The SIU was not in SNC for the January to June 2018 reporting period.
The SIU was in SNC for the July to December 2018 reporting period.
During May of 2018, the Control Authority suspected that non -representative
discharge was occurring during sampling events. Due to this, the Control
Authority conducted investigative sampling in a manhole downstream. Sampling
was performed in the manhole the weeks before, during and after sampling was
occurring at the SIU. Sampling in the manhole downstream occurred from
07/17/2018 to 08/04/2018 and again from 10/09/2018 to 10/27/2018. Sampling
at the SIU occurred from 07/24/2018 to 07/27/2018 and 10/16/2018 to
10/19/2018. During both sampling events, the Control Authority observed that
the samples collected in the manhole contained drastically lower concentrations
of cBOD, COD, and several organic parameters when we were also sampling at
the SIU's monitoring point versus when we were not.
Due to the results of the two sampling events, the Control Authority conducted an
unannounced site visit while the SIU was discharging at night. On 04/24/2019,
the Control Authority performed a site visit at approximately 19:50 and set up a
sampler at Pipe 001. The Control Authority collected samples over the next two
days and pollutant levels were much higher than previous sampling events at
Pipe 001, including a cBOD slug which occurred on 04/25/2019. With this
information, the Control Authority began moving forward with enforcement action.
The SIU was issued a Compliance Order (CO) on 08/07/2019 due to the SIU
discharging non -representative wastewater while monitoring was being
conducted. The SNC designation was retroactive to the July through December
2018 reporting period due to the samples taken downstream which confirmed
non-compliance during this time. An NOV and cost recovery assessment were
also issued to the SIU in 2019.
The annual inspection was conducted on 12/17/2018.
Haz—Mat Environmental Services, LLC was a recipient of the CLTWater
Environmental Excellence Gold Award for 2017.
The SIU will be published.

1020 AERC Acquisition Corporation d/b/a DART, A Clean Earth Company
(Previously "DART Acquisitions, LLC")
Due to elevated pollutant loadings at the Irwin Creek WWTP beginning in April
2018, the Control Authority conducted an extensive investigation to determine
the source. As a result of the investigation, the SIU was found to be in violation
for failing to ensure that self -monitoring and sampling was representative of
prevailing conditions during the period of April 2018 to November 2018 for Pipe
002. An NOV with a civil penalty of $25,000 and designation of SNC was issued
in 2019.
Pipe 001 (Metals waste stream)
The SIU was not in SNC for the January to June 2018 reporting period for Pipe
001.
The SIU was not in SNC for the July to December 2018 reporting period for Pipe
001.
Pipe 002 (Organic/Oily waste stream)
The SIU was in SNC for the January to June 2018 reporting period for Pipe 002.
The SIU was in SNC for the July to December 2018 reporting period for Pipe
002.
Permit #1020 was modified on 09/05/2018 to reflect the industry name change to
AERC Acquisition Corporation d/b/a DART, A Clean Earth Company.
AERC Acquisition Corporation d/b/a DART received an NOV with the designation
of SNC on 02/08/2019. for exceeding the 33% TRC criteria for the parameter of
TTO during the July to December Compliance Judgement Period. A civil penalty
of $500.00 was applied.
AERC Acquisition Corporation d/b/a DART discharged slugs of TTO on
12/12/2018 at 29.4mg/I (7.35 times the permitted limit), on 12/14/18 at 29.2mg/I
(7.3 times the permitted limit), on 12/18/18 at 33.3mg/I (8.3 times the permitted
limit), on 12/19/18 at 29.8mg/I (7.45 times the permitted limit), on 12/20/18 at
43.6 mg/I (10.9 times the permitted limit), and on 12/21/18 at 20.0mg/I (5 times
the permitted limit) at Pipe 002. The SIU also discharged slugs of p-cresol on
12/12/18 at 1.9mg/I (9.3 times the permitted limit), on 12/14/18 at 2.9mg/I (14.1
times the permitted limit), on 12/18/18 at 2.4mg/I (11.7 times the permitted limit),
on 12/19/18 at 1.4mg/I (6.8 times the permitted limit), on 12/20/18 1.85mg/I (9.02
times the permitted limit), and on 12/21/18 at 0.48mg/I (2.3 times the permitted
limit) at Pipe 002. During the same monitoring event, the SIU discharged cBOD
on 12/14/18 at 24,OOOmg/I (15.99% of the Irwin Creek WWTP MAIL ), on
12/20/18 at 47,OOOmg/I (22.1 % of the MAIL ), and on 12/21/18 at 12,OOOmg/I
(6.48% of the MAIL at Irwin Creek WWTP) at Pipe 002 The SIU does not have a

limit for cBOD, however these were still considered slug discharges due to the
potential for impact to the Irwin Creek WWTP, including potential for interference
and/or pass -through. An NOV for these slug discharges with a civil penalty of
$25,000 was issued in 2019.
The SIU appealed the NOVs issued in 2019. As described in the City's Sewer
Use Ordinance an Informal Review was held along with further negotiations. A
Settlement Agreement was reached between the SIU and the Control Authority in
2020. As a result of the Settlement Agreement signed on 03/28/2020, the SIU
agreed to pay the total sum of $50,500.00 in connection with the NOVs issued for
violations that occurred in 2018 and was published in an addendum to the 2018
Public Notice and updated in the corresponding 2018 SNC Report addendum.
The annual inspection was conducted on 06/14/2018.
The SIU will be published.
