Department of Transportation pursuant to an application filed on the 23rd day of August, 1988 to widen U.S. Highway 158 from 2 to 5 lanes between Southern Shores and Currituck Sound. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of tributaries to Currituck Sound in conjunction with the proposed highway project in Dare County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That appropriate sedimentation and erosion control practices shall be employed to minimize siltation and turbidity impacts. Violations of any condition herein set forth shall result in revocation of this Certification. WHITE, NC DOT, DIVISION OF HIGHWAYS BIO REPORT PAGE 2 BIO REPORT The applicant currently maintains US highway 158 in Kitty Hawk, Dare County. With stoplights and high seasonal traffic, the 2-lane highway 158 just east of the Curr.ituck Sound Bridge quickly becomes congested and presents long back-ups. To facilitate this problem, DOT proposes to widen US 158 from the Jean Guite bridge to the Business 158/Bypass 158 split; this widening will be from the present 2 lanes to a proposed 5 lanes. All of this proposed work will be carried out within the existing right-of-way of Highway 158. To provide adequate shoulder and base for the road widening, DOT plans to fill in 11404" wetland swales adjacent the existing road averaging 25' wide for a total linear length of 10381. These 11404" wetlands consist of red maple, willow and hickory and represent remnants of the dune and Swale system exemplary of the Outer Banks. Individual 11404" wetland swales are identified on the plat to be filled. Exact determination of the 11404" limits should be carried out by appropriate U.S. Army Corps of Engineers' representatives. No mitigation is offered or proposed for the loss of these ..6 acres of 11404" wetlands. ANTICIPATED IMPACTS Approximately .6 acres of 11404" wooded swamp wetlands will be filled and lost. No coastal wetlands will be impacted. CAMA REVIEW Although no constraints are identified for road construction in transition areas in the 1983 Kitty Hawk LUP, wetland areas are denoted as unique, fragile areas with special features which should not.be adversely impacted by development. According to said application NC DEPARTMENT OF TRANSPORTATION proposes to widen existing 2-lane Highway 158 to 5-lanes between Southern Shores and Currituck Sound, Dare County, N.C. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of David R. Griffin, Division of Coastal Management, located at Route 6, Box 203, Elizabeth City, N.C., (919) 264-3901, and/or the office of Bill Moore, Division of Environmental Management, NRCD Regional Field Office, Washington, N.C.
