CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management-
Regulations in 15 NCAC 2H, Section .0500 to N. C. Dept. of
Transportation pursuant to an application filed on the 21st day of
August, 1988 to replace the Sunset Beach Bridge.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Atlantic
Intracoastal Water Way in conjunction with the proposed bridge
replacement in Brunswick County will not result in a violation of
applicable Water Quality Standards and discharge guidelines. Therefore,
the State of North Carolina certifies that this activity will not
violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions hereinafter
set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction-
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).
2. That silt fences and other erosion controls be in place prior
to any earthen movement in the area of the wetlands.
3. That all fill material be clean material from an upland source
and free of any toxic materials.
4. That the side slopes of the filled areas be stabilized with
vegetation as soon as possible to prevent erosion.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Project Description: The N.C. D.O.T. plans to replace the steel
barge swing span drawbridge with a new
fixed highway bridge.
Adjacent Water Body: AIWW
Classification: SA
Status: Closed
The project has been reviewed to determine impacts to water
quality. The following comments are provided:
The project will require a 401 certification and that
certification should include the following conditions for
the filling of wetlands:
a. That silt fences and other erosion controls be in place
prior to any earthen movement in the area of the
wetlands.
b. That all fill material be from a clean upland source,
free from any toxic material.
c. That the turbidity in the water not exceed 25 NTU due to
the project.
d. That the side slope of the filled area be stabilized
with vegetation as soon as possible to prevent erosion.
This office has no objection to the project as proposed.

To Whom It May Concern
All interested parties are notified that an application has been
received from the North Carolina Department of Transportation by
the Commander, Fifth Coast Guard District, for approval of
location and plans for construction of a fixed highway bridge
over a navigable waterway of the United States.
WATERWAY AND LOCATION: Atlantic Intracoastal Waterway, mile
337.9, Sunset Beach, North Carolina.
CHARACTER OF WORK: To replace a steel barge, swing span
drawbridge with a new fixed highway bridge.
MINIMUM NAVIGATIONAL CLEARANCES:
Existing
Horizontal: 82' between fender
systems normal to the axis of
the channel.

Vertical: 0' (pontoon bridge)

ENVIRONMENTAL CONSIDERATIONS: The Federal Highway
Administration, the lead Federal Agency, has approved this
project as a Finding of No Significant Impact. The bridge will
be located in the floodplain. The existing bridge and
surrounding area are within the 100 year floodplain. No
significant encroachments on the floodplain are expected to occur
due to the proposed project. The proposed bridge is along an
alignment west of the existing bridge. Approximately 6 acres of
right-of-way will be taken for highway purposes. The loss of
approximately 11 acres of wetland due to dredging and filling
will occur. The amount of acreage and wetland loss differs from
the amount published in the Environmental Assessment. This .
change was verified via a telephone conversation on August 10,
1988, between NC DOT and the Coast Guard. The type of wetland to
be impacted will be low tidal marshland consisting of smooth
cordgrass, glasswort, sea lavender, salt meadow grass, black
needlerush and sea ox-eye.

Mitigation measures will consist of the roadbed being elevated by
piers and/or pilings over much of the marsh:?and; the earthen
causeway will be removed to compensate for the loss of marsh
vegetation which will be returned to biological production; all
fill material will be removed down to the existing marsh
elevation to allow for revegetation of marsh grasses; and
saltmarsh cordgrass will be planted to enhance restoration of the
impacted wetlands.
To maintain water quality during and after the construction of
the proposed bridge, erosion control will be in accordance with
Section 107-13 of NC DOT Standard Specifications for Roads and
Structures.
In the Environmental Assessment, it was recommended that some
additional testing be conducted to determine if archaeological
features were preserved under the shell midden layer. Additional
tests were conducted in May 1982 and the findings were negative.
The report was submitted to the State Historic Preservation
Officer. SHPO then requested further testing be conducted to
determine if the site was eligible for the National Register of
Historic Places. This test was completed in September 1985 and
the test revealed the midden deposits very thin and insignificant
in the proposed right-of-way. The conclusion that the proposed
project will have no effect on significant archaeological
resources or properties eligible for inclusion in the National
Register of Historic Places is accepted by -SHPO in their letter
dated October 31, 1985.
There are no wildlife and waterfowl refuges, recreational areas,.
public parks or historic sites in the vicinity of the bridge.
The North Carolina Division of Coastal Management has advised the
applicant that a formal CZM consistency statement will not be
required. The State's position of consistency will be included
as part of the CAMA permit.
SOLICITATION OF COMMENTS:
Interested parties are invited to express their views in writing
on the proposed. bridge giving sufficient detail to establish a
clear understanding of their reasons for support of or opposition
to the proposed work. Comments will be received for the record
at the office of the Commander (ob), Fifth Coast Guard District,
431 Crawford Street, Portsmouth, Virginia 23704-5004 through
September 26, 1988.

PERMIT AND WATER QUALITY CERTIFICATION
The Department of Natural Resources and Community Development hereby gives
public notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that

filed an application on June 23, 1988 for- 9L permit from
the Division of Coastal Management to develop in an Area of Environmental Concern
and for certification from the Division of Environmental Management that a discharge
of fill material in project wetlands will not violate applicable water quality standards.
According to said application The applicants propose to repl nrP the Pxi ding
swim bridge connecting the mainland to Sunset Beach with a fixed-span high riGP
structure.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal
business hours of the Division of Coastal Management and/or the Division of
Environmental Management, Regional Office 7225 Wrightsville Avenue, Wilmington,
North Carolina 28403.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before October 13, 1988
The issuance of the CAMA Major Development Permit and the Section 401 Certification
may deviate from this projected date depending upon the nature of the comments
submitted and subsequent hearings that may arise.
All persons desiring to make comments should do so in writing to Mr. David
Owens, Director, Division of Coastal Management, P.O. Box 27687, Raleigh, North
Carolina 27611 prior to October 8 1988 for
consideration in the CAMA permit decision, and to Mr. Bill Mills, Division of
Environmental Management, P.O. Box 27687, Raleigh, North Carolina 27611 prior to
October 8, 1988 for consideration in the water quality
certification decision. Later comments on the CAMA application will be accepted and
considered up to the time of permit decision. Project modifications may occur based
on review and comment by the public and state and federal agencies. Notice of the
permit decision in this matter will be provided upon written request.
