This permit, issued on 3113/87 '~*/ 'b .is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
perm,ittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The modified project must be carried out in strict compliance with the project
plans.
(2) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surround-
ing waters.
(3) The rip-rap will be of a size sufficient to prevent its movement offsite
by currents or wave action.
(4) The rip-rap material will be clean and free of any pollutants, except in
trace quantities. Metal products, organic materials, or unsightly debris
will not be used.
(5) The disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within thirty. (30) days of project completion.

'This permit action may be appealed by the permittee
of other qualified persons within twenty (20) days of the
issuing date. 'An appeal requires resolution prior to work
initiation of continuance, as the case may be.
"This permit must be accessible on-site to Department
personnel lien the project-is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval
All work must cease when the permit expires on
December 31, 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(6) The activity shall be'conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction
related discharge (increases such that the turbidity in the Stream is 25
NTUs or less are not considered significant).
NOTE: The Division of Environmental 'Management issued Water Quality Certification
No. 2028 on February 27, 1987 for the initial rip-rap work. The modified
project is certified under General Water Quality Certification No. 1664
issued on September 8, 1983 for rip-rap placement.
NOTE: The U. S. Department of the interior issued Special Use Permit No. AR 86-11
for the project activity authorized in March of 1987. A modified special
use permit has been applied for by the Department of Transportation. No
work may be carried out until the amended permit is issued by the
U.S. Department of the Interior.

Reference your request for modification to State/Federal
authorization to place additional riprap material and armor stone
along the shorelines of Oregon Inlet, adjacent the N.C. Highway 12
Bridge, Dare County, North Carolina.
Your modified plan has been reviewed and is consistent with
the provisions and objectives of general permit No. SAWC080-N-000-
0291. Therefore, you may continue construction activity in strict
accordance with modified State permit, No. 56-87. Failure to
comply with the State authorization or conditions of the general
permit could result in a violation of Federal law.
If any additional change in your work is required because of
unforeseen or altered conditions or for any other reason, plans
revised to show the change must be sent promptly to this office
and the North Carolina Division of Coastal Management prior to
performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization
modified.

Reference the April 22, 1988, letter from the North Carolina
Department of Transportation whereby they requested the
modification of their State/Federal permit which authorized the
placement of riprap material for the stabilization of the southern
shoreline of Oregon Inlet, adjacent the N.C. Highway 12 Bridge,
Dare County, North Carolina. This proposed modification involves
the placement of additional riprap material on the ocean side of
the bridge and to cover all riprap material with armor stone.
We have coordinated this matter with the Federal agencies, and
neither they nor we have any objections to the proposed
modification.

SUBJECT: Dare County, Shoreline Stabilization on NC 12 at
South Shore of Oregon Inlet Bridge--Permit No. 56-.87
Reference is made to our April 22nd letter.requesting that the
subject permit be modified to authorize the placement of additional
rip-rap along the shoreline. We have since determined that the
additional protection should also be extended 225 feet toward
the inlet, parallel to the bridge.
Therefore, please find enclosed a revised modification request
for adding 410 feet of rip-rap (225 feet westward and 185 feet
eastward) on the ocean side of the bridge and covering the entire
825-foot section of rip-rap with armor stone.
We anticipate awarding a contract for this work May 4th with the
provision that the contractor may begin work immediately upon
receipt of the required permits. The earliest date we anticipate
that work could begin at the site is May 11.
Your assistance in expediting this request would be greatly
appreciated.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 % x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of .
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113.229(d).

SUBJECT: Dare County, Shoreline Stabilization on NC 12 at
South Shore of Oregon Inlet Bridge--Permit No. 56-87
Accelerated migration of the ocean and inlet have resulted in-the
recent loss of several hundred additional feet of shoreline. This
poses no immediate threat to the Oregon Inlet Bridge; however,
continued erosion will remove the island's northern tip (known as
South Point). Inundation of South Point will remove the last
barrier that protects the bridge from the ocean. As a result,
the south end of the bridge would become exposed to more intense
wave action.
To protect the south end of the bridge, existing rip-rap should.
be extended and strengthened by adding a layer of-large armoring
stone. This is to be accomplished as quickly as possible. This
armor plating is necessary to achieve short-term stability of
the bridge. It is proposed to extend the recently installed rip-
rap on the ocean side approximately 185 feet and cover the entire
600-foot ocean side section of rip-rap with armor stone.
It is-requested that the existing permit be modified to include
this additional work. Attached are revised drawings showing the
work that has been accomplished and that which is proposed.
We are in the process of obtaining a Special Use Permit from the
U. S. Fish and Wildlife Service to allow us to undertake work on
Federal property. No work will be started outside the highway
right-of-way until we have the Special Use Permit.

An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 Yz x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and. the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-

quired by G.S. 113-229(d).

to place riprap material for stabilization of the southern
shoreline of Oregon Inlet, adjacent to the N.C. Highway 12 Bridge,
Dare County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on 321 31Z 2 h / , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surroun-
ding waters.
(2) The temporary placement or double-handling of excavated or rip-rap materials
within waters or vegetated wetlands is not authorized.
(3) No vegetated wetlands will be excavated or filled.
(4) The rip-rap will be of a size sufficient to prevent its movement offsite
by currents or wave action.
(5) The rip-rap material will be clean and free of any pollutants, except in
trace quantities. Metal products, organic materials, or unsightly debris
will not be used.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1990
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Reference the application of the North Carolina Department of
Transportation, Division of Highways, for a Department of the Army permit to
place rip rap material for stabilization of the shoreline on the southern bank
of Oregon Inlet, adjacent to the North Carolina Highway 12 Bridge, Dare County,
North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
a. All excavated materials will be confined landward of the mean high
water (MHW) elevation contour and any regularly or irregularly flooded
vegetated wetlands.
b. The temporary placement or double handling of excavated or rip rap
materials within waters or vegetated wetlands is not authorized.
c. No vegetated wetlands will be excavated or filled.
d. The rip rap material will be obtained from an upland source and placed
in strict accordance with the permit plans.
e. The rip rap material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
f. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in
` the waterbody is 50 NTU's or less are not considered significant.

The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Pamlico
Sound in conjunction with the proposed shore stabilization in Dare
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:

SITE DESCRIPTION
Highway 12 spans Oregon Inlet via the Oregon Inlet Bridge. The approachway on
the eastern side of Oregon Inlet has been stabilized by rock rip rap, however, the
adjacent property has eroded severely. The applicant states that the annual rate
is approximately 25 feet. The shoreline on either side of the bridge is characterized
by an exposed peatbed at the waters edge with a sloping sand beach extending land-
ward approximately 24 feet to an erosion escarpment. On the north side of the bridge
and landward of the erosion escarpment, there is a border of shrub thicket and
yaupon which continues to grade upward to the improved parking area. On the south
side of the bridge and landward of the erosion escarpment, there is a slight rise of
sand with some yaupon which drops off on the back side to a mixed Juncus roemerianus,
Spartina patens marsh. This marsh, though landward of the sandy berm and maritime
thicket, is connected to the Pamlico Sound on the southern border.
In order to abate the erosion on the adjacent property, the DOT has obtained a
special use permit from the U.S. Fish and Wildlife Service to place rip rap along
660 linear feet of the shoreline. Three hundred and twenty feet will extend to the
north of the bridge and will average 12 feet waterward of MHW. Three hundred and
forty feet will extend south of the bridge and will average 20 feet waterward of
MHW. There will be excavation below MHW to allow even placement of the filter cloth
and Class II rip rap. All rip rap will be placed waterward of the top of the sandy
beach and none is proposed to be placed in the marsh.
ANTICIPATED IMPACTS
The excavation below MHW will cause some localized elevated turbidity levels,
however, providing the spoil is retained on highground and stabilized, the effects
should be short term. The placement of rip rap will result in the filling of 10,560
square feet of shallow water habitat.
CAMA REVIEW
The project site is classified as conservation in the Dare County LUP. The
project is consistent with that plan subject to the conditions of the Special
Use Permit.
