THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to N. C. Department of Transportation pursuant to an application
filed on the 23rd day of May, 1990 to place fill in a wetland
area adjacent to Tar River in conjunction with the construction
of the U. S. Highway 264 Bypass of Greenville.
The Application provides adequate assurance that the
discharge of fill material into the wetlands adjacent to the Tar
River in conjunction with the proposed highway construction in
Pitt County will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore, the State
of North Carolina Certifies that this activity will not violate
Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions
hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less are not
considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above condition is made a condition of the Federal Permit.

SUBJECT: Pitt County, North Carolina, Proposed Greenville Bypass, US 264,
from SR 1200 to North of Existing US 264, (Project R-1022BA,

Reference your letter of May 22, 1990, file no. CESAW-C-090-N-074-0326, on
the above subject, requesting additional information with respect to the
guidance contained in the Feb. 6, 1990, Memorandum of Agreement (MOA) between
the Corps and the USEPA.
Plans for the relocation of US 264 have been underway for more than 20
years. An Environmental Impact Statement (EIS) was prepared by our Department
and approved by the Federal Highway Administration in 1984. Wetland mitigation
has been discussed since the inception of this project and a great deal of
coordination has been conducted with the resource agencies.
Avoidance: The EIS was fully coordinated with all concerned agencies, and
the selected alternative was approved by the Federal Highway Administration.
Although the selected alternative does not fully avoid all wetlands, it
comprises an alignment that is the least environmentally damaging out of the
possible corridors. Thd judgement of "least environmentally damaging" took into
consideration all aspects of the environment;* i.e., social, historical,
archaeological, air, and noise, as well as wetlands impacts.
A total of five alignment alternatives were selected for study. The
recommended bypass location was selected because:

1) the selected alternative must be relocated from existing routes
(US 13-11 and SR 1200) in order to provide adequate traffic service and
to provide for future development of Greenville. The US 13-11 and
SR 1200 corridors cannot meet future projected traffic demands;
2) the recommended alignment will have the least impact on aquatic
resources of all the relocated alternatives;
3) the selected route will not impact historic sites;
4) the estimated construction costs for the preferred alternative is the o
lowest of the alternatives providing for relocation and offering
adequate adequate traffic service;
5) the selected alignment will require minimal relocation of area families
and will not separate neighborhoods, churches or schools.
Meetings were held on June 4, 1981, September 28, 1982 and March 29, 1985
during which agency concerns were expressed. As a result of these concerns, the
NCDOT agreed to shift the alignment of the north project section (R-1022BB) in a
westerly direction to reduce. impacts on gum-cypress wetlands at the Tar River
crossing.
Therefore, we believe that justification for the selected alignment as
proposed is warranted, and avoidance has been used to the maximum extent
practicable.
Minimization: Efforts to minimize wetland losses included reducing
right-of-way widths from 300 to 200 feet and restricting side slopes in wetland
communities to no greater than 2:1. At the request of the 11. C. Wildlife
Resources Commission, the proposed 36" pipe culverts at the southern end of the
wetland crossings were replaced with 100 ft.-long bridges to improve flow and
allow for wildlife movement. The bridge over the Tar River will be approximately
900 feet in length with 550 feet of this structure crossing wetland areas or
river bank communities.
For the south project section (R-1022BA), the NCDOT has reduced right-of-way
widths from 300 to 200 feet and restricted side slopes in wetland communities to
no greater than 2:1.
Mitigation: For the north section (R-1022BB), mitigation has been agreed
upon and will consist of creation of 7.2 acres of wetland through the purchase of
a tract near the proposed alignment, and the placing into public trust of 8.5
acres near the Ta"r River crossing. The site near the Tar will offset the 1.3
acre deficit not covered by the creation site. As mitigation for the unavoidable
wetland losses in the south section (R-1022BA), we propose debiting of the NCDOT
Company Swamp Mitigation Bank, using a HEP evaluation to determine credit
withdrawal for the 16.4 acres. We believe use of the NCDOT Mitigation Bank
represents the most prudent approach for mitigation. Our reasoning for this -
includes:
1) The wetlands to be filled on the south section are mesic pine forest.
Until recently the area would not have been classified as wetlands

and, in fact, was not identified as wetlands when the environmental
studies were made.
2) At this location, there is no opportunity for wetland mitigation,
either enhancement or creation, within the highway right-of-way.
3) A review of the project area has not revealed a location that would
provide a suitable. off site mitigation area for restoration or
creation.
The NCDOT has spent considerable time and resources planning and coordi-
nating the proposed US 264 Bypass. Our agency has made a concerted effort to
address the concerns of all commenting agencies with a spirit of compromise when
necessary. We have evaluated all avenues for wetland avoidance and have
minimized potential encroachment whenever feasible. We believe use of the NCDOT
Mitigation Bank represents the most appropriate and practical approach for
mitigating the remaining loss. In the meantime, traffic demands in the
Greenville area dictate that improvements must be forthcoming. Therefore, we
respectfully request issuance of a Section 404 permit so that planned
improvements may continue.

In keeping with your request, this office has circulated to interested
state review agencies U. S. Army Corps of Engineers Public Notice .... 0326
dated July 5, 1990 which describes a project, proposal by the N. C. Department
of Transportation, Division of Highways of Raleigh. The project, involving
the placement of 16.4 acres of fill in forested wetland to facilitate bypass
construction is located west of Greenville, in Pitt County, along the U. S.
Highway 264 Bypass.
Inasmuch as processing for the water quality certification is incomplete,
a final position of the state is not offered at this time. However, other
important comments are provided herein. All cooperating agencies responded
with only Land Resources and Wildlife Resources submitting written comments.
These responses follow:
Division of Land Resources - will require that: a) appropriate erosion and
sedimentation control devices, measures, or structures be used to prevent
sediment from entering the adjacent wetlands/watercourses/property (e.g., silt
fence, diversion swales/berms, sand fence, etc.), b) a ground cover
sufficient to restrain erosion be provided within 30 working days of
completion of any phase of grading oncut or filled slopes.
Wildlife Resources Commission - finds that the highway corridor will have
significant direct and indirect impacts on wildlife resources and
environmental quality. Further, the Commission finds that debiting the
Company Swamp Mitigation Bank 'inappropriate due to extreme habital
differences. However, the Commission .... "would concur with debiting a
pocosin mitigation bank, or other restoration/creation proposals".
In view of the above, this viewpoint position will not interpose
ojection. It is obvious, however, that a firm commitment by the D.O.T. on
future debiting would be necessary to resolve this matter.

Reference your application for Department of the Army (DOA) authorization
to place fill material in wetlands adjacent to the Tar River associated with
construction of the Greenville Bypass, U.S. Highway 264, Pitt County, North
Carolina.
On February 6, 1990, the DOA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the purposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts.
C. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please indicate your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.

PUBLIC NOTICE
NORTH CAROLINA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS, Post
Office Box 25201, Raleigh, North Carolina 27611 has applied for a Department
of the Army (DOA) permit TO PLACE FILL MATERIAL IN ISOLATED WOODED WETLANDS IN
PITT COUNTY, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show construction of approximately 0.5 miles of the Greenville
Bypass, U.S. Highway 264, from S.R. 1200 to north of existing U.S. Highway 264
west of Greenville. The project will result in filling 16.4 acres of forested
wetlands. Dominant plant species include loblolly pine (Pinus taeda), pond
pine (Pinus serotina), water oak ( uercus nigra), cane (Arundinaria gigantea),
red bay (Persea borbonia), fetter-bush (Leonia lucida), and catbrier (Smilax
s2.). Most of the construction corridor is wetland and underlain with Rains
hydric soil. The applicant proposes to mitigate for lost wetland resources by
debiting the NCDOT Company Swamp Mitigation Bank and will use a HEP evaulation
to determine credit withdrawal for the 16.4 acres. The purpose of the work is
to improve public highway transportation facilities. Plans showing the work
are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No DOA
permit will be issued until the coordinated State viewpoint on the proposal
has been received and reviewed by this agency, nor will a DOA permit be
issued until the North Carolina Division of Environmental Management (NCDEM)
has determined the applicability of a Water Quality Certificate as required by
PL 92-500.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible

for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archaeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species Act
of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain values (in accordance with Executive Order
11988), land use, navigation, shore erosion and accretion, recreation, water
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the
placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit
would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable
guidelines or criteria, a permit will be granted unless the District Engineer
determines that it would be contrary to the public interest.
The Corps of Engineers is soliciting comments from the public; Federal,
State and local agencies and officials; Indian Tribes and other interested
parties in order to consider and evaluate the impacts of this proposed
activity. Any comments received will be considered by the Corps of Engineers
to determine whether to issue, modify, condition or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on
endangered species, historic properties, water quality, general environmental
effects and the other public interest factors listed above. Comments are used
in the preparation of an Environmental Assessment and/or an Environmental
Impact Statement pursuant to the National Environmental Policy Act. Comments
are also used to determine the need for a public hearing and to determine the
overall public interest of the proposed activity.

Generally, the decision whether to issue this DOA permit will not be made
until the North Carolina Division of Environmental Management (DEM) issues,
denies, or waives State certification required by Section 401 of the Clean
Water Act. The DEM considers whether or not the proposed activity will comply
with Sections 301, 302, 306, and 307 of the Clean Water Act. The application
and this public notice for the DOA permit serve as application to the DEM for
certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
Aug 3, 1990.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the North

Enclosed is the application of the North Carolina Department of
Transportation, Division of Highways, for Department of the Army authorization
and a State Water Quality Certification to place fill material in wetlands
adjacent to the Tar River associated with construction of the Greenville
Bypass, U.S. Highway 264, Pitt County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by July 23, 1990, the District
Engineer will deem that waiver has occurred.

The North Carolina Department of Transportation proposes
to construct approximately 0.5 miles of the Greenville
Bypass, US 264, from SR 1200 to north of Existing US 264,
Pitt County, North Carolina, near the corporate limits of
Greenville. Note that the Bypass segment previously
designated "R-1022B" has been split into two sections:
"R-1022BA" and "R-1022BB."
Your letter of Feb 9, 1990, indicated Corps of Engineers
regulatory jurisdiction stationing for the "BA" section.
As requested by the Feb 9 letter, the lateral extent of
wetlands at the stations mentioned has been determined, and
amounts to approximately 16.4 acres. This is approximately
from station 19+75 to station 40+90. Pine-oak wetlands are
predominant.
Plans for the relocation of US 264 have been underway
for more than 20 years. An Environmental Impact Statement
was prepared by our Department and approved in 1984. Wetland
mitigation has been discussed since the inception of this
project and a great deal of coordination had been conducted
with the resource agencies.

Due to concerns expressed by these agencies, the NCDOT
agreed to various measures to avoid or minimize wetland
impacts. For the "BA" section, the NCDOT has reduced right-
of-way widths from 300 to 200 feet and restricted side slopes
in wetland communities to no greater than 2:1.
As mitigation for the unavoidable wetland losses, we
propose debiting of the NCDOT Company Swamp Mitigation Bank,
using a HEP evaluation to determine credit withdrawal for the
16.4 acres. We believe use of the NCDOT Mitigation Bank
represents the most logical approach for mitigation.
A 401 water Quality Certification was issued for this
project by NC EHNR/DEM on November 6, 1989.
In the meantime, traffic demands in the Greenville area
dictate that improvements must be forthcoming. We intend to
let this project for construction in September, 1990. We
request your immediate attention to this matter, and we
respectfully request issuance of a Section 404 permit so that
planned improvements may continue.
