THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Envirrmental Management
Regulations in 15 NCAC 2H, Section .0500 to N.C. Department of
Transportation pursuant to an application filed on the 26th day of
February, 1988 to extend SR1243 (Country Club Boulevard) across Calico
Creek.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Calico
Creek in conjunction with the proposed roadway crossing in Carteret
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will.-not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).
2. That silt fences and other erosion control measures
be in place prior to an earthen movement in the area
of the wetlands.
3. That all fill material be from a clean upland source
free from any toxic material.
4. That the side slopes of the filled area be stabilized
with vegetation as soon as possible to minimize erosion.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Dear Mr. Parker:
Reference the application of the Division of Highways, North
Carolina Department of Transportation, for a Department of the
Army permit to place fill material in the waters/wetlands of
Calico Creek associated with improvement and extension of
S.R. 1243, Country Club Boulevard, Morehead City, Carteret County,
North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The placement of fill material in wetlands will be
strictly limited to the areas indicated on the plans.
b. Silt fences and erosion control measures will be in place
prior to any work within wetlands.
c. All fill materials will be obtained from a high ground
source. It will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly
debris will not be used.
d. The side slopes of the fill will be stabilized with
vegetation as soon as possible so as to minimize erosion.

e. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 25 NTU's or less are not
considered significant.
By letter of April 1, 1988 (copy enclosed), the National
Marine Fisheries Service (NMFS) recommended that:
A mitigation plan to compensate for all wetland losses will be
developed, submitted and approved prior to the start of any work
on roadway construction.
It is the Corps of Engineers' policy to require compensatory
mitigation only when necessary to ensure that the activity is not
contrary to the public interest. Therefore, although we cannot
support the NMFS's condition as a required condition, we do offer
it as support for comments that we understand you have received
from State review agencies. We would offer no objection should
you determine that this condition need be included in the State
authorization.

9. NARRATIVE DESCRIPTION: The North Carolina Department of
Transportation is proposing to extend SR 1243, known as
Country Club Boulevard, across the upper end of Calico
Creek, located on the north side of Morehead City, in
Carteret County. The color aerial photography referenced on
the front page of this report shows clearly how efforts were
made several years ago to construct an earthen causeway
across=,,this particular section of Calico Creek. What
remains today is an unsanctioned dirt road measuring 15' to
20' wide; extending some 600' north from where the pavement
ends on SR 1243. Mature pine trees and saltbushes now
stabilize the side slopes of the causeway in an area 10' to
15'„fide creating the total width of the existing road bed.
Rdmnants of an old bulkhead and a pedestrian bridge link the
causeway to the north shore some 18' across the Creek. The
"Beaufort" topographic map photorevised in 1983 also shows
the light duty road crossing Calico Creek near the Morehead
Middle School.
Calico Creek is a tidal tributary of the Newport River
system. About 2,000 feet downstream of the project site is
the Morehead City wastewater treatment plant and point of
discharge into Calico Creek. Wide fringes of saltmarsh
cordgrass border both sides of the creek and in the area
around the existing causeway. At this point in the creek
system, the old causeway constricts the tidal flow to a
s narrow passage between the two banks. The Division of
Marine Fisheries has designated Calico Creek as a Primary
Nursery Area. Although the shallow mudflats and marshes in
the upper end of Calico Creek are productive nursery habitat
for juvenile shrimp and finfish, the immediate project site
lacks any sign and indication of oysters or clams.
The proposed project will involve the installation of two
concrete culverts each measuring 60' long x 70' wide x 6'
high. In order to provide a suitable foundation, the creek
bed will be excavated to a depth of -2.51. Approximately
100 cubic yards of sandy mud will be removed from the
culvert alignment. The same area measuring about 60' x 18'
x 2.5' will be backfilled with suitable material to support
the two boxed culverts.
In addition to the filling requirements for the boxed
culverts, the total width of the existing causeway will have
to be widened from 30' to 601. This will require filling an
area on the downstream side of the causeway about 15' wide x
500' long. This area contains approximately 7,500 sq. ft.
of saltmarsh cordgrass. On the upstream side of the
causeway, approximately-4,696 sq. ft. of saltmarsh cordgrass
and

intertidal mudflat will be displaced by the filling
requirements. Another 3,000 sq. ft. of wetlands
characterized as Section 404 Wooded Swamp will be removed
from the west side of the causeway where it joins the
highground property and the end of SR 1234. On the north
side of Calico Creek, the proposed roadway will extend
approximately 100' and will join the newest section of
` Country. Club Boulevard constructed within a new section of
Mandy Paflns Subdivision. The proposed project will greatly
improve vehicular traffic flow and emergency access to and
from the Morehead Middle School where grades 6, 7 and 8 are
located on the south side of Calico Creek near the point of
inte#section with the proposed project.
10. ANTICIPATED IMPACTS: The extension of SR 1243 and the
crossing of Calico Creek will displace some 12,000 sq. ft.
of saltmarsh cordgrass and approximately 1,000 sq. ft. of
intertidal bottomland. In addition, the expansion project
will also involve the loss of 3,000 sq. ft. of wooded,
wetlands. The combined resource value of 15,000 sq. ft., or
.34 acres, constitutes a significant impact or loss to the
local ecology of Calico Creek, a designated Primary Nursery
Area. During construction, instream turbidity and siltation
can become a problem if proper sedimentation control
measures are not employed around the causeway and in the
creek. On a more positive note, the proposed project will
generate a significant amount of public good in the Morehead
city community by improving vehicular traffic flow and
emergency access to the school.
CAMA REVIEW: The 1986 Land Use Plan Update for the Town of
Morehead City classifies the highground property around
Calico Creek as "Transitional" and the Estuarine Waters and
Coastal Wetlands of Calico Creek as "Conservation". The
Town of Morehead City strongly supports the proposed road
crossing of Calico Creek, but the Land Use Plan seems to
present a contradiction. On page #24 under the physical
constraints section, the plan states that the land within a
primary nursery area should remain in its natural state.
While on page #32 of their plan a policy statement for
resource protection indicates the Town's support for work
associated with bridges, bridge approaches and culverts that
may occur within Estuarine Areas of Environmental Concern.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.

9. NARRATIVE DESCRIPTION: The North Carolina Department of
Transportation is proposing to extend SR 1243, known as
Country Club Boulevard, across the upper end of Calico
Creek, located on the north side of Morehead City, in
Carteret County. The color aerial photography referenced on
the front page of this report shows clearly how efforts were
made several years ago to construct an earthen causeway
across this particular section of Calico Creek. What
remains today is an unsanctioned dirt road measuring 15' to
20' wide, extending some 600' north from where the pavement
ends on SR 1243. Mature pine trees and saltbushes now
stabilize the side slopes of the causeway in an area 10' to
15' wide creating the total width of the existing road bed.
Remnants of an old bulkhead and a pedestrian bridge link the
causeway to the north shore some 18' across the Creek. The
"Beaufort" topographic map photorevised in 1983 also shows
the light duty road crossing Calico Creek near the Morehead
Middle School.
Calico Creek is a tidal tributary of the Newport River
system. About 2,000 feet downstream of the project site is
the Morehead City wastewater treatment plant and point of
discharge into Calico Creek. Wide fringes of saltmarsh
cordgrass border both sides of the creek and in the area
around the existing causeway. At this point in the creek
system, the old causeway constricts the tidal flow to a
narrow passage between the two banks. The Division of
Marine Fisheries has designated Calico Creek as a Primary
Nursery Area. Although the shallow mudflats and marshes in
the upper end of Calico Creek are productive nursery habitat
for juvenile shrimp and finfish, the immediate.project site
lacks any sign and indication of oysters or clams.
The proposed project will involve the installation of two
concrete culverts each measuring 60' long x 70' wide x 6'
high. In order to provide a suitable foundation, the creek
bed will be excavated to a depth of -2.5'. Approximately
100 cubic yards of sandy mud will be removed from the
culvert alignment. The same area measuring about 60' x 18'
x 2.5' will be backfilled with suitable material to support
the two boxed culverts.
In addition to the filling requirements for the boxed
culverts, the total width of the existing causeway will have
to be widened from 30' to 60'. This will require filling an
area on the downstream side of the causeway about 15' wide x
500' long. This area contains approximately 7,500 sq. ft.
of saltmarsh cordgrass. On the upstream side of the
causeway, approximately 4,696 sq. ft. of saltmarsh cordgrass
and

intertidal mudflat will be displaced by the filling
requirements. Another 3,000 sq. ft. of wetlands
characterized as Section 404 Wooded Swamp will be removed
from the west side of the causeway where it joins the
highground property and the end of SR 1234. On the north
side of Calico Creek, the proposed roadway will extend
approximately 100' and will join the newest section of
Country Club Boulevard constructed within a new section of
Mandy Farms Subdivision. The proposed project will greatly
improve vehicular traffic flow and emergency access to and
from the Morehead Middle School where grades 6, 7 and 8 are
located on the south side of Calico Creek near the point of
intersection with the proposed project.
10. ANTICIPATED IMPACTS: The extension of SR 1243 and the
crossing of Calico Creek will displace some 12,000 sq. ft.
of saltmarsh cordgrass and approximately 1,000 sq. ft. of
intertidal bottomland. In addition, the expansion project
will also involve the loss of 3,000 sq. ft. of wooded
wetlands. The combined resource value of 15,000 sq. ft., or
.34 acres, constitutes a significant impact or loss to the
local ecology of Calico Creek, a designated Primary Nursery
Area. During construction, instream turbidity and siltation
can become a problem if proper sedimentation control
measures are not employed around the causeway and in the
creek. On a more positive note, the proposed project will
generate a significant amount of public good in the Morehead
City community by improving vehicular traffic flow and
emergency access to the school.
CAMA REVIEW: The 1986 Land Use Plan Update for the Town of
Morehead City classifies the highground property around
Calico Creek as "Transitional" and the Estuarine Waters and
Coastal Wetlands of Calico Creek as "Conservation". The
Town of Morehead City strongly supports the proposed road
crossing of Calico Creek, but the Land Use Plan seems to
present a contradiction. On page #24 under the physical
constraints section, the plan states that the land within a
primary nursery area should remain in its natural state.
While on page #32 of their plan a policy statement for
resource protection indicates the Town's support for work
associated with bridges, bridge approaches and culverts that
may occur within Estuarine Areas of Environmental Concern.

APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Natural Resources and Community
Development hereby gives public notice as required by NCGS
113A-119(b) and 143-215 3(a)(1)(c) that North Carolina Department
of Transportation of Carteret County, filed an application on
February 11, 1988, for a permit from the Division of Coastal
Management to develop in an Area of Environmental-Concern and for
certification from the Division of Environmental Management that
a discharge of fill material in project wetlands will not violate
applicable water quality standards.
According to said application the applicant is proposing to
extend SR 1243 across Calico Creek by installing two 7' x 6' box
culverts and fill to create a causeway with a 20' wide paved road
on Country Club Boulevard, in Morehead City, Carteret County.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of
James L. Mercer, Division of Coastal Management, located in the
Division of Marine Fisheries Building, Morehead City, N.C.,
919/726-7021, and/or the office of Preston Howard, Division of
Environmental Management, NRCD Regional Field Office, Wilmington,
N.C., Telephone (919) 256-4161.
The Division of Environmental Management proposes to take
final action on this water quality certification on or before
April 10, 1988. The issuance of the CAMA Major Development
permit and the Section 401 Certification may deviate from this
projected date depending upon the nature of the comments
submitted and subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Mr. David Owens, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to March
31, 1988 for consideration in the CAMA permit decision, and to
Mr. Bill Mills, Division of Environmental Management, P.O. Box
27687, Raleigh, N.C., 27611, prior to March 31, 1988 for
consideration in the water quality certification decision. Later
comments on the CAMA application will be accepted and considered
up to the time of permit decision. Project modifications may
occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter
will be provided upon request.

will deem that waiver has occurred.

In 'addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate v ork plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners.'These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

8 ADDITIONAL INFORMATION
In 'addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 Y2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners.' These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

9 CERTIFICATION AND PERMIS-
SION TO ENTER ON LAND
Any permit issued in response to this application
will allow only the development described in the
application. The project will be subject to condi-
tions and restrictions contained in the permit.

posed activity complies with the State of North
Carolina's approved Coastal Management Program
