Department of Transportation pursuant to an application filed on the 13 day of December, 1991 to replace Melvin Daniels Bridge and widen US 64/264 between NC 345 on Roanoke Island and US 158/NC12 intersection at Whalebone Junction. The Application provides adequate assurance that the discharge of fill material into the waters of Roanoke Sound tributaries in conjunction with the proposed road and bridge improvements in Dare County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance withthe application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. Department of Transportation Bio Report Page Two History The applicant proposes to replace the Melvin Daniels Bridge (#14) on the Nags Head Causeway and widen U.S. 64/264 between N.C. 345 on Roanoke Island and the U.S. 158/N.C. 12 intersection at Whalebone Junction. These proposed improvements comprise the second phase of a two-phase construction plan for this 2.1 mile long expanse. In Phase I, the old swing-span bridge over Roanoke Sound (Washington Baum Bridge No. 12) was replaced with a fixed-span, high rise, four lane facility which was completed in April, 1991. Phase II involves widening to 4 and 5 lanes the existing 2.1 miles of two lane approaches on either end of the new Washington Baum Bridge. The Phase I construction activities were authorized under CAMA Permit No. 79-87. The N.C. Wildlife Resources Commission has proposed to construct a public boat launching facility in the southwest corner of the area under the Washington Baum Bridge. In accordance with a memorandum of understanding between N.C. DOT and N.C. WRC, N.C. DOT will allow the four acre area to be used for this purpose and will provide mitigation for the wetland losses associated with the boat ramp construction as part of the mitigation plan for Phases I and II of the construction described above. The N.C. WRC, which is responsible for obtaining all required permits, submitted a complete CAMA application to the Division of Coastal Management on August 27, 1991 and this application is now being reviewed by the various state and federal agencies. The wetland creation sites initially selected by N.C. DOT were a 3.8 acre site at Whalebone Junction, and a 1.03 acre site at the staging area within the sw bridge quadrant. Changes in the mitigation proposal have been necessitated by the following: 1) Modifications to the roadway plans for the Whalebone Junction area have reduced the acreage available for wetlands creation from 3.8 acres to 0.9 acres. 2) The 1.49 acres of disturbed wetlands and an open water slough at the sw bridge quadrant originally proposed for restoration are now slated for use as a parking area for N.C. WRC's boat launching facility. 3) The proposed boat ramp and associated facilities will lead to the deletion on N.C. DOT's commitment to create 1.03 acres of wetlands on the staging area. N.C. Department of Transportation Bio Report Page Three 4) A revision by DOT in its roadway design plans eliminated canal replacements paralleling the east-bound lanes of U.S. 64/264 between N.C. 345 and Bridge 12. Site Description For descriptive purposes the proposed improvements to the 2.1 mile long section of U.S. 64/264 are separated into two segments as follows: (1) The section of U.S. 64/264 lying between the western approach to the new Washington Baum Bridge and N.C. 345 on Roanoke Island and (2) The section of U.S. 64/264 between the eastern approach to the Washington Baum Bridge and the U.S. 158/N.C. 12 intersection. This segment includes the existing Melvin Daniels Bridge over Muddy Channel. Within the 5500' long segment #1, man-made canals approximately 25 feet in width and 5' - 6' in depth parallel both sides of the existing alignment. The canal on the south side of U.S. 64/264 is +5400 feet long and the canal along the opposite side is about 4800 feet long and both canals are bordered by extensive expanses of black needlerush (Juncus roemerianus) marsh. These marshes are predominately vegetated with black needlerush but scattered throughout are occasional specimens of giant cordgrass (Soartina cynosuroides) and wax myrtle (Myrica cerifera). On the higher elevations and spoil banks bordering the roadside canals sea myrtle (Baccharis halimifolia), marsh elder (Iva frutescens), salt grass (Distichlis spicata), smooth cordgrass (Spartina alterniflora_), and wax myrtle are more prevalent. Just east of the N.C. 345 intersection and adjacent the south side canal is a small hummock about 5,000 square feet in area which is vegetated by species such as pond pine (Pinus serotina), loblolly pine (Pinu_s taeda) and live oak (4uercus virginiana). Farther to the east and approximately 50' - 200' from the canal are hummocks 1-2 acres in size which are similarly vegetated. At the eastern end of the first segment near the western approach of the Washington Baum Bridge, the Pirates Cove Planned Unit Development, owned and under construction by Roanoke Properties, Inc. abuts the north side of the U.S. 64/264 corridor for a distance of about 1500 feet. On the south side of the bridge approach an 800' long by 20' wide unpaved access road exists in conjunction with the activities carried out at the former staging area for bridge construction. Just north of the access road a natural slough about 500' long and 5' - 60' in width extends inland off Roanoke Sound parallel to the new bridge. N.C. Department of Transportation Bio Report Page Four The second segment of the corridor is about 55001in length. Within it are uplands not subject to tidal flooding. Almost all of these uplands have been developed. This segment includes the existing 2 lane Melvin Daniels Bridge which is approximately 345' long with clearance of about 4 feet above MHW. Along approximately 40% of the corridor's edge the roadside is fringed with bushes and shrubs including wax myrtle, yaupon, sea myrtle, and black cherry which at several locations are quite dense. As these fringes grade down to near marsh elevation saw grass ( ad um jamaicense) and cattail (Typha latifola) are quite common. Proposed Improvements/Methods The applicant proposes to complete Phase II of their two-phase construction plans by widening to 4/5 lanes the existing 2.1 miles of two lane approaches on either end of the new Washington Baum Bridge and replacing the Melvin Daniels Bridge on the Nags Head Causeway. Additional right-of-way on the south side of the alignment within Segment 1 is being obtained in order to encompass the 25' wide canal. About 1500 linear feet of the canal near the proposed boat ramp will be left open to allow continued access and use by boaters and fisherman. The balance of this canal (5375 linear feet) would be filled. No filling is proposed on the north side of this alignment. Along the 5375 linear feet of canal where filling is to occur, appropriate soil erosion/sedimentation control measures will be taken to insure that fill will not enter the marsh. The existing Melvin Daniels Bridge will be replaced by a new 4-lane, 450' long bridge running from fill face to fill face with a width of 93' and a vertical clearance of 5.45' at MHW. At the east end of the bridge, the existing seawall is to be removed and 85 linear feet of material excavated by clamshell dredge for a width of 100 feet centered on the centerline of the roadway. Existing piles would be loosened by vibration, then removed by crane. New piles would be placed by hydraulic jet and pile driver. All construction is to take place from barges or bridges themselves, therefore no construction access channel will be required and no hydraulic dredging will take place. The widening of the bridge will require that additional right-of-way on the south side be obtained at the western bridge approach, therefore, the Ships Wheel Restaurant building will be demolished. Approximately 20 other structures fronting this section of U.S. 64/264 will apparently remain intact. Where the exiting structures are located, a combination of open swales and infiltration trenches utilizing paving blocks, filter cloth and class "A" stone are proposed along the south side of the pavement for stormwater management purposes. N.C. Department of Transportation Bio Report Page Five Immediately east of the proposed Melvin Daniels Bridge and on the north side of the U.S. 64/264 alignment the applicant is proposing to extend the right-of-way a maximum of 20' to the north along a 1200 linear foot section of the roadway. Approximately 1600 cubic yards of fill would be placed below MHW. In order to accomplish the right-of-way extension rip rap would be placed a maximum of 30' waterward of the mean high tide line. Anticipated Impacts The widening of the 5400 linear feet of U.S. 64/264 between the western approach of the Washington Baum Bridge and the N.C. 345 intersection will involve the filling of 3.76 acres of open water. Immediately west of the N.C. 345 intersection approximately 5,000 square feet (0.12 acres) of wetland scrub would be filled. Approximately 2.8 acres of 11404" and coastal wetlands would be permanently lost as a result of the Phase II roadway improvements. Increased water turbidity is likely to occur as a result of bridge construction activity and the placing of fill and rip rap along the north side of the eastern approach of the Melvin Daniels Bridge. Department of Transportation Bio Report Page Six CAMA Review - Segment #1 The Dare County land use plan expresses strong support for highway improvements. The County's policy for state and Federal Program Support states "States and federally funded water and highway transportation projects shall receive the highest level of support". The County identifies roadway improvements to handle summer traffic as being needed, and places greatest importance on improved evacuation routes, the main road(s) running through the unincorporated communities on the Outer Banks, and bikeways for alternative travel. However, the particular new roadways alignment anticipates significant impacts to coastal wetlands and estuarine waters. The County's land use plan states that "the critical importance of coastal wetlands has been recognized by including all such areas in the Conservation category of the land classification map". Dare County's Conservation classification includes special development standards that deem development appropriate where it can be shown that "the proposed development will not destroy or irretrievably alter wetlands". The County supports the LAMA permit standards for coastal wetlands and its policy is to "support reasonable efforts by federal, state and local agencies to protect and preserve coastal wetlands". For estuarine waters, the County's policy is to "discourage developments that have a high probability of seriously impacting the water quality or environmental values of the estuarine resource". While Dare County's land use plan gives strong support for roadway improvements, the County's plan places critical importance upon coastal wetlands, the estuarine system and other similarly classed lands. It expresses equally strong support for the protection of those lands and resources and it requires that impacts to those land/resources must be kept to the minimum possible. Use of measures including alternative roadway alignments and right-of-way widths fill reduction, and mitigation prior to construction can together minimize the adverse impacts posed by the particular proposal, maintain the resources and their values, and as a whole, accomplish the environmental protection goals set out in Dare County's land use plan. This proposal must meet these goals as noted above in order to be consistent with the Dare County land use plan. N.C. Department of Transportation Bio Report Page Seven CAMA Review - Segment #2 This segment lies entirely within the jurisdiction of the town of Nags head. The Town has nearly completed an update of its 1985 land use plan, and the new plan is likely to be locally adopted and certified by the Coastal Resources commission prior to a decision being made on this permit application. There is little difference between the applicable Town policies found in each plan, such that the Town in its 1990 land use plan simply adds a bit more clarity and specificity to the applicable policies from its 1985 land use plan. Therefore, this CAMA review is reflective of both the 1985 and 1990 (proposed) land use plans. As in the case of Dare County, the Town of Nags Head land use plan calls for improvements to U.S. 64/264 or additional bridges to the mainland to achieve the goal of quick evacuation in the event of a major storm threat. The proposed improvements are aimed at this purpose. The Town places all CAMA AEC's and 11404" wetlands" in its Conservation classification of its land use plan. The Town calls for any development that might occur to be done in a cautious fashion and that only those uses allowed by local zoning and state/federal regulations are acceptable. The overall goal is to "provide for effective long-term management and protection of significant, limited or irreplaceable resource areas." In sum, the proposed improvements will address in part one of the Town's traffic policies. So long as the proposed improvements are found by the reviewing agencies to constitute "development in a cautious manner, recognizing the environmental sensitivity of these areas," and to satisfy current regulations, the Segment II proposal will be consistent with the Nags Head land use plans. NCDOT has addressed your request in the following manner. Item 1 requested that all wetland areas to be filled be clearly indicated on the work plats. Sheets 8 and 9 have been modified to denote the wetland areas to be filled. All other plats appear to accurately show wetlands fill. Please note that the wetlands loss calculations included in our mitigation plan were based on the same information as that shown on the revised permit plats. Item 2 requested further details on construction design plans and methods for the replacement of the Melvin Daniels Bridge. The existing bridge will serve as a temporary crossing until traffic can be detoured onto a section of the new bridge, and then the old bridge will be removed. Construction of the new bridge will utilize a cast in place deck. A 24" water line and all associated supports north of the existing bridge will be removed, and the new water line will be carried on the deck of the proposed bridge. The bridge will possess a width of 93' 2" and a length of 450' from fill face to fill face. Two end bents and 11 supporting bents are to be utilized. DEPARTMENT OF TRANSPORTATION proposes to replace the 345 .11.g1mi r__Daniels Bridge (#14) and widen U.S. 64/264 between N.C 345 on Roanoke Island and U.S. 158/N.C. 12 intersection at Whalebone Junction. Mitigation is proposed for wetland impacts associated with this phase (Phase II) and Phase I improvements to U.S. 64/264.
