The Application provides adequate assurance that the discharge of fill material into the waters of Atlantic Ocean in conjunction with the proposed beach nourishment in Hyde County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU`s or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. Everett Director Attached is a copy of a request from NC DOT to carry out beach nourishment adjacent the ferry loop road at the Ocracoke Ferry Terminal, Hyde County. On April 22, 1988, LAMA Permit #224-87 was modified to incorporate a similar request for beach nourishment. This area has experienced erosion and the loop road may be soon undermined by erosion. I have no objection to this modification request and recommend we modify LAMA permit #224-87 to allow one-time beach nourishment subject to the same conditions as issued on 4/22/88. STATE HIGHWAY ADMINISTRATOR Recent storms in the Hatteras Inlet area have caused erosion of shoreline at the Hatteras Inlet, South Dock ferry terminal. Tlae encroaching waterline reaches to within approximately twenty feet of a portion of NC 12, threatening to undermine the pavement. I would like to counter this potentiality by deposit- ing sand slurry, pumped from the nearby channel, onto the problem area. I request that CN4A permit # 224-87 be modified to permit the Ferry DiSision's dredge department to perform this proposed project. Earlier this year the dis- tance between the pavement and the waterline was approximately seventy feet. Roughly four thousand cubic yards of sand will be required to restore the beach. Enclosed is a plat highlighting the threatened shoreline. Officials at the Cape Hatteras National Seashore Park were told of the erosion problem on Monday, December 4. They advised that they would expedite a Special Use Permit for this proposal. Immediately upon receipt, a copy will be forwarded to you. Channel expansion .was deleted in order to preclude impacts to adjacent shallow water habitat including sea grass beds. If channel expansion is deemed necessary, modifi- cation, of this permit is required. Such modification request would have to include a detailed plan depicting existing sea grass beds and degree of impact by expanded channel. (2) Excavation will not exceed 12 feet below the elevation of mean low water (MLW) . (3) The activity will be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction-related discharge (increases such that the turbidity in the Stream is 25 NT Us or less are not considered significant). (5) No marsh: grass or sea grass will be excavated and/or filled. (6) The material from the basin (silty bottom) will be contained in the diked disposal areas and only suitable sandy spoil will be placed on the beach. Refer to additional conditions for spoil disposal. Maintenance Clause (7) The Division of Coastal Management must be notified in writing at least two (2) weeks prior to initiation of any maintenance work and such notification will include: A.' the number of the dredge and fill permit, B. a statement that no dimensional changes are proposed, C.` a copy of the -permit plat with cross-hatching indicating the area to be maintained, the area to be used for spoil, and the estimated amount of material to be removed, and D. the date of map revision and the applicant's signature shown anew on the plat. (8) If, during project activity, submerged materials of archaeological significance are encountered, the ._.permittee will immediately. cease. work and notify the Division of Coastal-Management and the Corps of Engineers. NOTE: The Division of Environmental Management issued Section 401 Water Quality Certification No. 2139 for this project on August 25, 1987. NOTE: Whenever possible, the permittee is urged to carry out maintenance excavation and spoiling during November-February in order to afford greater protection to all fish and wildlife resources in the project area. Conditions Applicable To Diked Spoil Disposal Use (9) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surroun- ding waters. (10) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or below the mean low water level to prevent gully erosion and unnecessary siltation. (11) The terminal end of the pipeline will be positioned at or greater than fifty (50) feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended solids. (12) A water control structure will be installed at the intake end of the effluent pipe to assure.compliance with water quality standards. (14) This project must be conducted in accordance with the rules and regulations of the N. C. Sedimentation Pollution Control Act. (15) All earthen berms, dikes, and cut or filled slopes must be at an angle that can be retained by vegetative ground cover and be provided with a ground cover (vegetative or other) within 30 working days of placement. (16) Adequate erosion/sedimentation control measures, structures, and devices must be utilized until a permanent ground cover sufficient to restrain erosion is established. _:NOTE: This project is expected to result in moderate mosquito problems. The applicant should contact the Vector Control Branch regarding appropriate mosquito control measures. Conditions Applicable To Beach Spoil Disposal (17) Spoil disposal on beach land owned by the U.S. Department of the Interior is contingent upon an active Special Use Permit. (18) During the sea turtle nesting season (May 1 through October 31), no materials may be placed on the ocean facing (east-west oriented) portion of area one (see sketch) but must be placed on that section of area one adjacent to the inlet channel (north-south oriented). (19) Material placed on beach strand may not be allowed to pile up but must be evenly distributed so that elevation of the spoil area is no greater than two feet above the adjacent beach. (20) Material placed on beach must be placed on beach berm or strand and may not cover intertidal sand flats behind the beach berm. (21) Following deposit from maintenance dredging, area three must be contoured to natural conditions. The Superintendent, Cape Hatteras National Seashore, at his discretion, may require the permittee to sprig the deposit area with American beach grass during the appropriate growing season. yea Please type or print.
