This permit, issued on October 26, 1990 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) In order to protect juvenile shrimp and finfish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management through coordination with the Division of Marine Fisheries. 2) Remedial excavation of the. old causeways must average at least -3.5' relative to the MLW level. All areas adjusted by remedial excavation will. assume bottom elevation below the MLW level. 3) The riprap material used at each of the buttress locations must be free from loose dirt and other pollutants other than in trace quantities. 4) All earthen fill material placed below the MHW level must be clean and free of all pollutants, except in trace quantities. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1993 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. This would eliminate a significant amount of fill, create more intertidal habitat and enhance flushing to greater extent than proposed. Fill required for the widening of the causeway is 2.9 times the amount that will be removed by increasing the span. Approximately half the fill required on the west side of the bridge could be eliminated by adding two more spans on the west side. Mitigation was not offered for the loss of wetland and SAV habitat. This Office feels the impacts from the widening of the causeway should be minimized to a greater extent than proposed. Widening of the span would not only reduce habitat impacts but should improve water quality in Gales Creek. PAGE #2 8. PROJECT SUMMARY: The 'revised' project plans have increased the intertidal bridge opening from 100' (in the original proposal) to 185' at the MHW level (buttress to buttress). The Gales Creek bridge will be constructed similar to the Broad Creek bridge, with 6 individual spans each 37.5' long for a total bridge surface of 2251. 9. NARRATIVE DESCRIPTION: In order to create the increased opening, a portion of the old causeway will be excavated. On the west side of the bridge, an area measuring 50' x 70' will be excavated to a depth of approximately 2.5' relative to MLW. A similar size area on the east side of the existing bridge will also be removed. The excavation is an effort by DOT to enhance the tidal flushing capabilities of Gales Creek and create shallow-water habitat. Excavation in these two areas will not directly involve coastal wetlands or any of the known submerged aquatic vegetation since the existing bridge abutments are stabilized by bulkhead construction and the SAVs are located outside of the excavation alignment. In addition, the increased bridge length has eliminated a significant amount of fill in the shallow waters of Gales Creek where the majority of the known SAVs reside. An estimated 13,500 sq. ft. of open-water fill has been eliminated by the increased bridge opening. Approximately 21,000 sq. ft. of intertidal habitat will now be subject to filling. The fill requirements on coastal wetlands, at the project site, remain basically the same at approximately 20,000 sq. ft. The vegetation in all four quadrants of the project is dominated by saltmarsh cordgrass and black needlerush. An estimated 11,800 cu. yds. of improved fill will be placed below the level of the MHW shoreline creating the new wider roadbed. Half of the projected fill operation will take place on the north side of Hwy. 24 within the designated Primary Nursery Area. Fill requirements on the southwest side of the bridge may impact an area of submerged aquatic vegetation estimated to be only 500 sq. ft. The extent of this impact will depend on the offshore extent of the roadway slope. 10. ANTICIPATED IIiPACTS: The proposed bridge replacement and subsequent improvements to N.C. Hwy. 24 will greatly improve public safety and the driveability of the highway. Increased vertical clearance 8' under the bridge will improve, to a limited basis, the accessibility of the upper reaches of Gales Creek by small boats. FIELD INVESTIGATION REPORT - N.C. Primary concerns appear to center around hydrologic restrictions potentially created by the causeways and appropriate mitigation for wetland losses. The Office of Planning and Assessment within your Department has recommended that additional studies be conducted to investigate sedimentation away from the channels, effects on the benthic biota, and the potential for anoxic conditions to develop behind the causeways (see attached 6/20/89 memo from Mr. Doug Lewis). From our June 5, 1989 meeting, we also realize that an acceptable mitigation program must be developed. We hereby request that our application for a CAMA permit be held in abeyance until further studies are conducted and these issues can be resolved. By copy of this letter, we request similar consideration from the U.S. Army Corps of Engineers regarding 404 permit approval and from the N.C. Division of Environmental Management for 401 Water Quality Certification. Lewis Director Planning and Assessment The Department of Natural Resources and Community Development (NRCD) has reviewed.the Department of . Transportation's (DOT) EA/FONSI for Bridge No. 11 over Broad Creek and Bridge No. 23 over Gales Creek. As a result of this review, we question whether the hydrologic study is sufficient evidence to show there is no improvement in tidal flushing when the length of the bridge opening is increased at each creek. In addition, we oppose "best management practices" as appropriate mitigation for the anticipated wetland takings. These concerns have been brought to DOT's attention in previous correspondence and meetings but have been dismissed as unnecessary and too expensive. Since our last meeting with DOT on June 5, NRCD staff members have continued to investigate and conduct site visits. The professional opinion of Dr. John Miller, North Carolina State University (NCSU) Zoology that causeways across tidal creeks have undoubtedlyralteredis circulation patterns within the creeks, which would therefore impact sedimentation, the benthic biota, and periods of inundation. Dr. Miller is currently working with a French scientist who has demonstrated that impedance to flow in lagoons has produced areas prone to anoxic conditions and this is clearly demonstrated in the benthic biota. of sediment cores from these creeks be undertakendtohdetermineyif anoxic conditions were created by the causeways. Gary Evink of the Florida Department of Transportation studied a bridge-causeway system in the Indian River, FL before and after construction. His observations of the effect of the causeway included wastewater loading, formation of organic sinks, low dissolved oxygen, and sedimentation in the corner areas. He stated that the flow in a system with causeways is in a straight line rather than in a sheet across the system and thus there is a tendency for "dead" areas to form. NRCD strongly recommends further study be undertaken in Broad and Gales Creeks to.investigate sedimentation away from the channels, effects on the benthic biota, and the potential for anoxic conditions to develop behind the causeways. Until a more thorough study is conducted NRCD cannot concur with the results or assume that the hydrologic study conducted at NCSU adequately addresses our concerns about tidal flushing. This document also indicates that best management practices will be substituted as appropriate mitigative measures: This is inconsistent with the Coastal Resources Commission's mitigation policy and general guidelines for development in AEC's. Adopting mitigation measures would not only comply with these laws but would protect the aquatic vegetation recently discovered by the Division of Coastal Management (DCM) on the west side of Gales Creek. According to DCM the vegetationis dominated by eel grass and about 2500 sq. ft. would be directly displaced by the proposed filling requirements proposed by DOT. With grass s being a sensitive resource, on the order of Primary NurserybAreas in terms of resource productivity, DCM continues to find these projects inconsistent with the CAMA use standards for development. In conclusion, this Department feels that before these bridge replacements are allowed, adequate assessment of their a coF4_a?fJCObaa? impacts on our resources must be made. Concerns revealed by our review show that the FONSI is not warranted in this instance. Before such a determination can be accepted outstanding issues previously discussed must be addressed by amending the EA/FONSI to support such a finding. SUBJECT: North Carolina Department of Transportation (DOT) - Bridge Replacement Projects for Bridges #11 and #23 Over Broad and Gales Creek, in Carteret County The North Carolina Coastal Federation has reviewed the Finding of No Significant Impact (FONSI) in regard to this bridge replacement project, the Major CAMA Permit Application to the Division of Coastal Management, the 404 Permit Application to the U.S. Army Corps of Engineers, and the application for the 401 Water Quality Certification submitted to the Division of Environmental Management. We offer the following public comments to be included in the permit application files: (1) The FONSI ignores significant public comments that were made at the public hearing in regard to this project and a petition signed by over 200 people. DOT never did any follow-up with the people that attended the public hearing nor did it respond to the citizens that signed the petition despite their requests to receive up-dates as to the status of this project. (2) The Coastal Federation endorses comments that have been made by both federal and state environmental review agencies in regard to the need to lengthen the new bridges to 300 feat. Private developers would 47- never be allowed to fill open water and seagrass habitat as DOT proposes. DOT should set an example with this project by avoiding all unnecessary losses of wetlands and by attempting to restore water quality in these creeks by removing existing fill S a?jl? ..a Public Comments on Broad and Gales Creek Bridges July 5, 1989 Page 2. material that serves to dike the openings of these creeks. (3) A state environmental impact study should be prepared for this project as was requested by citizens who attended the public hearing. The discovery of eelgrass habitat at the Gales Creek bridge by Jim Mercer on June 14 is a clear example that the FONSI did not adequately evaluate the impacts of this project. The circulation study conducted as part of the FONSI is based on numerous assumptions with very little actual data or site observations. The comments submitted by the NC Division of Marine Fisheries is further evidence that the circulation study contained in the FONSI is inadequate. Furthermore, it is vital that all planned highway improvements along Highway 24 between Swansboro and Morehead City be considered at the same time so that the least environmentally and socially disruptive project can be designed before major financial commitments are made to the present route. The piecemeal process that DOT is currently using to evaluate impacts of improving Highway 24 do not allow the NC Division of Coastal Management or NC Division of Environmental Management to adequately consider cumulative impacts of these highway improvements. Given newly ratified legislation enacted by the NC General Assembly which requires state agencies to consider cumulative impacts of development in their permit reviews, a full Environmental Impact Study should be conducted as part of this public works project. (4) A public hearing on the 401 Certification for these bridges should be held. There has already been significant public concern expressed about this project. DOT has failed to provide meaningful opportunity for public comment. The Division of Environmental Management needs to hold a public hearing on the 401 Water Quality Certification to gather historical water quality information about these creeks that is only known by local residents who lived near and fished them prior to construction of the causeways in 1942. Thank you for considering these comments.
