Creek, a DEHNR Class C trout water.
These plans have been reviewed and approved by our Division
Roadside Environmental Engineer, with copies to the area
Roadside Environmental Engineer. Plans have been sent to the
North Carolina Wildlife Resources Commission and the U. S.
Army Corps. of Engineers for their review and approval.
(Copies of letters attached).
Said road now exists inside the 25 ft. buffer zone of Cabbage
Ck. The new center line has been surveyed, and moved away
from the creek as much as reasonably possible to avoid and
minimize impact to the stream. To protect the existing slope
and minimize future erosion, we propose to utilize class II
Rip Rap at a thickness of 18 in. with fabric liner along the
creek banks for slope protection.

Dear Mr. Jolly:
The North Carolina Department of Transportation (NC:DOT) is
requesting a letter of concurrence from the North Carolina
Wildlife Resource, Commission (NCWRC) to obtain a 404 permit from
the U.S. Army Corps of Engineers. I have reviewed information
provided by the applicant, and I am familiar- with habitat values
of the project area. A site visit was not conducted for this
re-.view. Theme comments are provided In accordance with
provisions of the Clean Hater Act of 1977 (33 U.S.C. 466 cit.
seq.) and the Fisch and Wildlife Coordination Act (48 Stat. 401,
a amended; 16 U.S.C. 661-667d).
I'tEDOT is proposing to grade, drain, bane and pave 1.0 KIM
of SR 1307 (Cabbage Creek Road) in•Ashe County. Seven pipes are
achodcaled for replacement or extension. Also, road shoulder
r_onotrcrr_tion using Class II riprap is required at stations 5+70 -
7+5 and 32+50 - 33+00.
Cabbage Creek lr a tributary to Roundabout Creek which f.low!?s
into the Nor th Fork. New Fiver which is Designated Public Mountain
Trotit Water. While no fish sample was collected from Cabbage
Crank , it is expect ed that the stream supports br ook and brown
trout ninrv both sp ecies are found in Roundabout Creek: (NCWRC
data, 1971).
Rased on the information provided by NCDOT and knowing they
range of wild trout populations in the aarea, the NCURC mill not
object to the project as proposed provided that:

1. Construction within the 25-foot buffer- one is
prohibited during the trout spawning period of November-
I to April 15 in order to protect the egg and fry stager,
from sedimentation.
2. Erasion controls should be installed where soil is
disturbed and maintained until project completion.
3. Temporary ground cover (e.g. hardwood mulch, straw,
etc.) should be placed on all hare soil during
construction. Permanent'vegetation in these same areas
should he established within 15 days of ground
disturbing activities to provide long term erosion
control.

Engineers for the replacement, addition, and/or extension of pipe
required to perform the construction of an improvement to SR 1307,
Cabbage Creek Road, in Ashe County.
This improvement consists of grading, draining, adding base, paving
and erosion control to accommodate a pavement width of 18-feet, with
a proposed beginning date of November 02, 1992 and completion no
later than March 30, 1993.
Attached are marked county map and sketches showing the proposed pipe
changes necessary for this road improvement. There will be less than
ten (10) cubic yards of fill material placed below ordinary high
water at these locations.

On projects where fill material must be placed in a Buffer Zone, it must be built with a rock toe
embankment. Fill should then be placed behind the rock embankment such that no earth mater-
ial is directly exposed to the buffer zone area. The rock must extend up the slope so that the
entire slope is plated with the stone. I'his procedure shall be implemented in the sequence as
outlined in the detail shown below

EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures will be
installed before clearing and grubbing operations begin.
(2) As construction progresses temporary and permanent
erosion control devices shall be installed in a timely
manner.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) As project progresses, request will promptly be made to
the Division Roadside Environmental Unit for stage and
permanent seeding.
(5) Any removal of siltation devices will be based on the
condition of established ground cover of that area the
device is serving.
