Management signed General Water Quality Certification Number 2735
for General Permit Number 198200031 for DOT bridges. This
General Certification states that written DEM concurrence with
GP031 is needed only if there is wetland fill.
In recent weeks, you sent 401 applications for the following
projects. Since these projects do not involve any wetland fill,
they are in compliance with our new General Certification Number
2735 are hereby approved.

Nationwide 404 Permit applications
Biologists on our staff have reviewed the following Nationwide 404 permit
applications and believe that the Section 401 Water Quality Certification can be issued
without significant harm to wetland resources, including fish and wildlife:

On March 9, 1992, 1 received a letter from you advising that
your project entitled Pipe Addition on SR 1335 at Lansing in Ashe
County qualifies for a General Permit 31. Please be advised that
this General Permit is not valid until a letter of concurrence is
issued by the State of North Carolina.
Our existing regulations (15A NCAC 2H .0501(a)) require that
all applicants for 401 Certifications submit seven complete
copies of 401 Applications. These copies must be supplied by the
Division of Environmental Management to various state and federal
agencies.
Therefore, please complete the attached form and send
additional copies (a total of seven copies) of your 401
Certification application so we can initiate the comprehe
review required by our rules. If you have any questions,

The North Carolina Department Of Transportation Bridge Maintenance
Unit, proposes the following project for yourissuance of a Section 404
Permit. The project involves a designated mountain county in Western
North Carolina and we believe this project can be accomplished under
General Permit No. SAWC082-N-000-0031.

STREAM:Tributary to Little Horse Creek (No designated trout waters involved
DESCRIPTION: Add additional 84" CMP at exist. 84" CMP
No wetlands involved
Less than 25 CY fill material below normal highwater.
With a-copy of this letter, we are also requestinq a concurrence letter
from the Wildlife Resources Commission and requesting issuance of 401
Water Quality Certification from the N. C. Division Of Environmental.
Management.
We have.-attached a site location map, and a sketch of planned activities.
A strinqent erosion and sedimentation control program will be implemented
during the project construction and every effort will be made to complete
work in a timely manner.

SUBJECT: Comments on Section 401 Water Quality Certification for
Section 404 Nationwide Permit requests
Biologists on the Wildlife Resources Commission staff have
reviewed the subject permit application and we are familiar with
habitat values of the project area. Our comments are provided in
accordance with provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U. S. C. 661-667d).
Based upon information provided, it is our opinion that
Section 401 Water Quality Certification can be issued without
significant impacts on fish and wildlife for the following
projects:
1. City of Winston-Salem, Forsyth County
2. Southeastern Jurisdiction Administrative Council, Lake
Junaluska, Haywood County (ID# 92174)
3. Transcontinental Gas Pipe Line Corp., Iredell and Rowan
Counties, (ID# 92178)
4. NCDOT Bridge No. 26 over Cypress Creek on NC 53, Pender
County
5. NCDOT Bridge No. 239 over Mulberry Creek on SR 1369,
Caldwell County
6. NCDOT Pipe Replacement 0.9 miles west of SR 1506 on SR

applications. This "no comment" should not be considered as
either approval or disapproval of the work proposed. These
projects are:

2. NCDOT Bridge No. 12 over Thorofare Bay Channel at Cedar
Island, Carteret County.
