Subject: Addendum to 2019 Pretreatment Annual Report
Dear Ms. Zhong,
The enclosed is a modification to the Charlotte Water (CLTWater) 2019 Pretreatment Annual Report as well as
confirmation of the publication of SIUs in SNC for Compliance Year 2019.
A corrected Pretreatment Performance Summary is attached. Per communication with DEQ on 03/30/2020 and
04/06/2020 clarifying what should be included on the form, the numbers of SIUs in SNC for violation of permit limits
(Item 10) was changed from 4 to 3. An SIU in SNC for a slug discharge (Carolina Foods) was removed from the count.
The count for SIUs in SNC for reporting (Item 11) was also adjusted from 2 to 1; this number was initially reported
incorrectly.
A revised SNC report is also attached. Two non -significant industrial users, Edifice, Inc. and Piedmont Pipe
Construction, were removed from the report. Following appeals of the NOVs with designation of SNC issued to these
companies, informal review meetings were held on 03/04/2020. Following the informal reviews, the penalty for each
user was reduced from $10,000 to $1,000 and the designation of SNC was removed. These users have therefore been
removed from the SNCR.
AERC Acquisition Corporation d/b/a DART, A Clean Earth Company appealed the use of the term "manipulation" in the
NOV issued to them on 08/27/20190 A settlement was reached, and Charlotte Water withdrew the allegation of
manipulation. The associated NOV was re -issued on 04/03/2020 for "failing to ensure self -monitoring was
representative of prevailing conditions." This change is reflected in the attached revised SNC report and NOV
summary and an updated Narrative for this SIU is also attached.
CLTWater has taken the appropriate steps as required in 40 CFR 403.8(f)(2)(viii) and provided public notice of users
in SNC. A notice was issued in The Charlotte Business Journal on 04/24/2020 for SIUs in SNC during Compliance Year
2019. This information was also posted on Charlotte Water's website for a limited time. Documentation of the
publication is attached.
